Supplementary Provisions, Article 11-3

①In the month that includes a day on which a beneficiary of an employees' old-age pension under the provisions of Article 8 of the Supplementary Provisions (limited to one the amount of which is calculated pursuant to the provisions of Article 9 and Article 9-4 of the Supplementary Provisions; hereinafter referred to as an "employees' old-age pension for mine workers and mariners") is the day on which the person is an insured, etc., if the total of the person's amount equivalent to total monthly remuneration and the amount obtained by dividing, by twelve, the amount of the employees' old-age pension (excluding the additional amount of pension prescribed in Article 44, paragraph (1) as applied mutatis mutandis pursuant to Article 9-4, paragraph (3) or (5) of the Supplementary Provisions (including the case where the example of Article 9-4, paragraph (6) of the Supplementary Provisions is followed); the same applies hereinafter in this paragraph) (hereinafter in this paragraph referred to as the "base monthly amount") exceeds the amount of the adjustment for the suspension of payment, payment of that employees' old-age pension for that month is suspended for the portion equivalent to the amount (hereinafter in this paragraph referred to as the "standard amount for a payment suspension") obtained by multiplying by twelve the amount equivalent to one-half of the amount obtained by deducting the amount of the adjustment for the suspension of payment from the total of the amount equivalent to total monthly remuneration and the base monthly amount; provided, however, that if the standard amount for a payment suspension is the amount of the employees' old-age pension or more, payment of the whole of the employees' old-age pension is suspended.

②With regard to an employees' old-age pension for mine workers and mariners paid to a person whose period of being an insured is wholly or partly a period of being a member of an employees' pension Fund, in the preceding paragraph, the phrase "the person's amount equivalent to total monthly remuneration and the amount obtained by dividing, by twelve, the amount of the employees' old-age pension" is deemed to be replaced with "the person's amount equivalent to total monthly remuneration and the amount obtained by dividing, by twelve, the amount of the employees' old-age pension calculated as if Article 44-2, paragraph (1) as it was prior to the amendment by Article 1 of the 2013 Amendment Act, which remains in force pursuant to the provisions of Article 86, paragraph (1) of the Supplementary Provisions of the 2013 Amendment Act, as applied mutatis mutandis pursuant to Article 9-4, paragraph (3) or (5) of the Supplementary Provisions (including the case where the example of Article 9-4, paragraph (6) of the Supplementary Provisions is followed), did not apply", the phrase "excluding the additional amount of pension prescribed in Article 44, paragraph (1) as applied mutatis mutandis pursuant to Article 9-4, paragraph (3) or (5) of the Supplementary Provisions (including the case where the example of Article 9-4, paragraph (6) of the Supplementary Provisions is followed); the same applies hereinafter in this paragraph" with "excluding the additional amount of pension prescribed in Article 44, paragraph (1) as applied mutatis mutandis pursuant to Article 9-4, paragraph (3) or (5) of the Supplementary Provisions (including the case where the example of Article 9-4, paragraph (6) of the Supplementary Provisions is followed) (hereinafter in this paragraph referred to simply as the "additional amount of pension"); the amount of the employees' old-age pension so calculated is hereinafter in this paragraph referred to as the "amount of the employees' old-age pension without Fund membership"", the phrase "the amount of the employees' old-age pension or more" with "the amount of the employees' old-age pension (excluding the additional amount of pension) or more", and the phrase "the whole of the employees' old-age pension" with "the whole of the employees' old-age pension (excluding the additional amount of pension where the standard amount for a payment suspension is less than the amount of the employees' old-age pension without Fund membership)".
