Article 17-2Procedures for Claiming Unpaid Benefits for Unemployment, etc.

①A person who intends to claim payment of benefits for unemployment, etc. under Article 10-3, paragraph (1) of the Act (hereinafter referred to as a "person claiming unpaid benefits") must, within six months counting from the day following the day on which the deceased qualified recipient, elderly qualified recipient, specially qualified recipient, qualified day worker recipient or person eligible to receive payment of employment promotion benefits, educational training benefits or continuous employment benefits (hereinafter referred to as "qualified recipients, etc." in this Section) died, submit to the Chief of the Public Employment Security Office of the deceased a written claim for unpaid benefits for unemployment, etc. (Form No. 10-4), with documents capable of proving the fact and the date of death of that qualified recipient, etc., documents capable of proving the relationship between the person claiming unpaid benefits and the deceased qualified recipient, etc., and documents capable of proving that the person claiming unpaid benefits had shared a livelihood with the deceased qualified recipient, etc. attached. In this case, where those benefits for unemployment, etc. fall under any of the following items (excluding the case where the deceased qualified recipient, elderly qualified recipient, specially qualified recipient, or person eligible to receive payment of employment promotion benefits or educational training benefits has been issued the notice of recipient qualification prescribed in Article 19, paragraph (3), the notice of recipient qualification for the elderly prescribed in Article 65-4, paragraph (1), the special recipient qualification notice prescribed in Article 68, paragraph (1) or the notice of educational training recipient qualification prescribed in Article 101-2-13, paragraph (2), respectively), the person must attach the documents specified in that item according to the category of benefits for unemployment, etc. listed in that item:

②In the case of the second sentence of the preceding paragraph, where there are legitimate grounds why the documents specified in the items of the preceding paragraph cannot be submitted, those documents may be omitted.

③When submitting the written claim for unpaid benefits for unemployment, etc., a person claiming unpaid benefits must make the notifications or submit the documents that the deceased qualified recipient, etc. would have been required to make or submit had the qualified recipient, etc. received payment of the benefits for unemployment, etc.

④A person claiming unpaid benefits may have an agent make the claim under this Article (excluding the case falling under Article 47, paragraph (1) (including as applied mutatis mutandis pursuant to Article 65, Article 65-5, Article 69, Article 77 and Article 101-2-28)). In this case, the agent must submit to the Chief of the Public Employment Security Office referred to in paragraph (1) the documents proving the agent's authority, with the documents prescribed in paragraph (1) and the preceding paragraph attached.
