Supplementary Provisions, Article 21Special Provisions on Early Payment of Employees' Old-Age Pension under the Special Provisions for a Person Who Has Spent Time as an Insured in Two or More Categories
第二十一条（二以上の種別の被保険者であつた期間を有する者に係る特例による老齢厚生年金の支給の繰上げの特例）
In the case of applying Article 13-4, paragraph (1) of the Supplementary Provisions to a person who has spent time as an insured in two or more categories, the request under that paragraph for the employees' old-age pension based on the time in one category, among the periods during which the person was an insured under the two or more insured categories, must be made at the same time as that request for the employees' old-age pension based on the time in another category.
二以上の種別の被保険者であつた期間を有する者について、附則第十三条の四第一項の規定を適用する場合においては、当該二以上の被保険者の種別に係る被保険者であつた期間のうち一の期間に基づく老齢厚生年金についての同項の請求は、他の期間に基づく老齢厚生年金についての当該請求と同時に行わなければならない。
In the case of the preceding paragraph, the provisions of Articles 13-4 through 13-6 of the Supplementary Provisions apply to each category of EPI insured period. In such a case, in addition to the phrase "the provisions of Article 13-4, paragraph (3) of the Supplementary Provisions" in Article 13-6, paragraph (1) of the Supplementary Provisions being deemed to be replaced with "the provisions of Article 13-4, paragraph (3) of the Supplementary Provisions based on the time in one category among the categories of EPI insured period", the phrase "the amount of the employees' old-age pension (" with "the amount obtained by adding together the amounts of the employees' old-age pension based on each category of EPI insured period (", the phrase "Article 46, paragraph (1)" with "Article 46, paragraph (1) as applied with terms replaced pursuant to the provisions of Article 78-29", the phrase "the employees' old-age pension for that month" with "the employees' old-age pension based on that time in one category for that month", the phrase "the amount obtained by subtracting the amount of the adjustment for the suspension of payment from the total of the amount equivalent to total monthly remuneration and the base monthly amount" with "the amount obtained by subtracting the amount of the adjustment for the suspension of payment from the total of the amount equivalent to total monthly remuneration and the base monthly amount, multiplied by the number obtained by dividing the amount obtained by dividing the amount of the employees' old-age pension based on that time in one category by 12 by the base monthly amount", the phrase "equal to or more than the amount of the employees' old-age pension" with "equal to or more than the amount of the employees' old-age pension based on that time in one category", and the phrase "the whole of the employees' old-age pension" with "the whole of the employees' old-age pension based on that time in one category", the replacement of terms necessary for the application of those provisions and other necessary particulars are specified by Cabinet Order.
前項の場合においては、各号の厚生年金被保険者期間ごとに附則第十三条の四から第十三条の六までの規定を適用する。この場合において、同条第一項中「附則第十三条の四第三項」とあるのは「各号の厚生年金被保険者期間のうち一の期間に基づく附則第十三条の四第三項」と、「老齢厚生年金の額（」とあるのは「各号の厚生年金被保険者期間に基づく老齢厚生年金の額を合算して得た額（」と、「第四十六条第一項」とあるのは「第七十八条の二十九の規定により読み替えて適用する第四十六条第一項」と、「当該老齢厚生年金」とあるのは「当該一の期間に基づく老齢厚生年金」と、「控除して得た額」とあるのは「控除して得た額に当該一の期間に基づく老齢厚生年金の額を十二で除して得た額を基本月額で除して得た数を乗じて得た額」と、「老齢厚生年金の額以上」とあるのは「当該一の期間に基づく老齢厚生年金の額以上」と、「老齢厚生年金の全部」とあるのは「当該一の期間に基づく老齢厚生年金の全部」とするほか、これらの規定の適用に関し必要な読替えその他必要な事項は、政令で定める。
