The Ordinance for Enforcement of the Labor Standards Act is established as follows.

労働基準法施行規則を、次のように定める。

Article 2

第二条

Wages to be included in the total amount of wages provided in the provisions of paragraph (5) of Article 12 of the Labor Standards Act (Act No. 49 of 1947; hereinafter referred to as "the Act")are those to be paid other than in currency under the provisions of laws and regulations or collective agreement as permitted under the proviso in paragraph (1) of Article 24 of the Act.

労働基準法(昭和二十二年法律第四十九号。以下「法」という。)第十二条第五項の規定により、賃金の総額に算入すべきものは、法第二十四条第一項ただし書の規定による法令又は労働協約の別段の定めに基づいて支払われる通貨以外のものとする。

The estimated value of wages paid other than in currency as set forth in the preceding paragraph must be prescribed in the collective agreement unless otherwise provided by laws and regulations.

前項の通貨以外のものの評価額は、法令に別段の定がある場合の外、労働協約に定めなければならない。

When the estimated value prescribed in the collective agreement referred to in the provisions of the preceding paragraph is judged inappropriate, or the estimated value is not set forth in laws and regulations or collective agreement, the directors of the Prefectural Labor Offices may fix the estimated value of those other than currency.

前項の規定により労働協約に定められた評価額が不適当と認められる場合又は前項の評価額が法令若しくは労働協約に定められていない場合においては、都道府県労働局長は、第一項の通貨以外のものの評価額を定めることができる。

Article 3

第三条

When some grounds for calculation of a worker's average wages occurs in this worker's probationary period, the number of days and the wages during the period shall be respectively included in the period and the wages designated in the provisions of paragraphs (1) and (2) of Article 12 of the Act notwithstanding the provisions of paragraph (3) of the said Article.

試の使用期間中に平均賃金を算定すべき事由が発生した場合においては、法第十二条第三項の規定にかかわらず、その期間中の日数及びその期間中の賃金は、同条第一項及び第二項の期間並びに賃金の総額に算入する。

Article 4

第四条

In the event that the periods stipulated in items (i) to (iv) of paragraph (3) of Article 12 of the Act are three months or more preceding the day on which there arises a need for calculation of a worker's average wage, or in the event there arises a need for calculation of a worker's average wage on the day that the worker is taken into employment, the average wage of the worker shall be stipulated by the directors of the prefectural labor offices.

法第十二条第三項第一号から第四号までの期間が平均賃金を算定すべき事由の発生した日以前三箇月以上にわたる場合又は雇入れの日に平均賃金を算定すべき事由の発生した場合の平均賃金は、都道府県労働局長の定めるところによる。

Article 5

第五条

The working conditions that an employer must clearly indicate to a worker pursuant to the provisions of the first sentence of Article 15, paragraph (1) of the Act are to be those set forth in the following; provided, however, that this does not apply to the matters set forth in item (i)-2 except in the case of the conclusion of a labor contract with a definite term (hereinafter referred to as a "fixed-term labor contract" in this Article) under which that labor contract may be renewed after the expiration of its term, or to the matters set forth in items (iv)-2 through (xi) in the case where the employer does not establish provisions concerning those matters.

使用者が法第十五条第一項前段の規定により労働者に対して明示しなければならない労働条件は、次に掲げるものとする。ただし、第一号の二に掲げる事項については期間の定めのある労働契約(以下この条において「有期労働契約」という。)であつて当該労働契約の期間の満了後に当該労働契約を更新する場合があるものの締結の場合に限り、第四号の二から第十一号までに掲げる事項については使用者がこれらに関する定めをしない場合においては、この限りでない。

Matters concerning term of labor contract

労働契約の期間に関する事項

Matters concerning the standards for renewing a fixed-term labor contract (including, if there is a provision setting an upper limit on the total contract term (meaning the total contract term prescribed in Article 18, paragraph (1) of the Labor Contract Act (Act No. 128 of 2007)) or on the number of renewals of the fixed-term labor contract, that upper limit)

有期労働契約を更新する場合の基準に関する事項(通算契約期間(労働契約法(平成十九年法律第百二十八号)第十八条第一項に規定する通算契約期間をいう。)又は有期労働契約の更新回数に上限の定めがある場合には当該上限を含む。)

Matters concerning the place of employment and the work to be engaged in (including the scope of changes to the place of employment and to the work to be engaged in)

就業の場所及び従事すべき業務に関する事項(就業の場所及び従事すべき業務の変更の範囲を含む。)

Matters concerning starting hour and closing hour of work, whether there is labor to be done exceeding prescribed working hours, rest period, days off, leave, and the change in shifts in cases where workers work in two or more shifts

始業及び終業の時刻、所定労働時間を超える労働の有無、休憩時間、休日、休暇並びに労働者を二組以上に分けて就業させる場合における就業時転換に関する事項

Matters concerning methods of decision, calculation, and payment of wages (except retirement allowances and those wages falling under item (v); hereinafter the same shall apply in this item), the dates for closing account for wages and for payment of wages, and increases in wages

賃金(退職手当及び第五号に規定する賃金を除く。以下この号において同じ。)の決定、計算及び支払の方法、賃金の締切り及び支払の時期並びに昇給に関する事項

Matters concerning retirement (including grounds for dismissal)

退職に関する事項(解雇の事由を含む。)

Matters concerning the scope of workers covered, methods of determination of retirement allowances, calculation and payment of retirement allowances, and the dates for payment of retirement allowances

退職手当の定めが適用される労働者の範囲、退職手当の決定、計算及び支払の方法並びに退職手当の支払の時期に関する事項

Matters concerning wages paid in special circumstances (except retirement allowances), bonuses, those wages listed in each item of Article 8, and minimum wages

臨時に支払われる賃金(退職手当を除く。)、賞与及び第八条各号に掲げる賃金並びに最低賃金額に関する事項

Matters concerning meal expenses, supplies for work to be borne by workers, and any things to be covered

労働者に負担させるべき食費、作業用品その他に関する事項

Matters concerning safety and health

安全及び衛生に関する事項

Matters concerning vocational training

職業訓練に関する事項

Matters concerning accident compensation and support for injury and illness outside the course of employment

An employer must not make the working conditions that the employer must clearly indicate to a worker pursuant to the provisions of the first sentence of Article 15, paragraph (1) of the Act differ from the facts.

使用者は、法第十五条第一項前段の規定により労働者に対して明示しなければならない労働条件を事実と異なるものとしてはならない。

The matters specified by Order of the Ministry of Health, Labour and Welfare referred to in the second sentence of Article 15, paragraph (1) of the Act are to be the matters set forth in paragraph (1), items (i) through (iv) (excluding matters concerning pay raises).

法第十五条第一項後段の厚生労働省令で定める事項は、第一項第一号から第四号までに掲げる事項(昇給に関する事項を除く。)とする。

The method specified by Order of the Ministry of Health, Labour and Welfare referred to in the second sentence of Article 15, paragraph (1) of the Act is to be the delivery to the worker of a document that makes clear the matters prescribed in the preceding paragraph; provided, however, that if the worker has expressed a wish to use any of the following methods by which the matters prescribed in that paragraph are made clear, that method may be used.

法第十五条第一項後段の厚生労働省令で定める方法は、労働者に対する前項に規定する事項が明らかとなる書面の交付とする。ただし、当該労働者が同項に規定する事項が明らかとなる次のいずれかの方法によることを希望した場合には、当該方法とすることができる。

The method of transmission using a facsimile

ファクシミリを利用してする送信の方法

The method of transmitting an email or other telecommunications used to convey information to a specified recipient (meaning telecommunications prescribed in Article 2, item (i) of the Telecommunications Business Act (Act No. 86 of 1984); hereinafter referred to as "email, etc." in this item) (limited to a method by which the worker is able to prepare a document by outputting the record of the email, etc.)

電子メールその他のその受信をする者を特定して情報を伝達するために用いられる電気通信(電気通信事業法(昭和五十九年法律第八十六号)第二条第一号に規定する電気通信をいう。以下この号において「電子メール等」という。)の送信の方法(当該労働者が当該電子メール等の記録を出力することにより書面を作成することができるものに限る。)

In the case of the conclusion of a fixed-term labor contract under which, within its contract term, the worker becomes able to make an application to conclude a labor contract without a fixed term to which Article 18, paragraph (1) of the Labor Contracts Act applies (hereinafter referred to as an "application under Article 18, paragraph (1) of the Labor Contracts Act for a labor contract without a fixed term"), the working conditions that an employer must clearly indicate to the worker pursuant to the provisions of the first sentence of Article 15, paragraph (1) of the Act are to be, in addition to those prescribed in paragraph (1), matters concerning the application under Article 18, paragraph (1) of the Labor Contracts Act for a labor contract without a fixed term and, among the working conditions constituting the contents of the labor contract without a fixed term pertaining to that application, the matters set forth in paragraph (1), item (i) and items (i)-3 through (xi); provided, however, that this does not apply to the matters set forth in items (iv)-2 through (xi) of that paragraph among the working conditions constituting the contents of the labor contract without a fixed term pertaining to that application, in the case where the employer does not establish provisions concerning those matters.

その契約期間内に労働者が労働契約法第十八条第一項の適用を受ける期間の定めのない労働契約の締結の申込み(以下「労働契約法第十八条第一項の無期転換申込み」という。)をすることができることとなる有期労働契約の締結の場合においては、使用者が法第十五条第一項前段の規定により労働者に対して明示しなければならない労働条件は、第一項に規定するもののほか、労働契約法第十八条第一項の無期転換申込みに関する事項並びに当該申込みに係る期間の定めのない労働契約の内容である労働条件のうち第一項第一号及び第一号の三から第十一号までに掲げる事項とする。ただし、当該申込みに係る期間の定めのない労働契約の内容である労働条件のうち同項第四号の二から第十一号までに掲げる事項については、使用者がこれらに関する定めをしない場合においては、この限りでない。

In the case of the conclusion of a fixed-term labor contract under which, within its contract term, the worker becomes able to make an application under Article 18, paragraph (1) of the Labor Contracts Act for a labor contract without a fixed term, the matters specified by Order of the Ministry of Health, Labour and Welfare referred to in the second sentence of Article 15, paragraph (1) of the Act are to be, in addition to those prescribed in paragraph (3), matters concerning the application under Article 18, paragraph (1) of the Labor Contracts Act for a labor contract without a fixed term and, among the working conditions constituting the contents of the labor contract without a fixed term pertaining to that application, the matters set forth in paragraph (1), item (i) and items (i)-3 through (iv) (excluding matters concerning pay raises).

その契約期間内に労働者が労働契約法第十八条第一項の無期転換申込みをすることができることとなる有期労働契約の締結の場合においては、法第十五条第一項後段の厚生労働省令で定める事項は、第三項に規定するもののほか、労働契約法第十八条第一項の無期転換申込みに関する事項並びに当該申込みに係る期間の定めのない労働契約の内容である労働条件のうち第一項第一号及び第一号の三から第四号までに掲げる事項(昇給に関する事項を除く。)とする。

Article 5-2

第五条の二

If an employer intends to take charge of workers savings entrusted to the employer by workers, and in the event that the savings kept in custody constitute a deposit accepted, the employer shall fix, in an agreement provided in paragraph (2) of Article 18 of the Act, the following matters:

使用者は、労働者の貯蓄金をその委託を受けて管理しようとする場合において、貯蓄金の管理が労働者の預金の受入れであるときは、法第十八条第二項の協定には、次の各号に掲げる事項を定めなければならない。

Scope of depositors

預金者の範囲

Limit of deposit per depositor

預金者一人当たりの預金額の限度

Method of calculating interest rates and interest

預金の利率及び利子の計算方法

Procedures in accepting and paying out deposits

預金の受入れ及び払いもどしの手続

Article 6

第六条

A notification under the provisions of paragraph (2) of Article 18 of the Act must be submitted, according to Form No.1, to the director of the labor standards office which has jurisdiction over the location of the said workplace (hereinafter referred to as "the Director of the Labor Standards Office Concerned")

法第十八条第二項の規定による届出は、様式第一号により、当該事業場の所在地を管轄する労働基準監督署長(以下「所轄労働基準監督署長」という。)にしなければならない。

Article 6-2

第六条の二

The person representing a majority of the workers (hereinafter referred to as "a representative of the majority of the workers" in this Article) prescribed in paragraph (2) of Article 18, the proviso of paragraph (1) of Article 24, paragraph (1) of Article 32-2, paragraph (1) of Article 32-3, paragraphs (1) and (2) of Article 32-4, paragraph (1) of Article 32-5, the proviso of paragraph (2) of Article 34, paragraphs (1), (8), and (9) of Article 36, paragraph (3) of Article 37, paragraph (2) of Article 38-2, paragraph (1) of Article 38-3, item (i) of paragraph (2) of Article 38-4 (including as applied mutatis mutandis pursuant to paragraph (3) of Article 41-2), paragraphs (4), (6), and the proviso of paragraph (9) of Article 39, and paragraph (1) of Article 90 of the Act shall be a person who falls under all of the following items:

法第十八条第二項法第二十四条第一項ただし書、法第三十二条の二第一項法第三十二条の三第一項法第三十二条の四第一項及び第二項法第三十二条の五第一項法第三十四条第二項ただし書、法第三十六条第一項第八項及び第九項法第三十七条第三項法第三十八条の二第二項法第三十八条の三第一項法第三十八条の四第二項第一号法第四十一条の二第三項において準用する場合を含む。)、法第三十九条第四項第六項及び第九項ただし書並びに法第九十条第一項に規定する労働者の過半数を代表する者(以下この条において「過半数代表者」という。)は、次の各号のいずれにも該当する者とする。

A person who is not in the position of supervision or management prescribed in item (ii) of Article 41 of the Act

法第四十一条第二号に規定する監督又は管理の地位にある者でないこと。

A person who has been elected by a procedure using a method such as voting or a show of hands, conducted after making it clear that a person who is to conclude the agreements, etc. prescribed in the Act is being elected, and who has not been elected based on the intentions of the employer.

に規定する協定等をする者を選出することを明らかにして実施される投票、挙手等の方法による手続により選出された者であつて、使用者の意向に基づき選出されたものでないこと。

At a workplace where there is no person who falls under item (i) of the preceding paragraph, the person who represents the majority of the workers prescribed in Article 18, paragraph (2) of the Act, the proviso to Article 24, paragraph (1) of the Act, Article 39, paragraphs (4) and (6) and the proviso to paragraph (9) of the Act, and Article 90, paragraph (1) of the Act is to be a person who falls under item (ii) of the preceding paragraph.

前項第一号に該当する者がいない事業場にあつては、法第十八条第二項法第二十四条第一項ただし書、法第三十九条第四項第六項及び第九項ただし書並びに法第九十条第一項に規定する労働者の過半数を代表する者は、前項第二号に該当する者とする。

An employer shall not treat a worker disadvantageously on the grounds that that worker is a representative of the majority of the workers, attempted to become a representative of the majority of the workers, or took a justifiable action as a representative of the majority of the workers.

使用者は、労働者が過半数代表者であること若しくは過半数代表者になろうとしたこと又は過半数代表者として正当な行為をしたことを理由として不利益な取扱いをしないようにしなければならない。

An employer must give necessary consideration so that a representative of the majority of the workers is able to smoothly carry out the affairs concerning the agreements, etc. prescribed in the Act.

使用者は、過半数代表者に規定する協定等に関する事務を円滑に遂行することができるよう必要な配慮を行わなければならない。

Article 6-3

第六条の三

An order under the provisions of paragraph (6) of Article 18 of the Act shall be issued in writing according to Form No.1-3 by the Director of the Labor Standards Office Concerned.

法第十八条第六項の規定による命令は、様式第一号の三による文書で所轄労働基準監督署長がこれを行う。

Article 7

第七条

A certification under the provisions of paragraph (2) of Article l9 of the Act; or a certification under the provisions of paragraph (2) of Article 19 of the Act applied mutatis mutandis provided in the provisions of paragraph (3) of Article 20 of the Act in the case of the first half of the proviso of paragraph (1) of Article 20 of the Act shall be obtained according to Form No. 2, and a certification under the provisions of paragraph (2) of Article 19 of the Act applied mutatis mutandis provided in the provisions of paragraph (3) of Article 20 of the Act in the case of the second half of the proviso of paragraph (1) of Article 20 of the Act the Director of the Labor Standards Office Concerned shall be obtained according to Form No. 3, from the Director of the Labor Standards Office Concerned.

法第十九条第二項の規定による認定又は法第二十条第一項但書前段の場合に同条第三項の規定により準用する法第十九条第二項の規定による認定は様式第二号により、法第二十条第一項但書後段の場合に同条第三項の規定により準用する法第十九条第二項の規定による認定は様式第三号により、所轄労働基準監督署長から受けなければならない。

Article 7-2

第七条の二

An employer may, if it has obtained the consent of a worker, pay wages by the following methods; provided, however, that in the case of using the method set forth in item (iii), the employer must enable the worker to choose payment of wages by the method set forth in item (i) or (ii), and must obtain the consent of the worker after explaining to the worker the matters concerning the requirements set forth in item (iii), (a) through (f).

使用者は、労働者の同意を得た場合には、賃金の支払について次の方法によることができる。ただし、第三号に掲げる方法による場合には、当該労働者が第一号又は第二号に掲げる方法による賃金の支払を選択することができるようにするとともに、当該労働者に対し、第三号イからヘまでに掲げる要件に関する事項について説明した上で、当該労働者の同意を得なければならない。

By transfer into the worker's account at a bank or other financial institution designated by the worker.

当該労働者が指定する銀行その他の金融機関に対する当該労働者の預金又は貯金への振込み

Payment into a deposit of the worker (limited to one that satisfies the following requirements) with a financial instruments business operator designated by the worker (meaning a financial instruments business operator prescribed in Article 2, paragraph (9) of the Financial Instruments and Exchange Act (Act No. 25 of 1948; hereinafter referred to as the "FIEA") (limited to a person that engages in the Type I Financial Instruments Business prescribed in Article 28, paragraph (1) of the FIEA, and excluding a Type I small-amount electronic public offering service provider prescribed in Article 29-4-2, paragraph (8) of the FIEA and a special unlisted securities intermediary service provider prescribed in Article 29-4-4, paragraph (7) of the FIEA); the same applies hereinafter in this item)

当該労働者が指定する金融商品取引業者金融商品取引法(昭和二十三年法律第二十五号。以下「金商法」という。)第二条第九項に規定する金融商品取引業者金商法第二十八条第一項に規定する第一種金融商品取引業を行う者に限り、金商法第二十九条の四の二第八項に規定する第一種少額電子募集取扱業者及び金商法第二十九条の四の四第七項に規定する非上場有価証券特例仲介等業者を除く。)をいう。以下この号において同じ。)に対する当該労働者の預り金(次の要件を満たすものに限る。)への払込み

The deposit in the account shall not be used to purchase anything other than beneficiary certificates for securities investment trusts (hereinafter referred to in this item as "securities investment trusts"), as such term is used under paragraph (4) of Article 2 of the Act on Investment Trusts and Investment Corporation(Act No. 198 of 1951).

当該預り金により投資信託及び投資法人に関する法律(昭和二十六年法律第百九十八号)第二条第四項の証券投資信託(以下この号において「証券投資信託」という。)の受益証券以外のものを購入しないこと。

In the Basic Terms and Conditions of the Investment Trust as such term is used under paragraph (1) of Article 4 of the Act on Investment Trusts and Investment Corporation with respect to the beneficiary certificates purchased with the deposit in the account shall include said following matters:

当該預り金により購入する受益証券に係る投資信託及び投資法人に関する法律第四条第一項の投資信託約款に次の事項が記載されていること。

That the objects of investment of the trust property are limited to the following securities (referred to as "securities" in (2)), deposits, bills, designated money trusts and call loans.

信託財産の運用の対象は、次に掲げる有価証券((2)において「有価証券」という。)、預金、手形、指定金銭信託及びコールローンに限られること。

Securities set forth in Article 2, paragraph (1), item (i) of the FIEA

金商法第二条第一項第一号に掲げる有価証券

Securities set forth in Article 2, paragraph (1), item (ii) of the FIEA

金商法第二条第一項第二号に掲げる有価証券

Securities set forth in Article 2, paragraph (1), item (iii) of the FIEA

金商法第二条第一項第三号に掲げる有価証券

Securities set forth in Article 2, paragraph (1), item (iv) of the FIEA (excluding specified corporate bond certificates with rights to subscribe for new preferred equity investment in the case where the asset securitization plan does not provide that only the rights to subscribe for new preferred equity investment may be transferred)

金商法第二条第一項第四号に掲げる有価証券(資産流動化計画に新優先出資の引受権のみを譲渡することができる旨の定めがない場合における新優先出資引受権付特定社債券を除く。)

Securities set forth in Article 2, paragraph (1), item (v) of the FIEA (excluding certificates of corporate bonds with share options)

金商法第二条第一項第五号に掲げる有価証券(新株予約権付社債券を除く。)

Securities prescribed in Article 2, paragraph (1), item (xiv) of the FIEA (limited to those pertaining to a trust that trusts the loan claims of a bank, a cooperative structured financial institution prescribed in Article 2, paragraph (1) of the Act on Preferred Equity Investment by Cooperative Structured Financial Institution (Act No. 44 of 1993) and a financial institution set forth in the items of Article 1-9 of the Order for Enforcement of the Financial Instruments and Exchange Act (Cabinet Order No. 321 of 1965), or a trust company (limited to a trust whose beneficiary at the time of the contract pertaining to that trust is the settlor), or to a designated money trust)

金商法第二条第一項第十四号に規定する有価証券(銀行、協同組織金融機関の優先出資に関する法律(平成五年法律第四十四号)第二条第一項に規定する協同組織金融機関及び金融商品取引法施行令(昭和四十年政令第三百二十一号)第一条の九各号に掲げる金融機関又は信託会社の貸付債権を信託する信託(当該信託に係る契約の際における受益者が委託者であるものに限る。)又は指定金銭信託に係るものに限る。)

Beneficial interests in a trust that trusts the loan claims of a bank, a cooperative structured financial institution prescribed in Article 2, paragraph (1) of the Act on Preferred Equity Investment by Cooperative Structured Financial Institution and a financial institution set forth in the items of Article 1-9 of the Order for Enforcement of the Financial Instruments and Exchange Act, or a trust company (limited to a trust whose beneficiary at the time of the contract pertaining to that trust is the settlor)

銀行、協同組織金融機関の優先出資に関する法律第二条第一項に規定する協同組織金融機関及び金融商品取引法施行令第一条の九各号に掲げる金融機関又は信託会社の貸付債権を信託する信託(当該信託に係る契約の際における受益者が委託者であるものに限る。)の受益権

Rights against a foreign person that have the nature of those set forth in (xii)

外国の者に対する権利で(xii)に掲げるものの性質を有するもの

That the securities, deposits, bills, designated money trusts and call loans that are the objects of investment of the trust property (referred to as "securities, etc." in (3) and (4)) are those whose period until redemption or maturity (referred to as the "remaining period" in (3)) does not exceed one year.

信託財産の運用の対象となる有価証券、預金、手形、指定金銭信託及びコールローン((3)及び(4)において「有価証券等」という。)は、償還又は満期までの期間((3)において「残存期間」という。)が一年を超えないものであること。

That the average remaining period of the securities, etc. incorporated into the trust property (meaning the period obtained by dividing the total of the amounts obtained by multiplying the remaining period of each of the securities, etc. by the amount of those securities, etc. incorporated, by the total of the amounts of those securities, etc. incorporated) does not exceed 90 days.

信託財産に組み入れる有価証券等の平均残存期間(一の有価証券等の残存期間に当該有価証券等の組入れ額を乗じて得た合計額を、当該有価証券等の組入れ額の合計額で除した期間をいう。)が九十日を超えないこと。

That the proportion of the total amount of the trust property accounted for by the value, which formed the basis for calculating that total amount of the trust property, of securities, etc. issued or handled by a single juridical person or other organization (referred to as a "juridical person, etc." in (5)) (excluding national government bond certificates, government-guaranteed bonds (meaning bonds for which the government guarantees the redemption of the principal and the payment of interest) and call loans whose period until repayment (excluding days on which the company that makes the loan and is the trustee of the securities investment trusts concerned is closed for business) is five days or less (referred to as "specified call loans" in (5))) is 5 percent or less.

That the proportion of the total amount of the trust property accounted for by the value, which formed the basis for calculating that total amount of the trust property, of specified call loans handled by a single juridical person, etc. is 25 percent or less.

信託財産の総額のうちに一の法人等が取り扱う特定コールローンの当該信託財産の総額の計算の基礎となつた価額の占める割合が、百分の二十五以下であること。

An investment contract concerning said deposit (a contract with respect to dealing of a deposit and purchase, etc. of beneficiary certificates conducted between a worker and a financial instruments business operator) shall include the following items.

当該預り金に係る投資約款(労働者と金融商品取引業者の間の預り金の取扱い及び受益証券の購入等に関する約款をいう。)に次の事項が記載されていること。

That payment into the deposit can be made in units of one yen.

当該預り金への払込みが一円単位でできること。

That refunds of the deposit and of an amount equivalent to the beneficial interests in securities investment trusts can be made in units of one yen on the day on which a request for them is made.

預り金及び証券投資信託の受益権に相当する金額の払戻しが、その申出があつた日に、一円単位でできること。

A transfer of funds into an account, pertaining to the Type II Funds Transfer Service prescribed in Article 36-2, paragraph (2) of the Payment Services Act (Act No. 59 of 2009; hereinafter referred to as the "Payment Services Act") (hereinafter simply referred to as the "Type II Funds Transfer Service"), of the one designated by the worker from among the funds transfer service providers prescribed in Article 2, paragraph (3) of the Payment Services Act that carry on the Type II Funds Transfer Service and that have received the designation of the Minister of Health, Labour and Welfare as satisfying the following requirements (hereinafter referred to as "designated funds transfer service providers")

資金決済に関する法律(平成二十一年法律第五十九号。以下「資金決済法」という。)第三十六条の二第二項に規定する第二種資金移動業(以下単に「第二種資金移動業」という。)を営む資金決済法第二条第三項に規定する資金移動業者であつて、次に掲げる要件を満たすものとして厚生労働大臣の指定を受けた者(以下「指定資金移動業者」という。)のうち当該労働者が指定するものの第二種資金移動業に係る口座への資金移動

That, with respect to an account used for transfers of funds pertaining to the payment of wages (hereinafter simply referred to as an "account"), it has taken measures to ensure that the amount of the obligations concerning exchange transactions that it owes to a worker does not exceed 1,000,000 yen, or measures to promptly reduce that amount to 1,000,000 yen or less if that amount has exceeded 1,000,000 yen.

賃金の支払に係る資金移動を行う口座(以下単に「口座」という。)について、労働者に対して負担する為替取引に関する債務の額が百万円を超えることがないようにするための措置又は当該額が百万円を超えた場合に当該額を速やかに百万円以下とするための措置を講じていること。

That it has a mechanism guaranteeing that, when it has filed a petition for the commencement of bankruptcy proceedings or when the performance of the obligations it owes in connection with exchange transactions has otherwise become difficult, the full amount of the obligations concerning exchange transactions that it owes to a worker with respect to an account will be promptly paid to that worker.

破産手続開始の申立てを行つたときその他為替取引に関し負担する債務の履行が困難となつたときに、口座について、労働者に対して負担する為替取引に関する債務の全額を速やかに当該労働者に弁済することを保証する仕組みを有していること。

That it has a mechanism for compensating for a loss when, with respect to an account, the worker has incurred a loss with regard to the obligations concerning exchange transactions that it owes to the worker because the performance of those obligations has become difficult due to an unauthorized exchange transaction against the worker's will or any other reason not attributable to the worker.

口座について、労働者の意に反する不正な為替取引その他の当該労働者の責めに帰することができない理由で当該労働者に対して負担する為替取引に関する債務を履行することが困難となつたことにより当該債務について当該労働者に損失が生じたときに、当該損失を補償する仕組みを有していること。

That, with respect to an account, it has taken measures to enable it, unless there are special circumstances, to perform the obligations concerning exchange transactions that it owes to a worker for at least ten years from the day on which the last transfer of funds pertaining to that account was made.

口座について、特段の事情がない限り、当該口座に係る資金移動が最後にあつた日から少なくとも十年間は、労働者に対して負担する為替取引に関する債務を履行することができるための措置を講じていること。

That it has taken measures to enable transfers of funds into an account to be made in units of one yen.

口座への資金移動が一円単位でできるための措置を講じていること。

That, with respect to the receipt of the amount pertaining to a transfer of funds into an account, it has taken measures to enable that receipt to be made in units of one yen by a method using an automatic cash dispenser or another method by which receipt in currency is possible, and measures to enable that receipt to be made at least once a month without bearing the fees or other expenses pertaining to that method.

口座への資金移動に係る額の受取について、現金自動支払機を利用する方法その他の通貨による受取ができる方法により一円単位で当該受取ができるための措置及び少なくとも毎月一回は当該方法に係る手数料その他の費用を負担することなく当該受取ができるための措置を講じていること。

That it has a system enabling it to report to the Minister of Health, Labour and Welfare in a timely manner on the status of implementation of its operations concerning the payment of wages and on its financial condition.

賃金の支払に関する業務の実施状況及び財務状況を適時に厚生労働大臣に報告できる体制を有すること。

That, beyond what is set forth in (a) through (g), it has the technical capability to carry out the operations concerning the payment of wages properly and reliably, and has sufficient social credibility.

イからトまでに掲げるもののほか、賃金の支払に関する業務を適正かつ確実に行うことができる技術的能力を有し、かつ、十分な社会的信用を有すること。

An employer may pay, with the consent of the worker, retirement allowances by any of the methods set forth in the following items as well as in the preceding paragraph:

使用者は、労働者の同意を得た場合には、退職手当の支払について前項に規定する方法によるほか、次の方法によることができる。

To deliver the worker a check which has been issued by a bank or other financial institution and payable by that bank or other financial institution.

銀行その他の金融機関によつて振り出された当該銀行その他の金融機関を支払人とする小切手を当該労働者に交付すること。

To deliver the worker a check guaranteed by a bank or other financial institution.

銀行その他の金融機関が支払保証をした小切手を当該労働者に交付すること。

To deliver said worker a certificate which shows the rights related to debts owed by the postal savings bank regarding its exchange transactions as set forth in Article 94 of the Postal Service Privatization Act (Act No. 97 of 2005).

郵政民営化法(平成十七年法律第九十七号)第九十四条に規定する郵便貯金銀行がその行う為替取引に関し負担する債務に係る権利を表章する証書を当該労働者に交付すること。

With regard to the application of the provisions of the preceding paragraph, when the provisions of paragraph (1) of Article 24 of the Act applies to local public officers, "a check" referred to in item (i) of the preceding paragraph shall be replaced with "a check or a check issued by the local public entity concerned."

地方公務員に関して法第二十四条第一項の規定が適用される場合における前項の規定の適用については、同項第一号中「小切手」とあるのは、「小切手又は地方公共団体によつて振り出された小切手」とする。

Article 7-3

第七条の三

A person that seeks to receive the designation of the Minister of Health, Labour and Welfare referred to in paragraph (1), item (iii) of the preceding Article (simply referred to as "designation" in Articles 7-6 through 7-8) must submit a written application to the Minister of Health, Labour and Welfare, attaching documents certifying that the person carries on the Type II Funds Transfer Service and satisfies the requirements set forth in (a) through (h) of that item.

前条第一項第三号の厚生労働大臣の指定(第七条の六から第七条の八までにおいて単に「指定」という。)を受けようとする者は、申請書に、第二種資金移動業を営むこと及び同号イからチまでに掲げる要件を満たすことを証する書類を添えて、厚生労働大臣に提出しなければならない。

Article 7-4

第七条の四

When a designated funds transfer service provider changes any of the matters pertaining to the requirements set forth in Article 7-2, paragraph (1), item (iii), (a) through (h), it must notify the Minister of Health, Labour and Welfare to that effect in advance.

指定資金移動業者は、第七条の二第一項第三号イからチまでに掲げる要件に係る事項のいずれかを変更するときは、あらかじめ、その旨を厚生労働大臣に届け出なければならない。

When a designated funds transfer service provider has registered a change under the provisions of Article 41, paragraph (1) of the Payment Services Act or has given notification of a change under the provisions of paragraph (3) or (4) of that Article, it must notify the Minister of Health, Labour and Welfare to that effect without delay.

指定資金移動業者は、資金決済法第四十一条第一項の規定による変更登録又は同条第三項若しくは第四項の規定による変更の届出を行つたときは、遅滞なく、その旨を厚生労働大臣に届け出なければならない。

Article 7-5

第七条の五

When the Minister of Health, Labour and Welfare finds it necessary in order to ensure the proper and reliable implementation of the operations concerning the payment of wages, the Minister may request a designated funds transfer service provider to report on the status of implementation of its operations concerning the payment of wages and on its financial condition, or request it to take necessary measures.

厚生労働大臣は、賃金の支払に関する業務の適正かつ確実な実施を確保するために必要があると認めるときは、指定資金移動業者に対し、賃金の支払に関する業務の実施状況及び財務状況に関し報告を求め、又は必要な措置を求めることができる。

Article 7-6

第七条の六

The Minister of Health, Labour and Welfare may rescind the designation when a designated funds transfer service provider falls under any of the following.

厚生労働大臣は、指定資金移動業者が次のいずれかに該当するときは、指定を取り消すことができる。

When a disposition under the provisions of Article 55 or Article 56, paragraph (1) or (2) of the Payment Services Act has been made

資金決済法第五十五条又は第五十六条第一項若しくは第二項の規定による処分が行われたとき。

When, beyond what is set forth in the preceding item, it has ceased to satisfy the requirements set forth in Article 7-2, paragraph (1), item (iii), (a) through (h)

前号のほか、第七条の二第一項第三号イからチまでに掲げる要件を満たさなくなつたとき。

When it has received the designation by wrongful means

不正の手段により指定を受けたとき。

When the Minister of Health, Labour and Welfare has rescinded a designation pursuant to the provisions of the preceding paragraph, the Minister must give public notice to that effect.

厚生労働大臣は、前項の規定により指定の取消しをしたときは、その旨を公告しなければならない。

Article 7-7

第七条の七

When a designated funds transfer service provider falls under any of the following, it must notify the Minister of Health, Labour and Welfare to that effect without delay.

指定資金移動業者は、次のいずれかに該当するときは、遅滞なく、その旨を厚生労働大臣に届け出なければならない。

When it intends to decline the designation

指定を辞退しようとするとき。

When it has given the notification under the provisions of Article 61, paragraph (1) of the Payment Services Act

資金決済法第六十一条第一項の規定による届出をしたとき。

When a designated funds transfer service provider has declined the designation, that designation ceases to be effective.

指定資金移動業者指定を辞退したときは、当該指定は、その効力を失う。

When a designated funds transfer service provider intends to decline the designation, it must, no later than 30 days before that day, give public notice to that effect and post a notice to that effect in a place readily visible to the public at all of its business offices.

指定資金移動業者指定を辞退しようとするときは、その日の三十日前までに、その旨を公告するとともに、全ての営業所の公衆の目につきやすい場所に掲示しなければならない。

When a designated funds transfer service provider has given public notice under the provisions of the preceding paragraph, it must immediately notify the Minister of Health, Labour and Welfare to that effect.

指定資金移動業者は、前項の規定による公告をしたときは、直ちに、その旨を厚生労働大臣に届け出なければならない。

Article 7-8

第七条の八

In the case where the designation of a designated funds transfer service provider has been rescinded pursuant to the provisions of Article 7-6, paragraph (1), if the Minister of Health, Labour and Welfare finds it necessary in order to ensure the performance of an employer's obligation to pay wages, the provisions of Article 7-2, paragraph (1) and Article 7-5 apply to the person that was the designated funds transfer service provider, by deeming that person to still be a designated funds transfer service provider.

指定資金移動業者について、第七条の六第一項の規定により指定が取り消された場合において、使用者の賃金の支払の義務の履行を確保するため必要があると厚生労働大臣が認めるときは、指定資金移動業者であつた者については、なお指定資金移動業者とみなして、第七条の二第一項及び第七条の五の規定を適用する。

Article 8

第八条

Those equivalent to wages paid in special circumstances or bonus set forth in the proviso of paragraph (2) of Article 24 of the Act shall be listed as follows:

Article 9

第九条

The emergencies set forth in the provisions of Article 25 of the Act shall be listed as follows:

法第二十五条に規定する非常の場合は、次に掲げるものとする。

Article 12

第十二条

When an employer who regularly employs less than 10 workers adopts such rules that are referred to in paragraph (1) of Article 32-2 or paragraph (2) of Article 35 of the Act, the employer shall make such rules known to the workers, except in cases where such rules are adopted by a written agreement referred to in paragraph (1) of Article 32-2 of the Act (including any resolution by the committee referred to in paragraph (1) of Article 38-4 of the Act set forth in paragraph (5) of the same Article (including as applied mutatis mutandis pursuant to paragraph (3) of Article 41-2 of the Act) (such committee shall hereinafter be referred to as a "labor-management committee") (such resolution shall hereinafter be referred to as a "resolution by a labor-management committee") and any resolution by the committee on the improvement of working time arrangements provided for in Article 7 of the Act on Special Measures for Improvement of Working Time Arrangements (Act No. 90 of 1992; hereinafter referred to as the "Improvement of Working Time Arrangements Act") (such resolution shall hereinafter be referred to as a "resolution by the committee on the improvement of working time arrangements")).

常時十人に満たない労働者を使用する使用者は、法第三十二条の二第一項又は法第三十五条第二項による定めをした場合(法第三十二条の二第一項の協定(法第三十八条の四第五項法第四十一条の二第三項において準用する場合を含む。)に規定する法第三十八条の四第一項の委員会(以下「労使委員会」という。)の決議(以下「労使委員会の決議」という。)及び労働時間等の設定の改善に関する特別措置法(平成四年法律第九十号。以下「労働時間等設定改善法」という。)第七条に規定する労働時間等設定改善委員会の決議(以下「労働時間等設定改善委員会の決議」という。)を含む。)による定めをした場合を除く。)には、これを労働者に周知させるものとする。

Article 12-2

第十二条の二

When an employer causes its workers to work under the conditions pursuant to any of the provisions of Articles 32-2 to 32-4 of the Act, the employer shall clearly indicate the initial date of the period prescribed in Articles 32-2 to 32-4 of the Act in the rules of employment or its equivalent or in a written agreement (including any resolution by a labor-management committee or a resolution by the committee on the improvement of working time arrangements).

使用者は、法第三十二条の二から第三十二条の四までの規定により労働者に労働させる場合には、就業規則その他これに準ずるもの又は書面による協定(労使委員会の決議及び労働時間等設定改善委員会の決議を含む。)において、法第三十二条の二から第三十二条の四までにおいて規定する期間の起算日を明らかにするものとする。

When an employer gives its workers holidays under the provisions of paragraph (2) of Article 35 of the Act, the employer shall clearly indicate, in the rules of employment or some other equivalent, the initial date of reckoning for a four-week period in which the employer provides four or more days off.

使用者は、法第三十五条第二項の規定により労働者に休日を与える場合には、就業規則その他これに準ずるものにおいて、四日以上の休日を与えることとする四週間の起算日を明らかにするものとする。

Article 12-2-2

第十二条の二の二

An agreement under the provisions of paragraph (1) of Article 32-2 of the Act (excluding the case where it is by way of collective agreement, and including a resolution of a labor-management or resolution of a committee on the improvement of working time arrangements )shall set forth a validity period .

法第三十二条の二第一項の協定(労働協約による場合を除き、労使委員会の決議及び労働時間等設定改善委員会の決議を含む。)には、有効期間の定めをするものとする。

A notification under the provisions of paragraph (2) of Article 32-2 of the Act shall be submitted according to Form No. 3-2 to the Director of the Labor Standards Office Concerned.

Article 12-3

第十二条の三

The matters specified by Order of the Ministry of Health, Labour and Welfare referred to in Article 32-3, paragraph (1) of the Act (including as applied by replacing terms pursuant to the provisions of paragraphs (2) and (3) of that Article; the same applies hereinafter in this Article), item (iv) are to be the following.

The notification under the provisions of Article 32-2, paragraph (2) of the Act as applied mutatis mutandis pursuant to Article 32-3, paragraph (4) of the Act must be made to the Director of the Labor Standards Office Concerned using Form No. 3-3.

法第三十二条の三第四項において準用する法第三十二条の二第二項の規定による届出は、様式第三号の三により、所轄労働基準監督署長にしなければならない。

Article 12-4

第十二条の四

Matters prescribed by Ordinance of the Ministry of Health, Labour and Welfare referred to item (v) of paragraph (1) of Article 32-4 of the Act which shall be fixed by a written agreement under the provisions of paragraph (1) of Article 32-4 of the Act (excluding the case where it is by way of collective agreement, and including a resolution of a labor-management or resolution of a committee on the improvement of working time arrangements) shall be a stipulation for the valid period of the agreement.

法第三十二条の四第一項の協定(労働協約による場合を除き、労使委員会の決議及び労働時間等設定改善委員会の決議を含む。)において定める同項第五号の厚生労働省令で定める事項は、有効期間の定めとする。

The employer shall establish stipulations in paper form under the provisions of paragraph (2) of Article 32-4 of the Act.

使用者は、法第三十二条の四第二項の規定による定めは、書面により行わなければならない。

When the applicable period referred to in item (ii) of paragraph (1) of Article 32-4 of the Act (hereinafter referred to as "the applicable period" in this Article) exceeds three months, annual working days stipulated by Ordinance of the Ministry of Health, Labour and Welfare referred to in paragraph (3) of Article 32-4 of the Act shall be limited to 280 days in the applicable period.However, in cases where the applicable period exceeds three months and there is an agreement with its applicable period of over three months, falling anytime during the one year prior to the first day of the aforementioned applicable period, (including resolution by a labor-management or resolution by the committee on the improvement of working time arrangements) (if there had been more than one agreement, an agreement just before the new agreement shall be applicable; hereinafter referred to in this paragraph as "the former agreement") under the provisions of paragraph (1) of Article 32-4 of the Act yearly working days shall be shorter one, either days determined by subtracting one day from the yearly working days in the applicable period stipulated under the former agreement or 280 days, if the daily limited working hours exceed longer one, either the daily limited working hours stipulated under the former agreement or nine hours, or the weekly limited working hours exceed longer one, either the weekly limited working hours stipulated under the former agreement or 48 hours.

法第三十二条の四第三項の厚生労働省令で定める労働日数の限度は、同条第一項第二号の対象期間(以下この条において「対象期間」という。)が三箇月を超える場合は対象期間について一年当たり二百八十日とする。ただし、対象期間が三箇月を超える場合において、当該対象期間の初日の前一年以内の日を含む三箇月を超える期間を対象期間として定める法第三十二条の四第一項の協定(労使委員会の決議及び労働時間等設定改善委員会の決議を含む。)(複数ある場合においては直近の協定(労使委員会の決議及び労働時間等設定改善委員会の決議を含む。)。以下この項において「旧協定」という。)があつた場合において、一日の労働時間のうち最も長いものが旧協定の定める一日の労働時間のうち最も長いもの若しくは九時間のいずれか長い時間を超え、又は一週間の労働時間のうち最も長いものが旧協定の定める一週間の労働時間のうち最も長いもの若しくは四十八時間のいずれか長い時間を超えるときは、旧協定の定める対象期間について一年当たりの労働日数から一日を減じた日数又は二百八十日のいずれか少ない日数とする。

Daily working hours and weekly working hours stipulated by Ordinance of the Ministry of Health, Labour and Welfare referred to in paragraph (3) of Article 32-4 of the Act shall be limited to 10 hours per day and 52 hours per week respectively.In this case, if the applicable period exceeds three months, the conformity both of the following items shall be established.

法第三十二条の四第三項の厚生労働省令で定める一日の労働時間の限度は十時間とし、一週間の労働時間の限度は五十二時間とする。この場合において、対象期間が三箇月を超えるときは、次の各号のいずれにも適合しなければならない。

In the applicable period, the number of consecutive weeks in which weekly working hours exceed 48 hours shall be three or less.

対象期間において、その労働時間が四十八時間を超える週が連続する場合の週数が三以下であること。

In each period determined by dividing the applicable period by every three months from the first day of the applicable period (if there is a period of less than three months, it shall be regarded as one period), the number of first days of weeks in which weekly working hours exceed 48 hours shall be three or less.

対象期間をその初日から三箇月ごとに区分した各期間(三箇月未満の期間を生じたときは、当該期間)において、その労働時間が四十八時間を超える週の初日の数が三以下であること。

The number of consecutive days on which an employer may have workers work in the applicable period provided in Ordinance of the Ministry of Health, Labour and Welfare referred to in paragraph (3) of Article 32-4 of the Act shall be limited to six days; and the number of consecutive days on which an employer may have workers work in the specified period set forth in the written agreement referred to in paragraph (1) of the Article (including resolutions of the labor-management committee and resolutions of the committee on the improvement of working time arrangements) shall be limited to the number of days that shall enable workers to have one day off per week.

法第三十二条の四第三項の厚生労働省令で定める対象期間における連続して労働させる日数の限度は六日とし、同条第一項の協定(労使委員会の決議及び労働時間等設定改善委員会の決議を含む。)で特定期間として定められた期間における連続して労働させる日数の限度は一週間に一日の休日が確保できる日数とする。

A notification referred to in the provisions of paragraph (2) of Article 32-2 of the Act applied mutatis mutandis under the provisions of paragraph (4) of Article 32-4 of the Act must be submitted according to Form No. 4 to the Director of the Labor Standards Office Concerned.

法第三十二条の四第四項において準用する法第三十二条の二第二項の規定による届出は、様式第四号により、所轄労働基準監督署長にしなければならない。

Article 12-5

第十二条の五

Businesses prescribed by Ordinance of the Ministry of Health, Labour and Welfare referred to in the provisions of paragraph (1) of Article 32-5 of the Act shall be businesses of retailers, hotels, restaurants, and eating and drinking places.

法第三十二条の五第一項の厚生労働省令で定める事業は、小売業、旅館、料理店及び飲食店の事業とする。

The number prescribed by Ordinance of the Ministry of Health, Labour and Welfare referred to in the provisions of paragraph (1) of Article 32-5 of the Act shall be 30 persons.

法第三十二条の五第一項の厚生労働省令で定める数は、三十人とする。

A notice of working hours for each day of a week pursuant to the provisions of paragraph (2) of Article 32-5 of the Act shall be given in writing at least before the first day of the week.However, if there is an urgent and unavoidable reason, the employer may change the working hours previously notified by notifying the relevant worker in writing by the day prior to the date on which the employer intends to change the said previously notified working hours.

法第三十二条の五第二項の規定による一週間の各日の労働時間の通知は、少なくとも、当該一週間の開始する前に、書面により行わなければならない。ただし、緊急でやむを得ない事由がある場合には、使用者は、あらかじめ通知した労働時間を変更しようとする日の前日までに書面により当該労働者に通知することにより、当該あらかじめ通知した労働時間を変更することができる。

A notification referred to in the provisions of paragraph (2) of Article 32-2 of the Act applied mutatis mutandis under the provisions of paragraph (3) of Article 32-5 of the Act must be submitted on Form No. 5 to the Director of the Labor Standards Office Concerned.

法第三十二条の五第三項において準用する法第三十二条の二第二項の規定による届出は、様式第五号により、所轄労働基準監督署長にしなければならない。

When an employer has workers work pursuant to the provisions of Article 32-5, the employer shall endeavor to respect the workers' intention when fixing working hours for each day of a week.

使用者は、法第三十二条の五の規定により労働者に労働させる場合において、一週間の各日の労働時間を定めるに当たつては、労働者の意思を尊重するよう努めなければならない。

Article 12-6

第十二条の六

When an employer has workers work pursuant to the provisions of Article 32-2, 32-4 or 32-5 of the Act, the employer shall give careful consideration to those who take care of children, those who take care of elderly persons and the like, those who receive vocational training or education, and such other workers who need special consideration so that they may secure time necessary for the child care and the like.

使用者は、法第三十二条の二第三十二条の四又は第三十二条の五の規定により労働者に労働させる場合には、育児を行う者、老人等の介護を行う者、職業訓練又は教育を受ける者その他特別の配慮を要する者については、これらの者が育児等に必要な時間を確保できるような配慮をしなければならない。

Article 13

第十三条

A permission under the provisions of the main clause of paragraph (1) of Article 33 of the Act must be obtained from the Director of the Labor Standards Office Concerned, and a notification under the proviso of the same paragraph of the same Article shall be submitted to the Director of the Labor Standards Office Concerned.

法第三十三条第一項本文の規定による許可は、所轄労働基準監督署長から受け、同条同項但書の規定による届出は、所轄労働基準監督署長にしなければならない。

The permission or the notification referred to in the preceding paragraph shall be made pursuit to Form No. 6.

前項の許可又は届出は、様式第六号によるものとする。

Article 14

第十四条

An order under the provisions of paragraph (2) of Article 33 of the Act shall be issued in writing according to Form No.7 by the Director of the Labor Standards Office Concerned.

法第三十三条第二項の規定による命令は、様式第七号による文書で所轄労働基準監督署長がこれを行う。

Article 15

第十五条

When an employer makes an agreement under the proviso of paragraph (2) of Article 34 of the Act, the employer shall agree on the scope of workers whom the employer do not provide simultaneous rest periods and to the method of providing rest periods to the said workers.

使用者は、法第三十四条第二項ただし書の協定をする場合には、一斉に休憩を与えない労働者の範囲及び当該労働者に対する休憩の与え方について、協定しなければならない。

The provisions of the preceding paragraph shall apply mutatis mutandis to a resolution of a labor-management committee or resolution of a committee on the improvement of working time arrangements

前項の規定は、労使委員会の決議及び労働時間等設定改善委員会の決議について準用する。

Article 16

第十六条

The notification under the provisions of Article 36, paragraph (1) of the Act must be made to the Director of the Labor Standards Office Concerned using Form No. 9 (or, in the case where provisions are established concerning the matters prescribed in paragraph (5) of that Article, Form No. 9-2).

法第三十六条第一項の規定による届出は、様式第九号同条第五項に規定する事項に関する定めをする場合にあつては、様式第九号の二)により、所轄労働基準監督署長にしなければならない。

Notwithstanding the provisions of the preceding paragraph, the notification under the provisions of Article 36, paragraph (1) of the Act with regard to the work prescribed in paragraph (11) of that Article must be made to the Director of the Labor Standards Office Concerned using Form No. 9-3.

前項の規定にかかわらず、法第三十六条第十一項に規定する業務についての同条第一項の規定による届出は、様式第九号の三により、所轄労働基準監督署長にしなければならない。

When an employer intends to renew an agreement under Article 36, paragraph (1) of the Act (including a resolution by a labor-management committee and a resolution by a committee on the improvement of working time arrangements; the same applies hereinafter in this paragraph), the employer may, by notifying the Director of the Labor Standards Office Concerned of an agreement to that effect, substitute that for the notification under the preceding two paragraphs.

法第三十六条第一項の協定(労使委員会の決議及び労働時間等設定改善委員会の決議を含む。以下この項において同じ。)を更新しようとするときは、使用者は、その旨の協定を所轄労働基準監督署長に届け出ることによつて、前二項の届出に代えることができる。

Article 17

第十七条

The matters specified by Order of the Ministry of Health, Labour and Welfare referred to in Article 36, paragraph (2), item (v) of the Act are to be the following; provided, however, that this does not apply to the matters in items (iv) through (vii) in the case where the agreement under paragraph (1) of that Article does not establish provisions concerning the matters prescribed in paragraph (5) of that Article.

法第三十六条第二項第五号の厚生労働省令で定める事項は、次に掲げるものとする。ただし、第四号から第七号までの事項については、同条第一項の協定に同条第五項に規定する事項に関する定めをしない場合においては、この限りでない。

Provisions on the validity period of the agreement under Article 36, paragraph (1) of the Act (excluding the case where it is made by a collective agreement)

法第三十六条第一項の協定(労働協約による場合を除く。)の有効期間の定め

The starting date of the one year referred to in Article 36, paragraph (2), item (iv) of the Act

That the requirements prescribed in Article 36, paragraph (6), items (ii) and (iii) of the Act are satisfied.

An employer must preserve records concerning the status of implementation of the measures set forth in item (v) of the preceding paragraph during the validity period referred to in item (i) of that paragraph and for five years after the expiration of that validity period.

使用者は、前項第五号に掲げる措置の実施状況に関する記録を同項第一号の有効期間中及び当該有効期間の満了後五年間保存しなければならない。

Article 18

第十八条

The work especially harmful to health specified by Order of the Ministry of Health, Labour and Welfare referred to in Article 36, paragraph (6), item (i) of the Act is to be the following.

法第三十六条第六項第一号の厚生労働省令で定める健康上特に有害な業務は、次に掲げるものとする。

Work for which workers handle a large quantity of intensely heated materials and work at an extremely hot place

多量の高熱物体を取り扱う業務及び著しく暑熱な場所における業務

Work for which workers handle a large quantity of cold materials, and work in an extremely cold place

多量の低温物体を取り扱う業務及び著しく寒冷な場所における業務

Work for in which workers are exposed to radium radioactive rays, X-rays, or some other injurious radioactive rays

ラジウム放射線、エックス線その他の有害放射線にさらされる業務

Work in a place where dust or powder such as that from earth, rocks, fur are extensively scattered

土石、獣毛等のじんあい又は粉末を著しく飛散する場所における業務

Work under unusual atmospheric pressure

異常気圧下における業務

Work for which workers receive an extreme vibration by operating a rock drill, rivetter and the like

削岩機、鋲打機等の使用によつて身体に著しい振動を与える業務

Extremely hard work such as those for which workers handle heavy materials

重量物の取扱い等重激なる業務

Work in an extremely noisy place such as boiler-manufacturing

ボイラー製造等強烈な騒音を発する場所における業務

Work in a place where particulate, vapor or gas of lead, mercury, chrome, arsenic, phosphorus, fluorine, chlorine, hydrochloric acid, nitric acid, sulphur dioxide, sulphuric acid, carbon monoxide, carbon disulphide, hydrocyanic, benzene, aniline, or other equivalent injurious material is generated

鉛、水銀、クロム、砒素、黄りん、弗素、塩素、塩酸、硝酸、亜硫酸、硫酸、一酸化炭素、二硫化炭素、青酸、ベンゼン、アニリン、その他これに準ずる有害物の粉じん、蒸気又はガスを発散する場所における業務

Work designated by the Minister of Health, Labour and Welfare other than those listed in the preceding items

前各号のほか、厚生労働大臣の指定する業務

Article 19

第十九条

The amount of wages for standard working hours or days under the provisions of paragraph (1) of Article 37 of the Act shall be calculated by multiplying the amount fixed in any of the following items by the number of overtime hours pursuant to the provisions of Article 33 or paragraph (1) of Article 36 of the Act, that of working hours on rest days, or that of working hours between 10 p.m. and 5 a.m. (or between 11 p.m. and 6 a.m., in case when the Minister of Health, Labour and Welfare recognize the necessary of the application of those hours at a certain areas or time of year):

法第三十七条第一項の規定による通常の労働時間又は通常の労働日の賃金の計算額は、次の各号の金額に法第三十三条若しくは法第三十六条第一項の規定によつて延長した労働時間数若しくは休日の労働時間数又は午後十時から午前五時(厚生労働大臣が必要であると認める場合には、その定める地域又は期間については午後十一時から午前六時)までの労働時間数を乗じた金額とする。

When wages are determined on an hourly basis, they shall be the total amount of hourly wages

時間によつて定められた賃金については、その金額

When wages are determined on a daily basis, they shall be obtained by dividing the amount of daily wages by the number of the prescribed working hours in a day (if the number of prescribed working hours varies daily, it is the average prescribed daily working hours for a week)

日によつて定められた賃金については、その金額を一日の所定労働時間数(日によつて所定労働時間数が異る場合には、一週間における一日平均所定労働時間数)で除した金額

When wages are determined on a weekly basis, they shall be obtained by dividing the amount of weekly wages by the number of the prescribed working hours in a week (if the number of prescribed working hours varies weekly, it is the average prescribed weekly working hours for four weeks)

週によつて定められた賃金については、その金額を週における所定労働時間数(週によつて所定労働時間数が異る場合には、四週間における一週平均所定労働時間数)で除した金額

When wages are determined on a monthly basis, they shall be obtained by dividing the amount of monthly wages by the number of the prescribed working hours in a month (if the number of prescribed working hours varies monthly, it is the average prescribed monthly working hours for a year)

月によつて定められた賃金については、その金額を月における所定労働時間数(月によつて所定労働時間数が異る場合には、一年間における一月平均所定労働時間数)で除した金額

When wages are determined in accordance with a certain period other than a month or a week, they shall be the amount calculated in the same manner as each of the preceding items

月、週以外の一定の期間によつて定められた賃金については、前各号に準じて算定した金額

When wages are determined at piece rates or on some other contract basis, they shall be obtained by dividing the total amount of wages calculated based on said piece rates or other contract basis during the period subject to the wage calculation(if the closing day for wage calculation is fixed, this means the period up to the closing day; hereinafter the same shall apply) by the total number of working hours during the period subject to the wage calculation

出来高払制その他の請負制によつて定められた賃金については、その賃金算定期間(賃金締切日がある場合には、賃金締切期間、以下同じ)において出来高払制その他の請負制によつて計算された賃金の総額を当該賃金算定期間における、総労働時間数で除した金額

When wages consist of two or more conditions referred to in the preceding items, they shall be the total amounts of each part calculated according to the items concerned

労働者の受ける賃金が前各号の二以上の賃金よりなる場合には、その部分について各号によつてそれぞれ算定した金額の合計額

Those wages such as holiday allowances or some other equivalents which fall under none of the preceding items shall be deemed as those determined on a monthly basis in case of the calculation in any of the items of preceding paragraph.

休日手当その他前項各号に含まれない賃金は、前項の計算においては、これを月によつて定められた賃金とみなす。

Article 19-2

第十九条の二

In the case where an employer concludes an agreement under Article 37, paragraph (3) of the Act (including a resolution by a labor-management committee, a resolution by the committee on the improvement of working time arrangements and a resolution by an enterprise committee on the improvement of working time arrangements prescribed in Article 7-2 of the Improvement of Working Time Arrangements Act), the employer must reach agreement on the following matters.

使用者は、法第三十七条第三項の協定(労使委員会の決議労働時間等設定改善委員会の決議及び労働時間等設定改善法第七条の二に規定する労働時間等設定改善企業委員会の決議を含む。)をする場合には、次に掲げる事項について、協定しなければならない。

Method of calculating the number of hours to be given as leave set forth in paragraph (3) of Article 37 of the Act (hereinafter referred to as "substitute leave")

法第三十七条第三項の休暇(以下「代替休暇」という。)として与えることができる時間の時間数の算定方法

Unit of substitute leave (The unit shall be a day or half day; if substitute leave can be given together with any other leave with the payment of wages for ordinary working hours, the unit of a day or half day shall include such leave)

代替休暇の単位(一日又は半日(代替休暇以外の通常の労働時間の賃金が支払われる休暇と合わせて与えることができる旨を定めた場合においては、当該休暇と合わせた一日又は半日を含む。)とする。)

The period where substitute leave can be given (within two months from the day following the last day of the month in which the working hours extended under Article 33 or paragraph (1) of Article 36 of the Act exceed 60 hours of that month)

代替休暇を与えることができる期間(法第三十三条又は法第三十六条第一項の規定によつて延長して労働させた時間が一箇月について六十時間を超えた当該一箇月の末日の翌日から二箇月以内とする。)

The calculation of the number of hours in item (i) of the preceding paragraph shall be made by multiplying the number of working hours extended beyond 60 hours per month in accordance with Article 33 or paragraph (1) of Article 36 of the Act by the difference between the rate of premium wages payable for such extended working hours under the proviso of paragraph (1) of Article 37 of the Act in case the worker does not take substitute leave, and the rate of premium wages payable for the extended working hours under the main clause of the same paragraph in case the worker does take substitute leave (hereinafter referred to as the "conversion rate" in the following paragraph).

前項第一号の算定方法は、法第三十三条又は法第三十六条第一項の規定によつて一箇月について六十時間を超えて延長して労働させた時間の時間数に、労働者が代替休暇を取得しなかつた場合に当該時間の労働について法第三十七条第一項ただし書の規定により支払うこととされている割増賃金の率と、労働者が代替休暇を取得した場合に当該時間の労働について同項本文の規定により支払うこととされている割増賃金の率との差に相当する率(次項において「換算率」という。)を乗じるものとする。

The number of hours prescribed by the Ordinance of the Ministry of Health, Labour and Welfare referred in paragraph (3) of Article 37 of the Act shall be obtained by dividing the number of hours of substitute leave by the conversion rate.

法第三十七条第三項の厚生労働省令で定める時間は、取得した代替休暇の時間数を換算率で除して得た時間数の時間とする。

Article 20

第二十条

When working hours extended under the provisions of Article 33 or paragraph (1) of Article 36 of the Act fall between 10 p.m. and 5 a.m. (or the period between 11 p.m. and 6 a.m. in case when the Minister of Health, Labour and Welfare recognize the necessary of the application of those hours at a certain areas or time of year ), the employer shall pay premium wages for the work during such hours at a rate no lower than 50 percent (or 75 percent or more for work extended beyond 60 hours in the month) over the amount calculated by multiplying the amount stipulated in items of paragraph (1) of Article 19 by the number of working hours.

法第三十三条又は法第三十六条第一項の規定によつて延長した労働時間が午後十時から午前五時(厚生労働大臣が必要であると認める場合は、その定める地域又は期間については午後十一時から午前六時)までの間に及ぶ場合においては、使用者はその時間の労働については、第十九条第一項各号の金額にその労働時間数を乗じた金額の五割以上(その時間の労働のうち、一箇月について六十時間を超える労働時間の延長に係るものについては、七割五分以上)の率で計算した割増賃金を支払わなければならない。

When working hours on days off under the provisions of Article 33 or paragraph (1) of Article 36 of the Act fall between 10 p.m. and 5 a.m. on a rest day (or the period between 11 p.m. and 6 a.m. in case when the Minister of Health, Labour and Welfare recognize the necessaryof the application of those hours at a certain areas or time of year), the employer shall pay premium wages for work during such hours at a rate no lower than 60 percent over the amount calculated by multiplying the amount stipulated in items of paragraph (1) of the preceding Article by the number of working hours.

法第三十三条又は法第三十六条第一項の規定による休日の労働時間が午後十時から午前五時(厚生労働大臣が必要であると認める場合は、その定める地域又は期間については午後十一時から午前六時)までの間に及ぶ場合においては、使用者はその時間の労働については、前条第一項各号の金額にその労働時間数を乗じた金額の六割以上の率で計算した割増賃金を支払わなければならない。

Article 21

第二十一条

Pursuant to the provisions of paragraph (5) of Article 37 of the Act, family allowances, commutation allowances, and the elements of wages listed in the following items shall not be included in the wage calculation basis for premium wages set forth in paragraphs (1) and (4) of the same Article:

法第三十七条第五項の規定によつて、家族手当及び通勤手当のほか、次に掲げる賃金は、同条第一項及び第四項の割増賃金の基礎となる賃金には算入しない。

第二十三条

When an employer has obtained the permission from the Director of the Labor Standards Office Concerned according to Form No. 10 with respect to night- or day-duty intermittent work, the worker may employ workers who are engaged in such work, notwithstanding the provisions of Article 32 of the Act.

使用者は、宿直又は日直の勤務で断続的な業務について、様式第十号によつて、所轄労働基準監督署長の許可を受けた場合は、これに従事する労働者を、法第三十二条の規定にかかわらず、使用することができる。

Article 24

第二十四条

When an employer has obtained the permission from the Director of the Labor Standards Office Concerned according to Form No. 11 with respect to the time between the commencement and completion of the entry into a pit for workers who enter and exit a pit as a group, the time period between the completion of entry into and the completion of exit from a pit shall be deemed as working hours of workers belonging to the group for the purpose of the application of the provisions of paragraph (2) of Article 38 of the Act.

使用者が一団として入坑及び出坑する労働者に関し、その入坑開始から入坑終了までの時間について様式第十一号によつて所轄労働基準監督署長の許可を受けた場合には、法第三十八条第二項の規定の適用については、入坑終了から出坑終了までの時間を、その団に属する労働者の労働時間とみなす。

Article 24-2

第二十四条の二

The provisions of paragraph (1) of Article 38-2 of the Act shall apply to the calculation of working hours in the application of the provisions concerning working hours under Chapter 4 of the Act .

法第三十八条の二第一項の規定は、法第四章の労働時間に関する規定の適用に係る労働時間の算定について適用する。

An agreement under the provisions of paragraph (2) of Article 38-2 of the Act (excluding the case where it is by way of collective agreement and including a resolution of a labor-management and resolution of a committee on the improvement of working time arrangements) shall set forth a validity period.

法第三十八条の二第二項の協定(労働協約による場合を除き、労使委員会の決議及び労働時間等設定改善委員会の決議を含む。)には、有効期間の定めをするものとする。

A notification pursuant to the provisions of paragraph (3) of Article 38-2 of the Act must be given to the Director of the Labor Standards Office Concerned according to Form No. 12. When the working hours stipulated in an agreement under the provisions of paragraph (2) of the said Article do not exceed the working hours prescribed in the provisions of Article 32 or 40 of the Act, such an agreement does not need to be notified.

法第三十八条の二第三項の規定による届出は、様式第十二号により、所轄労働基準監督署長にしなければならない。ただし、同条第二項の協定で定める時間が法第三十二条又は第四十条に規定する労働時間以下である場合には、当該協定を届け出ることを要しない。

An employer may give notification to the Director of the Labor Standards Office Concerned of the contents of an agreement referred to in the provisions of paragraph (2) of Article 38-2 of the Act by including the said contents in the notification under the provisions of paragraph (1) of Article 36 of the Act (except notification of resolution of a labor-management and resolution of a committee on the improvement of working time arrangements) instead of giving the notification referred to in the preceding paragraph.

使用者は、法第三十八条の二第二項の協定の内容を法第三十六条第一項の規定による届出(労使委員会の決議の届出及び労働時間等設定改善委員会の決議の届出を除く。)に付記して所轄労働基準監督署長に届け出ることによつて、前項の届出に代えることができる。

Article 24-2-2

第二十四条の二の二

The provisions of paragraph (1) of Article 38-3 of the Act shall apply to the calculation of working hours in applying provisions concerning working hours under Chapter IV of the Act.

法第三十八条の三第一項の規定は、法第四章の労働時間に関する規定の適用に係る労働時間の算定について適用する。

The work prescribed in Ordinance of the Ministry of Health, Labour and Welfare pursuant to item (i) of paragraph (1) of Article 38-3 of the Act shall be the followings:

法第三十八条の三第一項第一号の厚生労働省令で定める業務は、次のとおりとする。

Work ofesearch and development of new products or new technologies or research in the human or natural sciences

新商品若しくは新技術の研究開発又は人文科学若しくは自然科学に関する研究の業務

Work ofanalysis or design of information processing systems (meaning any architecture that combines multiple elements for information processing using computers and is the basis for program design)

情報処理システム(電子計算機を使用して行う情報処理を目的として複数の要素が組み合わされた体系であつてプログラムの設計の基本となるものをいう。)の分析又は設計の業務

The work of gathering material for or editing articles in a newspaper or publishing business, or the work of gathering material for or editing the production of broadcast programs prescribed in Article 2, item (xxviii) of the Broadcast Act (Act No. 132 of 1950) (hereinafter referred to as "broadcast programs")

新聞若しくは出版の事業における記事の取材若しくは編集の業務又は放送法(昭和二十五年法律第百三十二号)第二条第二十八号に規定する放送番組(以下「放送番組」という。)の制作のための取材若しくは編集の業務

Work to develop new designs for apparel, interior decoration, industrial products, advertisements, etc.

衣服、室内装飾、工業製品、広告等の新たなデザインの考案の業務

Work of a producer or director at a business that produces broadcast programs, motion pictures, etc.

放送番組、映画等の制作の事業におけるプロデューサー又はディレクターの業務

Work designated by the Minister of Health, Labour and Welfare other than those listed in the preceding items

前各号のほか、厚生労働大臣の指定する業務

The matters prescribed in Ordinance of the Ministry of Health, Labour and Welfare under item (vi) of paragraph (1) of Article 38-3 of the Act shall be the followings:

That the employer must obtain the consent of the worker to the worker being deemed, when the employer has the worker engage in the work set forth in Article 38-3, paragraph (1), item (i) of the Act pursuant to the provisions of that paragraph, to have worked the hours set forth in item (ii) of that paragraph, and that the employer must not dismiss or otherwise treat disadvantageously a worker who has not given that consent.

使用者は、法第三十八条の三第一項の規定により労働者を同項第一号に掲げる業務に就かせたときは同項第二号に掲げる時間労働したものとみなすことについて当該労働者の同意を得なければならないこと及び当該同意をしなかつた当該労働者に対して解雇その他不利益な取扱いをしてはならないこと。

第一号の同意及びその撤回

A notification under the provisions of paragraph (iii) of Article 38-2 of the Act as applied mutatis mutandis prescribed in the provisions of paragraph (ii) of Article 38-3 of the Act must be made according to Form No. 13 to the Director of the Labor Standards Office Concerned.

法第三十八条の三第二項において準用する法第三十八条の二第三項の規定による届出は、様式第十三号により、所轄労働基準監督署長にしなければならない。

Article 24-2-2-2

第二十四条の二の二の二

An employer must prepare records for each worker concerning the matters set forth in paragraph (3), item (iv), (a) through (c) of the preceding Article, and must preserve them during the validity period under item (iii) of that paragraph and for five years after the expiration of that validity period.

使用者は、前条第三項第四号イからハまでに掲げる事項に関する労働者ごとの記録を作成し、同項第三号の有効期間中及び当該有効期間の満了後五年間保存しなければならない。

Article 24-2-3

第二十四条の二の三

A notification under the provisions of paragraph (1) of Article 38-4 of the Act must be submitted according to the Form No. 13-2 to the Director of the Labor Standards Office Concerned.

法第三十八条の四第一項の規定による届出は、様式第十三号の二により、所轄労働基準監督署長にしなければならない。

The provisions of paragraph (1) of Article 38-4 of the Act shall apply to the calculation of working hours in applying provisions concerning working hours under Chapter IVof the Act.

法第三十八条の四第一項の規定は、法第四章の労働時間に関する規定の適用に係る労働時間の算定について適用する。

The matters set forth in Ordinance of the Ministry of Health, Labour and Welfare under the provisions of item (vii) of paragraph (1) of Article 38-4 of the Act shall be listed as follows.

法第三十八条の四第一項第七号の厚生労働省令で定める事項は、次に掲げるものとする。

Procedures concerning the withdrawal of the consent referred to in Article 38-4, paragraph (1), item (vi) of the Act by a worker who falls within the scope of workers set forth in item (ii) of that paragraph and who engages in the work set forth in Article 38-4, paragraph (1), item (i) of the Act (referred to as a "covered worker" in the following item and in Article 24-2-4, paragraph (4))

使用者は、対象労働者に適用される評価制度及びこれに対応する賃金制度を変更する場合にあつては、労使委員会に対し、当該変更の内容について説明を行うこと。

The validity period of the resolution provided in paragraph (1) of Article 38-4 of the Act

Article 24-2-4

第二十四条の二の四

The appointment under the provisions of item (i) of paragraph (2) of Article 38-4 of the Act must be made with respect to persons other than persons in a supervisory or managerial position provided in item (ii) of Article 41 of the Act, and must not be based on the intentions of the employer.

法第三十八条の四第二項第一号の規定による指名は、法第四十一条第二号に規定する監督又は管理の地位にある者以外の者について行わなければならず、また、使用者の意向に基づくものであつてはならない。

With respect to the preparation and preservation of minutes under item (ii) of paragraph (2) of Article 38-4 of the Act, an employer shall prepare minutes of each meeting of the labor-management committee and keep such minutes on file for five years after the date of such meeting (or, in the case of the minutes of a meeting where a resolution provided in paragraph (1) of Article 38-4 of the Act, a resolution by a labor-management committee and a resolution by a majority of four fifths or more of the labor-management committee members pursuant to Article 25-2 (referred to as a "resolution by a labor-management committee, etc." in paragraph (7)) are adopted, the date of completion (as provided for in item (v) of paragraph (1) of Article 56) of the documentation in relation to such resolution).

法第三十八条の四第二項第二号の規定による議事録の作成及び保存については、使用者は、労使委員会の開催の都度その議事録を作成して、これをその開催の日(法第三十八条の四第一項に規定する決議及び労使委員会の決議並びに第二十五条の二に規定する労使委員会における委員の五分の四以上の多数による議決による決議(第七項において「労使委員会の決議等」という。)が行われた会議の議事録にあつては、当該決議に係る書面の完結の日(第五十六条第一項第五号の完結の日をいう。))から起算して五年間保存しなければならない。

With respect to the requirement to make the minutes known to workers provided in item (ii) of paragraph (2) of Article 38-4 of the Act, an employer shall make the minutes of a labor-management committee known to the workers at the workplace by any of the following means.

法第三十八条の四第二項第二号の規定による議事録の周知については、使用者は、労使委員会の議事録を、次に掲げるいずれかの方法によつて、当該事業場の労働者に周知させなければならない。

To post or maintain a copy of such minutes at an easily viewable location at each workplace at all times

常時各作業場の見やすい場所へ掲示し、又は備え付けること。

To deliver written copies of such minutes to the workers

書面を労働者に交付すること。

To make a record in a file stored on a computer used by the employer or in a file prepared by means of an electronic or magnetic recording medium (meaning a recording medium for electronic or magnetic records (meaning records made in an electronic form, a magnetic form, or any other form not recognizable to human perception, which are used in information processing by computers; the same applies hereinafter)), and to install at each workplace equipment by which workers can check the contents of that record at any time.

使用者の使用に係る電子計算機に備えられたファイル又は電磁的記録媒体(電磁的記録(電子的方式、磁気的方式その他人の知覚によつては認識することができない方式で作られる記録であつて、電子計算機による情報処理の用に供されるものをいう。以下同じ。)に係る記録媒体をいう。)をもつて調製するファイルに記録し、かつ、各作業場に労働者が当該記録の内容を常時確認できる機器を設置すること。

The requirements specified by Order of the Ministry of Health, Labour and Welfare referred to in item (iii) of paragraph (2) of Article 38-4 of the Act are to be that rules have been established concerning the following, as matters concerning the operation of the labor-management committee.

法第三十八条の四第二項第三号の厚生労働省令で定める要件は、労使委員会の運営に関する事項として次に掲げるものに関する規程が定められていることとする。

Matters concerning the convocation of the labor-management committee, its quorum and its proceedings

労使委員会の招集、定足数及び議事に関する事項

Matters concerning the explanation by the employer of the content of the evaluation system applicable to covered workers and of the wage system corresponding thereto

対象労働者に適用される評価制度及びこれに対応する賃金制度の内容の使用者からの説明に関する事項

Matters concerning ensuring proper operation in line with the purpose of the system

制度の趣旨に沿つた適正な運用の確保に関する事項

That the frequency of meetings is to be once in every period not exceeding six months.

開催頻度を六箇月以内ごとに一回とすること。

Beyond what is set forth in (a) through (d), matters necessary for the operation of the labor-management committee

イからニまでに掲げるもののほか、労使委員会の運営について必要な事項

An employer shall obtain the consent of the labor-management committee in order to establish or amend the regulations referred to the preceding paragraph.

使用者は、前項の規程の作成又は変更については、労使委員会の同意を得なければならない。

An employer shall not treat a worker disadvantageously on the grounds that the worker is a member of the labor-management committee or attempted to become a member of the committee, or acted justifiably as a member of the committee.

使用者は、労働者が労使委員会の委員であること若しくは労使委員会の委員になろうとしたこと又は労使委員会の委員として正当な行為をしたことを理由として不利益な取扱いをしないようにしなければならない。

An employer must give necessary consideration so that the members appointed under the provisions of item (i) of paragraph (2) of Article 38-4 of the Act can smoothly carry out the affairs concerning a resolution by a labor-management committee, etc.

使用者は、法第三十八条の四第二項第一号の規定により指名された委員が労使委員会の決議等に関する事務を円滑に遂行することができるよう必要な配慮を行わなければならない。

Article 24-2-5

第二十四条の二の五

The report under the provisions of paragraph (4) of Article 38-4 of the Act must be made to the Director of the Labor Standards Office Concerned according to Form No. 13-4, once within six months counting from the starting date of the validity period of the resolution provided in paragraph (1) of that Article, and thereafter once in every period not exceeding one year.

法第三十八条の四第四項の規定による報告は、同条第一項に規定する決議の有効期間の始期から起算して六箇月以内に一回、及びその後一年以内ごとに一回、様式第十三号の四により、所轄労働基準監督署長にしなければならない。

The report under the provisions of paragraph (4) of Article 38-4 of the Act is to be made on the status of the working hours of the workers provided in item (iv) of paragraph (1) of that Article and the status of implementation of the measures to ensure the health and welfare of those workers, and the status of implementation of the consent referred to in item (vi) of that paragraph and the withdrawal thereof.

法第三十八条の四第四項の規定による報告は、同条第一項第四号に規定する労働者の労働時間の状況並びに当該労働者の健康及び福祉を確保するための措置の実施状況並びに同項第六号の同意及びその撤回の実施状況について行うものとする。

Article 24-3

第二十四条の三

The hours prescribed by Ordinance of the Ministry of Health, Labour and Welfare under paragraph (3) of Article 39 of the Act shall be 30 hours.

法第三十九条第三項の厚生労働省令で定める時間は、三十時間とする。

The number of days stipulated by Ordinance of the Ministry of Health, Labour and Welfare as the prescribed working days in a week for ordinary workers under paragraph (3) of Article 39 of the Act shall be 5.2 days.

法第三十九条第三項の通常の労働者の一週間の所定労働日数として厚生労働省令で定める日数は、五・二日とする。

The number of days prescribed by Ordinance of the Ministry of Health, Labour and Welfare with due consideration for the ratio of the number of days prescribed by Ordinance of the Ministry of Health, Labour and Welfare as the prescribed working days in a week for ordinary workers and either the number of prescribed weekly working days for the workers concerned or the average number of prescribed working days per week for the workers concerned ,under paragraph (3) of Article 39 of the Act, given to the worker according to the worker's prescribed weekly working days listed (in the left columns) in the following table in case the worker falls set forth in item (i) of the same paragraph or according to the worker's prescribed yearly working days listed (in the middle columns) in the following table in case the worker falls under item (ii) of the same paragraph, shall be the number of days listed (in the right columns) in the following table according to the worker's continuous service years counting from the employment day.

法第三十九条第三項の通常の労働者の一週間の所定労働日数として厚生労働省令で定める日数と当該労働者の一週間の所定労働日数又は一週間当たりの平均所定労働日数との比率を考慮して厚生労働省令で定める日数は、同項第一号に掲げる労働者にあつては次の表の上欄の週所定労働日数の区分に応じ、同項第二号に掲げる労働者にあつては同表の中欄の一年間の所定労働日数の区分に応じて、それぞれ同表の下欄に雇入れの日から起算した継続勤務期間の区分ごとに定める日数とする。

The number of days prescribed by Ordinance of the Ministry of Health, Labour and Welfare under item (i) of paragraph (3) of Article 39 of the Act shall be 4 days.

法第三十九条第三項第一号の厚生労働省令で定める日数は、四日とする。

The number of days prescribed by Ordinance of the Ministry of Health, Labour and Welfare under item (ii) of paragraph (3) of Article 39 of the Act shall be 216 days.

法第三十九条第三項第二号の厚生労働省令で定める日数は、二百十六日とする。

Article 24-4

第二十四条の四

Matters prescribed by the Ordinance of the Ministry of Health, Labour and Welfare under item (iii) of paragraph (4) of Article 39 of the Act shall be as follows:

法第三十九条第四項第三号の厚生労働省令で定める事項は、次に掲げるものとする。

Number of hours of paid leave that can be given in the unit of hours (It shall not be lower than the number of prescribed working hours per day, or the number of the average prescribed daily working hours for a year if the number of prescribed working hours varies daily; the same shall apply in the following item.)

時間を単位として与えることができることとされる有給休暇一日の時間数(一日の所定労働時間数(日によつて所定労働時間数が異なる場合には、一年間における一日平均所定労働時間数。次号において同じ。)を下回らないものとする。)

Number of hours when paid leave is given in any unit other than one hour (It shall be lower than the number of prescribed working hours per day.)

一時間以外の時間を単位として有給休暇を与えることとする場合には、その時間数(一日の所定労働時間数に満たないものとする。)

Article 24-5

第二十四条の五

When an employer has decided, under the provisions of the proviso to paragraph (7) of Article 39 of the Act, to grant 10 or more working days of paid leave under the provisions of paragraphs (1) through (3) of that Article, the employer must grant five days out of the number of days of that paid leave by specifying the time thereof within a period of one year from the day, being a day prior to the base date (meaning the base date referred to in paragraph (7) of that Article; the same applies hereinafter in this Article), on which the employer decided to grant 10 or more working days of paid leave (hereinafter referred to as the "first base date" in this Article and Article 24-7).

使用者は、法第三十九条第七項ただし書の規定により同条第一項から第三項までの規定による十労働日以上の有給休暇を与えることとしたときは、当該有給休暇の日数のうち五日については、基準日同条第七項基準日をいう。以下この条において同じ。)より前の日であつて、十労働日以上の有給休暇を与えることとした日(以下この条及び第二十四条の七において「第一基準日」という。)から一年以内の期間に、その時季を定めることにより与えなければならない。

Notwithstanding the provisions of the preceding paragraph, when an employer has decided to grant 10 or more working days of paid leave under the provisions of paragraphs (1) through (3) of Article 39 of the Act on the base date or the first base date, and has decided to newly grant 10 or more working days of paid leave on a specified day within one year from that base date or first base date (hereinafter referred to as the "second base date" in this Article and Article 24-7), the employer may grant, during the fulfillment period (meaning the period beginning on the base date or the first base date and ending on the day on which one year elapses from the second base date; the same applies hereinafter in this Article), the number of days obtained by dividing the number of months in the fulfillment period by 12 and multiplying the result by five, by specifying the time thereof.

前項の規定にかかわらず、使用者が法第三十九条第一項から第三項までの規定による十労働日以上の有給休暇を基準日又は第一基準日に与えることとし、かつ、当該基準日又は第一基準日から一年以内の特定の日(以下この条及び第二十四条の七において「第二基準日」という。)に新たに十労働日以上の有給休暇を与えることとしたときは、履行期間(基準日又は第一基準日を始期として、第二基準日から一年を経過する日を終期とする期間をいう。以下この条において同じ。)の月数を十二で除した数に五を乗じた日数について、当該履行期間中に、その時季を定めることにより与えることができる。

In the case where the period referred to in paragraph (1) or the fulfillment period referred to in the preceding paragraph has elapsed, the first day of each of the periods obtained by dividing the time from the day on which it elapsed into one-year periods (or, when a period of less than one year arises at the end, that period) is deemed to be the base date, and the provisions of the main clause of paragraph (7) of Article 39 of the Act apply.

第一項の期間又は前項履行期間が経過した場合においては、その経過した日から一年ごとに区分した各期間(最後に一年未満の期間を生じたときは、当該期間)の初日を基準日とみなして法第三十九条第七項本文の規定を適用する。

In the case where an employer has decided to grant, on a day on or before the base date (hereinafter referred to as a "specified day" in this paragraph), a number of days of paid leave under the provisions of paragraphs (1) through (3) of Article 39 of the Act that is less than 10 working days, if there are two or more specified days, the latest of the specified days up to the day on which those numbers of days of less than 10 working days come to 10 or more working days in total is deemed to be the first base date, and the provisions of the preceding three paragraphs apply. In this case, with respect to the number of days of paid leave granted under the provisions of paragraph (5) or (6) of that Article before the day deemed to be the first base date, it is not required to grant that leave by specifying the time thereof.

使用者が法第三十九条第一項から第三項までの規定による有給休暇のうち十労働日未満の日数について基準日以前の日(以下この項において「特定日」という。)に与えることとした場合において、特定日が複数あるときは、当該十労働日未満の日数が合わせて十労働日以上になる日までの間の特定日のうち最も遅い日を第一基準日とみなして前三項の規定を適用する。この場合において、第一基準日とみなされた日より前に、同条第五項又は第六項の規定により与えた有給休暇の日数分については、時季を定めることにより与えることを要しない。

Article 24-6

第二十四条の六

In granting paid leave to a worker by specifying the time thereof under the provisions of paragraph (7) of Article 39 of the Act, an employer must, in advance, make clear to the worker that the paid leave is to be granted under the provisions of that paragraph, and then hear the opinion of the worker regarding the time thereof.

使用者は、法第三十九条第七項の規定により労働者に有給休暇を時季を定めることにより与えるに当たつては、あらかじめ、同項の規定により当該有給休暇を与えることを当該労働者に明らかにした上で、その時季について当該労働者の意見を聴かなければならない。

An employer must endeavor to respect the opinion heard under the provisions of the preceding paragraph.

使用者は、前項の規定により聴取した意見を尊重するよう努めなければならない。

Article 24-7

第二十四条の七

When an employer has granted paid leave under the provisions of paragraphs (5) through (7) of Article 39 of the Act, the employer must prepare a document which makes clear, for each worker, the time, the number of days and the base date (including the first base date and the second base date) (referred to as the "annual paid leave management register" in Article 55-2 and paragraph (3) of Article 56), and must preserve it during the period in which that paid leave was granted and for five years after the expiration of that period.

使用者は、法第三十九条第五項から第七項までの規定により有給休暇を与えたときは、時季、日数及び基準日(第一基準日及び第二基準日を含む。)を労働者ごとに明らかにした書類(第五十五条の二及び第五十六条第三項において「年次有給休暇管理簿」という。)を作成し、当該有給休暇を与えた期間中及び当該期間の満了後五年間保存しなければならない。

Article 25

第二十五条

The ordinary wages paid for working the prescribed working hours under the provisions of paragraph (9) of Article 39 of the Act are to be the amount calculated by the methods set forth below.

法第三十九条第九項の規定による所定労働時間労働した場合に支払われる通常の賃金は、次に定める方法によつて算定した金額とする。

When wages are determined on an hourly basis, they shall be calculated by multiplying the amount of hourly wages by the number of the prescribed working hours of the day

時間によつて定められた賃金については、その金額にその日の所定労働時間数を乗じた金額

When wages are determined on a daily basis, they shall be the amount determined

日によつて定められた賃金については、その金額

When wages are determined on a weekly basis, they shall be calculated by dividing the amount of weekly wages by the number of the prescribed working days of the week

週によつて定められた賃金については、その金額をその週の所定労働日数で除した金額

When wages are determined on a monthly basis, they shall be calculated by dividing the amount of monthly wages by the number of the prescribed working days of the month

月によつて定められた賃金については、その金額をその月の所定労働日数で除した金額

When wages are determined in accordance with a certain period other than a month or a week, they shall be calculated in the same manner as each of the preceding items

月、週以外の一定の期間によつて定められた賃金については、前各号に準じて算定した金額

When wages are determined at piece rates or on some other contract basis, they shall be calculated by dividing the total amount the wage calculated based on said piece rates or other contract basis during the period subject to the wage calculation (if no wages are calculated at a piece rate or on some other contract basis in the wage calculation period concerned, the amount of wages paid last time for the wage calculation period is used . Hereinafter the same shall apply.) by the total number of working hours in the wage calculation period concerned, then multiplying the quotient by the average daily prescribed working hours during the period subject to the wage calculation

出来高払制その他の請負制によつて定められた賃金については、その賃金算定期間(当該期間に出来高払制その他の請負制によつて計算された賃金がない場合においては、当該期間前において出来高払制その他の請負制によつて計算された賃金が支払われた最後の賃金算定期間。以下同じ。)において出来高払制その他の請負制によつて計算された賃金の総額を当該賃金算定期間における総労働時間数で除した金額に、当該賃金算定期間における一日平均所定労働時間数を乗じた金額

When wages consist of two or more conditions referred to in the preceding items, they shall be the total amounts of each part calculated according to the item concerned

労働者の受ける賃金が前各号の二以上の賃金よりなる場合には、その部分について各号によつてそれぞれ算定した金額の合計額

The wages in the amount calculated as specified by Order of the Ministry of Health, Labour and Welfare referred to in the main clause of paragraph (9) of Article 39 of the Act are to be wages in the amount obtained by dividing the average wage or the amount calculated under the provisions of the preceding paragraph by the number of prescribed working hours of that day.

法第三十九条第九項本文の厚生労働省令で定めるところにより算定した額の賃金は、平均賃金又は前項の規定により算定した金額をその日の所定労働時間数で除して得た額の賃金とする。

The amount calculated as specified by Order of the Ministry of Health, Labour and Welfare referred to in the proviso to paragraph (9) of Article 39 of the Act is to be the amount obtained by dividing an amount equivalent to one-thirtieth of the standard monthly remuneration provided in paragraph (1) of Article 40 of the Health Insurance Act (Act No. 70 of 1922) (if that amount includes a fraction of less than five yen, the fraction is to be discarded, and if it includes a fraction of five yen or more but less than 10 yen, the fraction is to be rounded up to 10 yen) by the number of prescribed working hours of that day.

法第三十九条第九項ただし書の厚生労働省令で定めるところにより算定した金額は、健康保険法(大正十一年法律第七十号)第四十条第一項に規定する標準報酬月額の三十分の一に相当する金額(その金額に、五円未満の端数があるときは、これを切り捨て、五円以上十円未満の端数があるときは、これを十円に切り上げるものとする。)をその日の所定労働時間数で除して得た金額とする。

Article 25-2

第二十五条の二

An employer who usually employs less than 10 workers in a business stipulated in items (viii), (x) (except businesses producing motion pictures), (xiii), and (xiv) of appended table 1 of the Act may have a worker work up to 44 hours in a week and up to 8 hours in a day, notwithstanding the provisions of Article 32 of the Act.

使用者は、法別表第一第八号第十号(映画の製作の事業を除く。)、第十三号及び第十四号に掲げる事業のうち常時十人未満の労働者を使用するものについては、法第三十二条の規定にかかわらず、一週間について四十四時間、一日について八時間まで労働させることができる。

In the event that an employer has stipulated that the average weekly working hours in a period not exceeding one month shall not exceed 44 hours in a written agreement either with a labor union organized by a majority of the workers at the workplace concerned where such a labor union exists, or with a person representing a majority of the workers at a workplace where no such labor union exists (including a resolution adopted by majority of four fifths or more of the labor-management committee members or a resolution adopted by majority of four fifths or more of the members of the committee on the improvement of working time arrangements referred to in the provisions of Article 7 of the Improvement of Working Time Arrangements Act; hereinafter the same shall apply in this Article), or in the rules of employment, or the equivalent, the employer may, with respect to the businesses provided in the preceding paragraph and notwithstanding the provisions of that paragraph, have a worker work in excess of 44 hours in a specified week or in excess of 8 hours in a specified day in accordance with said stipulation.

使用者は、当該事業場に、労働者の過半数で組織する労働組合がある場合においてはその労働組合、労働者の過半数で組織する労働組合がない場合においては労働者の過半数を代表する者との書面による協定(労使委員会における委員の五分の四以上の多数による決議及び労働時間等設定改善法第七条の労働時間等設定改善委員会における委員の五分の四以上の多数による決議を含む。以下この条において同じ。)により、又は就業規則その他これに準ずるものにより、一箇月以内の期間を平均し一週間当たりの労働時間が四十四時間を超えない定めをした場合においては、前項に規定する事業については同項の規定にかかわらず、その定めにより、特定された週において四十四時間又は特定された日において八時間を超えて、労働させることができる。

In the event that the following items have been provided in a written agreement either with a labor union organized by a majority of the workers at the workplace concerned ( in case where such labor union exists),or with a person representing a majority of the workers(in case where such union does not exist), the employer may have a worker who has discretion to decide the starting and ending time for work pursuant to rules of employment or the equivalent and notwithstanding the provisions of paragraph(1) with respect to the business provided in said paragraph, work in excess of 44 hours in a week or in excess of 8 hours in a day; provided the average working hours per week for the period prescribed as the settlement period stipulated in item (ii) below do not exceed 44 hours:

使用者は、就業規則その他これに準ずるものにより、その労働者に係る始業及び終業の時刻をその労働者の決定にゆだねることとした労働者については、当該事業場の労働者の過半数で組織する労働組合がある場合においてはその労働組合、労働者の過半数で組織する労働組合がない場合においては労働者の過半数を代表する者との書面による協定により、次に掲げる事項を定めたときは、その協定で第二号の清算期間として定められた期間を平均し一週間当たりの労働時間が四十四時間を超えない範囲内において、第一項に規定する事業については同項の規定にかかわらず、一週間において四十四時間又は一日において八時間を超えて、労働させることができる。

Article 25-3

第二十五条の三

The provisions of paragraph (1) of Article 6-2 apply mutatis mutandis to the person representing a majority of the workers provided in paragraphs (2) and (3) of the preceding Article; the provisions of paragraphs (3) and (4) of Article 6-2 apply mutatis mutandis to the employer referred to in paragraphs (2) and (3) of the preceding Article; the provisions of Article 12 and paragraph (1) of Article 12-2 apply mutatis mutandis to a provision made under paragraphs (2) and (3) of the preceding Article; the provisions of paragraph (1) of Article 12-2-2 apply mutatis mutandis to the agreement referred to in paragraph (2) of the preceding Article; and the provisions of Article 12-6 apply mutatis mutandis to the employer referred to in paragraph (2) of the preceding Article.

第六条の二第一項の規定は前条第二項及び第三項に規定する労働者の過半数を代表する者について、第六条の二第三項及び第四項の規定は前条第二項及び第三項の使用者について、第十二条及び第十二条の二第一項の規定は前条第二項及び第三項による定めについて、第十二条の二の二第一項の規定は前条第二項の協定について、第十二条の六の規定は前条第二項の使用者について準用する。

An employer shall submit the agreement referred to in paragraph (2) of the preceding Article according to Form No. 3-2 to the Director of the Labor Standards Office Concerned.

Article 26

第二十六条

With regard to those workers who work on board a train, diesel railcar, or electric railcar as reserve crew members in the businesses designated in item (iv) of appended table 1 of the Act, an employer may make them work for a period exceeding 40 hours a week or a period exceeding 8 hours a day, notwithstanding the provisions of paragraph (1) of Article 32-2 of the Act, to the extent that the average weekly working hours for a fixed period of one month or less do not exceed 40 hours.

使用者は、法別表第一第四号に掲げる事業において列車、気動車又は電車に乗務する労働者で予備の勤務に就くものについては、一箇月以内の一定の期間を平均し一週間当たりの労働時間が四十時間を超えない限りにおいて、法第三十二条の二第一項の規定にかかわらず、一週間について四十時間、一日について八時間を超えて労働させることができる。

Article 31

第三十一条

The provisions of paragraph (2) of Article 34 of the Act shall not apply to the businesses designated in any of items (iv),(viii),(ix),(x),(xi), (xiii), and (xiv) of appended table 1 of the Act and businesses of public agencies (except the businesses designated in said appended table 1).

法別表第一第四号第八号第九号第十号第十一号第十三号及び第十四号に掲げる事業並びに官公署の事業(同表に掲げる事業を除く。)については、法第三十四条第二項の規定は、適用しない。

Article 32

第三十二条

With regard to those engineers, drivers, pilots, conductors, train masters, baggage men, trainmen, stewards, air conditioning engineers and power supply officers of a train, diesel railcar, electric railcar, automobile, ship or aircraft (hereinafter referred to as "crew members") who continuously work on board over a long distance among workers employed for the businesses designated in item (iv) of appended table 1 of the Act or for the postal or mail delivery businesses, and workers employed for the businesses designated in item (xi) of the same table who are engaged in postal business at business offices of Japan Post Co., Ltd. having less than 30 indoor workers (limited to business offices which provide postal counter service prescribed in Article 2 of the Post Office Branch Act (Act No. 213 of 1949)), an employer may give them no rest periods notwithstanding the provisions of Article 34 of the Act.

使用者は、法別表第一第四号に掲げる事業又は郵便若しくは信書便の事業に使用される労働者のうち列車、気動車、電車、自動車、船舶又は航空機に乗務する機関手、運転手、操縦士、車掌、列車掛、荷扱手、列車手、給仕、暖冷房乗務員及び電源乗務員(以下単に「乗務員」という。)で長距離にわたり継続して乗務するもの並びに同表第十一号に掲げる事業に使用される労働者で屋内勤務者三十人未満の日本郵便株式会社の営業所(簡易郵便局法(昭和二十四年法律第二百十三号)第二条に規定する郵便窓口業務を行うものに限る。)において郵便の業務に従事するものについては、法第三十四条の規定にかかわらず、休憩時間を与えないことができる。

With regard to those crew members who do not fall under the provisions of the preceding paragraph, an employer may give them no rest periods when it is found impossible to give them rest periods because of the nature of the work in which they are engaged, if the total of stoppage time, waiting time for turning back and other time while on duty is equal to the rest period prescribed in paragraph (1) of Article 34 of the Act, notwithstanding the provisions of the same Article.

使用者は、乗務員前項の規定に該当しないものについては、その者の従事する業務の性質上、休憩時間を与えることができないと認められる場合において、その勤務中における停車時間、折返しによる待合せ時間その他の時間の合計が法第三十四条第一項に規定する休憩時間に相当するときは、同条の規定にかかわらず、休憩時間を与えないことができる。

Article 33

第三十三条

The provisions of paragraph (3) of Article 34 of the Act shall not apply to those workers who fall under any of the following items:

法第三十四条第三項の規定は、左の各号の一に該当する労働者については適用しない。

Police officers, fire service personnel, full-time members of volunteer fire corps, associate emergency medical service personnel, and staff members working at children's self-reliance support facilities who live together with children

警察官、消防吏員、常勤の消防団員、准救急隊員及び児童自立支援施設に勤務する職員で児童と起居をともにする者

Workers working for infant homes, foster homes, and facilities for children with disabilities who live together with children

乳児院、児童養護施設及び障害児入所施設に勤務する職員で児童と起居をともにする者

Among workers employed in a home-visit child care business provided in paragraph (11) of Article 6-3 of the Child Welfare Act (Act No. 164 of 1947), persons who provide child care as home-based childcare providers (meaning the home-based childcare providers provided in item (i) of paragraph (9) of that Article; the same applies hereinafter in this item) (excluding the case where two or more home-based childcare providers simultaneously provide child care for one child in the same residence)

児童福祉法(昭和二十二年法律第百六十四号)第六条の三第十一項に規定する居宅訪問型保育事業に使用される労働者のうち、家庭的保育者同条第九項第一号に規定する家庭的保育者をいう。以下この号において同じ。)として保育を行う者(同一の居宅において、一の児童に対して複数の家庭的保育者が同時に保育を行う場合を除く。)

An employer who employs those workers falling under item (ii) of the preceding paragraph shall obtain, in advance, the permission of the Director of the Labor Standards Office Concerned for the number of such workers, the number of children for accommodation and the manner of work, according to Form No. 13-5.

前項第二号に掲げる労働者を使用する使用者は、その員数、収容する児童数及び勤務の態様について、様式第十三号の五によつて、予め所轄労働基準監督署長の許可を受けなければならない。

Article 34

第三十四条

A permission under the provisions of item (iii) of Article 41 of the Act must be obtained from the Director of the Labor Standards Office Concerned for the manner of labor to be engaged in and the number of workers according to Form No. 14.

法第四十一条第三号の規定による許可は、従事する労働の態様及び員数について、様式第十四号によつて、所轄労働基準監督署長より、これを受けなければならない。

Article 34-2

第三十四条の二

The notification under the provisions of paragraph (1) of Article 41-2 of the Act must be made to the Director of the Labor Standards Office Concerned according to Form No. 14-2.

法第四十一条の二第一項の規定による届出は、様式第十四号の二により、所轄労働基準監督署長にしなければならない。

The method specified by Order of the Ministry of Health, Labour and Welfare provided in the part of paragraph (1) of Article 41-2 of the Act other than the items is to be the method of obtaining the signature of the covered worker (meaning a "covered worker" provided in that paragraph; the same applies hereinafter) on a document which makes clear the following matters and receiving delivery of that document (or, if the covered worker so wishes, the method of receiving the provision of an electronic or magnetic record in which the matters to be stated in that document are recorded).

To provide face-to-face guidance by a physician (meaning ascertaining the physical and mental condition through medical interviews and other methods and giving necessary guidance through face-to-face interviews in response thereto, and excluding the face-to-face guidance under the provisions of paragraph (1) of Article 66-8-4 of the Industrial Safety and Health Act (Act No. 57 of 1972)) to covered workers whose working hours subject to health management exceed a certain number of hours.

健康管理時間が一定時間を超える対象労働者に対し、医師による面接指導(問診その他の方法により心身の状況を把握し、これに応じて面接により必要な指導を行うことをいい、労働安全衛生法(昭和四十七年法律第五十七号)第六十六条の八の四第一項の規定による面接指導を除く。)を行うこと。

To grant compensatory days off or special leave according to the working status and the health condition of the covered worker.

対象労働者の勤務状況及びその健康状態に応じて、代償休日又は特別な休暇を付与すること。

To establish a consultation service for covered workers concerning problems of mental and physical health.

対象労働者の心とからだの健康問題についての相談窓口を設置すること。

To give consideration to the working status and the health condition of the covered worker and, if necessary, transfer the covered worker to an appropriate department.

対象労働者の勤務状況及びその健康状態に配慮し、必要な場合には適切な部署に配置転換をすること。

To receive advice or guidance from an industrial physician or the like, or to have the covered worker receive health guidance from an industrial physician or the like.

産業医等による助言若しくは指導を受け、又は対象労働者に産業医等による保健指導を受けさせること。

The matters specified by Order of the Ministry of Health, Labour and Welfare referred to in item (x) of paragraph (1) of Article 41-2 of the Act are to be the following.

法第四十一条の二第一項第十号の厚生労働省令で定める事項は、次に掲げるものとする。

常時五十人未満の労働者を使用する事業場である場合には、労働者の健康管理等を行うのに必要な知識を有する医師を選任すること。

That the employer preserves records for each covered worker concerning the matters listed in (a) through (h) and records concerning the matter listed in (i) during the validity period referred to in item (i) and for five years after the expiration of that validity period.

Article 34-2-2

第三十四条の二の二

The report under the provisions of paragraph (2) of Article 41-2 of the Act must be made to the Director of the Labor Standards Office Concerned according to Form No. 14-3, in every period not exceeding six months counting from the starting date of the validity period of the resolution referred to in paragraph (1) of that Article.

法第四十一条の二第二項の規定による報告は、同条第一項の決議の有効期間の始期から起算して六箇月以内ごとに、様式第十四号の三により、所轄労働基準監督署長にしなければならない。

The report under the provisions of paragraph (2) of Article 41-2 of the Act is to be made on the status of working hours subject to health management and the status of implementation of the measures provided in item (iv) of paragraph (1) of that Article, the measures provided in item (v) of that paragraph and the measures provided in item (vi) of that paragraph.

法第四十一条の二第二項の規定による報告は、健康管理時間の状況並びに同条第一項第四号に規定する措置、同項第五号に規定する措置及び同項第六号に規定する措置の実施状況について行うものとする。

Article 34-2-3

第三十四条の二の三

The provisions of Article 24-2-4 (excluding (b) through (d) of paragraph (4)) apply mutatis mutandis to the committee referred to in paragraph (1) of Article 41-2 of the Act. In this case, the term "(a) through (d)" in (e) of paragraph (4) of Article 24-2-4 is to be deemed to be replaced with "(a)".

第二十四条の二の四第四項ロからニまでを除く。)の規定は、法第四十一条の二第一項の委員会について準用する。この場合において、第二十四条の二の四第四項ホ中「イからニまで」とあるのは、「イ」と読み替えるものとする。

Article 34-2-4

第三十四条の二の四

The hours specified by Order of the Ministry of Health, Labour and Welfare referred to in item (ii) of paragraph (3) of Article 60 of the Act are to be 48 hours.

法第六十条第三項第二号の厚生労働省令で定める時間は、四十八時間とする。

Article 34-2-5

第三十四条の二の五

The period of a labor contract with a worker who receives vocational training (hereinafter referred to as "trainee") from an employer who has obtained the permission pursuant to the provisions of Article 71 of the Act may be set according to the training course of the vocational training the trainee receives within the period prescribed by item (iv) of paragraph (1) of Article 10, item (iv) of paragraph (1) of Article 12 or item (iv) of paragraph (1) of Article 14 of Ordinance for Enforcement of the Vocational Ability Development and Promotion Act (Order of the Ministry of Labour No. 24 of 1969) (in the case where the training period is reduced under the provisions of Article 21 of the same Ordinance or paragraph (2) of Article 2 of the supplementary provisions of Ordinance of the Ministry of Labor for Making a Partial Revision of the Ordinance for Enforcement of the Vocational Training Act (Order of the Ministry of Labour No. 37 of 1978; hereinafter referred to as the "1978 Amended Training Rules"), the reduced period shall be deducted). In this case, the training period prescribed by the workplace shall not be exceeded.

法第七十一条の規定による許可を受けた使用者が行う職業訓練を受ける労働者(以下「訓練生」という。)に係る労働契約の期間は、当該訓練生が受ける職業訓練の訓練課程に応じ職業能力開発促進法施行規則(昭和四十四年労働省令第二十四号)第十条第一項第四号第十二条第一項第四号又は第十四条第一項第四号の訓練期間(同規則第二十一条又は職業訓練法施行規則の一部を改正する省令(昭和五十三年労働省令第三十七号。以下「昭和五十三年改正訓練規則」という。)附則第二条第二項の規定により訓練期間を短縮する場合においてはその短縮した期間を控除した期間とする。)の範囲内で定めることができる。この場合、当該事業場において定められた訓練期間を超えてはならない。

Article 34-3

第三十四条の三

When an employer finds it necessary so as to make trainees learn skills, the employer may make trainees under 18 years of age engage in some dangerous and injurious work designated in Article 62 of the Act or have male trainees of 16 years of age or more engage in belowground labor.

使用者は、訓練生に技能を習得させるために必要がある場合においては、満十八才に満たない訓練生を法第六十二条の危険有害業務に就かせ、又は満十六才以上の男性である訓練生を坑内労働に就かせることができる。

When an employer have trainees engage in some dangerous and injurious work or belowground labor set forth in the provisions of the preceding paragraph, the employer shall take necessary preventive measures against danger.

使用者は、前項の規定により訓練生を危険有害業務又は坑内労働に就かせる場合においては、危害を防止するために必要な措置を講じなければならない。

Dangerous and injurious work or belowground labor set forth in paragraph (1), and the preventive measures to be taken by an employer referred to provisions of the preceding paragraph shall be shown in appended table 1.

第一項の危険有害業務及び坑内労働の範囲並びに前項の規定により使用者が講ずべき措置の基準は、別表第一に定めるところによる。

Article 34-4

第三十四条の四

The permission under the provisions of Article 71 of the Act must be obtained from the Director of the Prefectural Labor Bureau having jurisdiction over the location of the workplace, by means of a written application for special permission concerning vocational training according to Form No. 14-4.

法第七十一条の規定による許可は、様式第十四号の四の職業訓練に関する特例許可申請書により、当該事業場の所在地を管轄する都道府県労働局長から受けなければならない。

Article 34-5

第三十四条の五

When the Director of General of the Prefectural Labor Bureau has given or not, or rescinded permission to an application pursuant to the provisions of the preceding Article, said director shall give notice to said effect to the prefectural governor concerned.

都道府県労働局長は、前条の申請について許可をしたとき、若しくは許可をしないとき、又は許可を取り消したときは、その旨を都道府県知事に通知しなければならない。

Article 35

第三十五条

The scope of illness in the course of employment under the provisions of paragraph (2) of Article 75 of the Act shall be shown in appended table 1-2.

法第七十五条第二項の規定による業務上の疾病は、別表第一の二に掲げる疾病とする。

Article 36

第三十六条

The scope of medical treatment provided in the provision of paragraph (2) of Article 75 of the Act shall be those set forth as follows are found necessary for medical care:

Article 37

第三十七条

If a worker is injured, gets disease, or dies in employment or in the workplace, or in auxiliary buildings of the business, the employer shall make a medical doctor diagnose the worker without delay.

労働者が就業中又は事業場若しくは事業の附属建設物内で負傷し、疾病にかゝり又は死亡した場合には、使用者は、遅滞なく医師に診断させなければならない。

Article 37-2

第三十七条の二

If a worker falls under any of the following items, this worker's employer may make no compensation for absence from work:

使用者は、労働者が次の各号のいずれかに該当する場合においては、休業補償を行わなくてもよい。

In the case of being detained in a penal institution (including, in the case where a sentence is executed in a juvenile training school pursuant to the provisions of paragraph (3) of Article 56 of the Juvenile Act (Act No. 168 of 1948), that juvenile training school) for the execution of a sentence of imprisonment or penal detention or upon being sentenced to death, or of being detained in a detention facility and undergoing the execution of a sentence of imprisonment or penal detention, in the case of being detained in a workhouse upon being ordered to be detained in a workhouse, or in the case of being detained in a confinement facility for the execution of a judicial decision of confinement

拘禁刑若しくは拘留の刑の執行のため若しくは死刑の言渡しを受けて刑事施設(少年法(昭和二十三年法律第百六十八号)第五十六条第三項の規定により少年院において刑を執行する場合における当該少年院を含む。)に拘置されている場合若しくは留置施設に留置されて拘禁刑若しくは拘留の刑の執行を受けている場合、労役場留置の言渡しを受けて労役場に留置されている場合又は監置の裁判の執行のため監置場に留置されている場合

Article 38

第三十八条

When a worker only works for part of the prescribed working hours due to injury or disease in the course of employment, the employer shall pay the worker, 60 percent of the difference between the average wages and those paid for said work as a compensation for absence from work.

労働者が業務上負傷し又は疾病にかかつたため、所定労働時間の一部分のみ労働した場合においては、使用者は、平均賃金と当該労働に対して支払われる賃金との差額の百分の六十の額を休業補償として支払わなければならない。

Article 38-2

第三十八条の二

In any one-year period from April 1 to March 31,a workplace that usually employs fewer than 100 workers, as referred to in paragraph (2) of Article 76 of the Act is one with fewer than 100workers,ascalculated by dividing the number of workers, in terms of worker-years, during the one year before the relevant April 1 have been employed from April 1 to March 31 each year by the number of the prescribed working days for the year concerned .

法第七十六条第二項の常時百人未満の労働者を使用する事業場は、毎年四月一日から翌年三月三十一日までの間においては、当該四月一日前一年間に使用した延労働者数を当該一年間の所定労働日数で除した労働者数が百人未満である事業場とする。

Article 38-3

第三十八条の三

The ordinary wages paid to workers engaged in the same type of work in the same workplace for the prescribed working hours referred to the provisions of paragraph (2) of Article 76 of the Act shall be calculated in the same manner as the method set forth in the provisions of paragraph (1) of Article 25.

法第七十六条第二項の規定による同一の事業場における同種の労働者に対して所定労働時間労働した場合に支払われる通常の賃金は、第二十五条第一項に規定する方法に準じて算定した金額とする。

Article 38-4

第三十八条の四

If there exists no worker whose work and working conditions are the same as those of a worker who suffers an injured or illness in the course of employment in a workplace which usually employs 100 workers or more, the amount of the compensation for absence from work paid to the worker shall be adjusted when the quarterly average of the ordinary wages paid to all the workers in said workplace for the prescribed working hours is increased or decreased.

常時百人以上の労働者を使用する事業場において業務上負傷し、又は疾病にかかつた労働者と同一職種の同一条件の労働者がいない場合における当該労働者の休業補償の額の改訂は、当該事業場の全労働者に対して所定労働時間労働した場合に支払われる通常の賃金の四半期ごとの平均給与額が上昇し又は低下した場合に行うものとする。

Article 38-5

第三十八条の五

Any amount of compensation for absence from work following an adjustment under the provisions of the second sentence of paragraph (2) of Article 76 of the Act shall be made on the basis of the quarterly average wages which has been used as a basis for the first adjustment.

法第七十六条第二項後段の規定による改訂後の休業補償の額の改訂は、改訂の基礎となつた四半期の平均給与額を基礎として行うものとする。

Article 38-6

第三十八条の六

In case where the increasing or decreasing rate of average wages is calculated on a quarterly under the provisions of paragraphs (2) and (3) of Article 76 of the Act, if there is a fractional percentage to be disregarded.

法第七十六条第二項及び第三項の規定により、四半期ごとに平均給与額の上昇し又は低下した比率を算出する場合において、その率に百分の一に満たない端数があるときは、その端数は切り捨てるものとする。

Article 38-7

第三十八条の七

With respect to compensation for absence from work at a workplace that regularly employs fewer than 100 workers, the rate by which 60 percent of the average wage (or, if the workplace is one that has revised the amount of that compensation for absence from work as a workplace regularly employing 100 or more workers, the amount of compensation for absence from work pertaining to that revision) is to be multiplied in calculating the amount of that compensation for absence from work is to be publicly notified, based on the ratio of the quarterly average amount of salary regularly paid every month in each industry in the Monthly Labour Survey to the quarterly average amount of salary for the quarter preceding that quarter.

常時百人未満の労働者を使用する事業場における休業補償については、毎月勤労統計における各産業の毎月きまつて支給する給与の四半期ごとの平均給与額のその四半期の前における四半期ごとの平均給与額に対する比率に基づき、当該休業補償の額の算定にあたり平均賃金の百分の六十(当該事業場が当該休業補償について常時百人以上の労働者を使用するものとしてその額の改訂をしたことがあるものである場合にあつては、当該改訂に係る休業補償の額)に乗ずべき率を告示するものとする。

Article 38-8

第三十八条の八

If the industry to which a workplace usually employing less than 100 workers belongs is not included in the industry classification listed in the Monthly Labor Survey, the amount of compensation for absence from work shall be calculated by multiplying 60 percent of the amount of average wages (or the adjusted amount, if a workplace has ever adjusted the amount of compensation for absence from work as a workplace usually employing100 workers or more, or according to Monthly Labor Survey ) by the rate prescribed by public notice.

常時百人未満の労働者を使用する事業場の属する産業が毎月勤労統計に掲げる産業分類にない場合における休業補償の額の算定については、平均賃金の百分の六十(当該事業場が、当該休業補償について、常時百人以上の労働者を使用するものとしてその額の改訂をしたことがあるものである場合又は毎月勤労統計によりその額の改訂をしたことがあるものである場合にあつては、当該改訂に係る休業補償の額)に告示で定める率を乗ずるものとする。

With regard to workers who are employed on a daily basis, an amount of compensation for absence from work shall be calculated by multiplying 60 percent of the amount of average wages by the rate prescribed by public notice.

日日雇い入れられる者の休業補償の額の算定については、平均賃金の百分の六十に告示で定める率を乗ずるものとする。

Article 38-9

第三十八条の九

A public notice pursuant to the provisions of the preceding two Articles shall be given every quarter.

前二条の告示は、四半期ごとに行うものとする。

Article 38-10

第三十八条の十

When it is difficult to adjust the amount of compensation for absence from work under the provisions of Articles 38-4, 38-5, 38-7 and 38-8, it shall be adjusted by the Minister of Health, Labour and Welfare.

休業補償の額の改訂について、第三十八条の四第三十八条の五第三十八条の七及び第三十八条の八の規定により難い場合は、厚生労働大臣の定めるところによるものとする。

Article 39

第三十九条

Payments for medical compensation and compensation for absence from work must be made once per month or more.

療養補償及び休業補償は、毎月一回以上、これを行わなければならない。

Article 40

第四十条

The grades of physically disabled persons eligible for compensation for disabilities shall be listed in appended table 2.

障害補償を行うべき身体障害の等級は、別表第二による。

When a worker suffers from two or more of the physical disabilities listed in appended table 2, the grade shall be the one for the most serious disability.

別表第二に掲げる身体障害が二以上ある場合は、重い身体障害の該当する等級による。

In any of the following cases, a grade under the preceding two paragraphs shall be raised as follows.However, the amount of the disability compensation for the raised grade must not exceed the total amount of the disability compensation for the grade in which each of the physical disabilities falls:

次に掲げる場合には、前二項の規定による等級を次の通り繰上げる。但し、その障害補償の金額は、各々の身体障害の該当する等級による障害補償の金額を合算した額を超えてはならない。

When a worker suffers from two or more of the physical disabilities corresponding to Grade 13 and above:one grade

第十三級以上に該当する身体障害が二以上ある場合 一級

When a worker suffers from two or more of the physical disabilities corresponding to Grade 8 or above:two grades

第八級以上に該当する身体障害が二以上ある場合 二級

When a worker suffers from two or more of the physical disabilities corresponding to Grade 5 or above:three grades

第五級以上に該当する身体障害が二以上ある場合 三級

With regard to a worker who suffers from a physical disability other than those listed in appended table 2, disability compensation must be made according to the degree of the disability in the same manner as the disabilities listed in appended table 2.

別表第二に掲げるもの以外の身体障害がある者については、その障害程度に応じ、別表第二に掲げる身体障害に準じて、障害補償を行わなければならない。

When a worker with an existing physical disability has aggravated the disability of the same part due to an injury or illness, the compensation for the disability must be made in the amount of compensation for the disability corresponding to the aggravated disability less the amount of compensation for the disability corresponding to the existing disability.

既に身体障害がある者が、負傷又は疾病によつて同一部位について障害の程度を加重した場合には、その加重された障害の該当する障害補償の金額より、既にあつた障害の該当する障害補償の金額を差し引いた金額の障害補償を行わなければならない。

Article 41

第四十一条

A certification pursuant to the provisions of Article 78 of the Act must be obtained according to Form No. 15 from the Director of the Labor Standards Office Concerned.In this case, the employer shall at same time submit a written document that proves the fact that there has been gross negligence prescribed in the provisions said Article.

法第七十八条の規定による認定は、様式第十五号により、所轄労働基準監督署長から受けなければならない。この場合においては、使用者は、同条に規定する重大な過失があつた事実を証明する書面をあわせて提出しなければならない。

Article 42

第四十二条

The person who should be given compensation for bereaved family shall be the spouse of a worker (including the person who has de facto marital relationship without a marriage notification; hereinafter the same shall apply).

遺族補償を受けるべき者は、労働者の配偶者(婚姻の届出をしなくとも事実上婚姻と同様の関係にある者を含む。以下同じ。)とする。

When a worker has no spouse, the persons who should be given compensation for bereaved family shall be the worker's children, parents, grandchildren and grandparents, who made a living from the worker's income, or who lived on common living expenses at the time when the worker died and the priority is in the order mentioned above. As for parents, adoptive parents shall have priority over natural parents.

配偶者がない場合には、遺族補償を受けるべき者は、労働者の子、父母、孫及び祖父母で、労働者の死亡当時その収入によつて生計を維持していた者又は労働者の死亡当時これと生計を一にしていた者とし、その順位は、前段に掲げる順序による。この場合において、父母については、養父母を先にし実父母を後にする。

Article 43

第四十三条

When a worker has no one who falls under the provisions of the preceding Article, the person who should be given compensation for bereaved family shall be the worker's children, parents, grandchildren and grandparents who do not fall under the provisions of paragraph (2) of the preceding Article, and the worker's brothers and sisters and the priority is in the order of children, parent, grandchildren, grandparents and bothers and sisters, and as for brothers and sisters, those who made a living from the worker's income, or who lived on common living expenses at the time when the worker died shall have priority.

前条の規定に該当する者がない場合においては、遺族補償を受けるべき者は、労働者の子、父母、孫及び祖父母で前条第二項の規定に該当しないもの並びに労働者の兄弟姉妹とし、その順位は、子、父母、孫、祖父母、兄弟姉妹の順序により、兄弟姉妹については、労働者の死亡当時その収入によつて生計を維持していた者又は労働者の死亡当時その者と生計を一にしていた者を先にする。

When a worker has designated a specific person among those who fall under the provisions set forth in the preceding paragraph in a will or in an advance notice to the employer, the person who should be given compensation for survivor shall be the designated one notwithstanding the provisions of the preceding paragraph.

労働者が遺言又は使用者に対してした予告で前項に規定する者のうち特定の者を指定した場合においては、前項の規定にかかわらず、遺族補償を受けるべき者は、その指定した者とする。

Article 44

第四十四条

When there are two or more persons of the same priority rank who should be given compensation for bereaved family, the compensation for bereaved family shall be equally divided by the number of such persons.

遺族補償を受けるべき同順位の者が二人以上ある場合には、遺族補償は、その人数によつて等分するものとする。

Article 45

第四十五条

When a person who should be given compensation for bereaved family has died, that person's right to receive such compensation for bereaved family shall cease to exist.

遺族補償を受けるべきであつた者が死亡した場合には、その者にかかる遺族補償を受ける権利は、消滅する。

In the cases referred to in the preceding paragraph, the employer shall give compensation for bereaved family excluding the deceased from the persons with priority order under the provisionss of any of the three preceding Articles.

前項の場合には、使用者は、前三条の規定による順位の者よりその死亡者を除いて、遺族補償を行わなければならない。

Article 46

第四十六条

After the commencement of the payment of compensation in installments pursuant to the provisions of Article 82 of the Act, an employer may pay the remaining amount of the compensation in a lump sum according to appended table 3 with the consent of the person who should be given the compensation.

使用者は、法第八十二条の規定によつて分割補償を開始した後、補償を受けるべき者の同意を得た場合には、別表第三によつて残余の補償金額を一時に支払うことができる。

Article 47

第四十七条

Compensation for physical disabilities must be made within seven days from the date when the disability grade is determined after a worker has recovered from the injury or illness.

障害補償は、労働者の負傷又は疾病がなおつた後身体障害の等級が決定した日から七日以内にこれを行わなければならない。

Compensation for bereaved family and funeral rites expenses shall be paid within seven days from the date when persons must be given the compensation for bereaved family and the funeral rites expenses is determined after a worker dies.

遺族補償及び葬祭料は、労働者の死亡後遺族補償及び葬祭料を受けるべき者が決定した日から七日以内にこれを行い又は支払わなければならない。

The second and later installments of compensation must be paid every year in the month corresponding to the month when the first installment of compensation is paid.

第二回以後の分割補償は、毎年、第一回の分割補償を行つた月に応当する月に行わなければならない。

Article 48

第四十八条

When accident compensation is made, the date when the accident causing death or injury has occurred or the date which is confirmed by diagnosis as that of the outbreak of the illness shall be the date when a cause has arisen to calculate average wages.

災害補償を行う場合には、死傷の原因たる事故発生の日又は診断によつて疾病の発生が確定した日を、平均賃金を算定すべき事由の発生した日とする。

Article 48-2

第四十八条の二

The businesses set in forth in Ordinance of the Ministry of Health, Labour and Welfare pursuant to the provisions of paragraph (1) of Article 87 of the Act shall be those businesses listed in item (iii) of appended table 1 of the Act.

法第八十七条第一項の厚生労働省令で定める事業は、法別表第一第三号に掲げる事業とする。

Article 49

第四十九条

When an employer has come to usually employ ten or more workers, the employer shall submit the rules of employment under the provisions of Article 89 of the Act, to the Director of the Labor Standards Office Concerned without delay.

使用者は、常時十人以上の労働者を使用するに至つた場合においては、遅滞なく、法第八十九条の規定による就業規則の届出を所轄労働基準監督署長にしなければならない。

The document stating the opinion that is to be attached to the notification referred to in the preceding paragraph under the provisions of paragraph (2) of Article 90 of the Act must state the name of the person representing the workers.

法第九十条第二項の規定により前項の届出に添付すべき意見を記した書面は、労働者を代表する者の氏名を記載したものでなければならない。

Article 50

第五十条

The order to change rules of employment under the provisions of paragraph (2) of Article 92 of the Act shall be given in writing according to Form No. 17 by the Director of the Labor Standards Office Concerned.

法第九十二条第二項の規定による就業規則の変更命令は、様式第十七号による文書で所轄労働基準監督署長がこれを行う。

Article 50-2

第五十条の二

Businesses involving dangerous activities or those involving activities harmful to health set forth in Ordinance of the Ministry of Health, Labour and Welfare under the provisions of paragraph (1) of Article 96-2 of the Act shall be listed as follows:

第五十二条の二

The methods set forth in Ordinance of the Ministry of Health, Labour and Welfare under paragraph (1) of Article 106 of the Act shall be listed as follows:

法第百六条第一項の厚生労働省令で定める方法は、次に掲げる方法とする。

To post or maintain a copy of such laws and regulations, etc. at an easily viewable location at each workplace at all times

常時各作業場の見やすい場所へ掲示し、又は備え付けること。

Article 53

第五十三条

Items to be entered into a roster of workers (Form No. 19) under paragraph (1) of Article 107 of the Act shall be those listed as follows in addition to those provided by the same paragraph of the same Article:

Article 54

第五十四条

An employer shall enter the following items into the wage ledger for each worker under the provisions of Article 108 of the Act:

When wage categories under item (vii) of paragraph (1) include wages paid in some form other than currency, the total appraised value of such wages must be stated.

第一項第七号の賃金の種類中に通貨以外のもので支払われる賃金がある場合には、その評価総額を記入しなければならない。

With regard to workers hired on a daily basis (except those who continue to be employed for a period exceeding one month), item (iii) of paragraph (1) shall not be required to be stated.

Article 55

第五十五条

A wage ledger pursuant to the provisions of Article 108 of the Act must be prepared for regular workers (including those hired on a daily basis who continue to be employed for a period exceeding one month) according to Form No. 20, and for workers hired on a daily basis according to Form No. 21 (excluding those who continue to be employed for a period exceeding one month).

法第百八条の規定による賃金台帳は、常時使用される労働者(一箇月を超えて引続き使用される日々雇い入れられる者を含む。)については様式第二十号日々雇い入れられる者(一箇月を超えて引続き使用される者を除く。)については様式第二十一号によつて、これを調製しなければならない。

Article 55-2

第五十五条の二

An employer may prepare the annual paid leave management register, the roster of workers under Article 53 or the wage ledger under Article 55 together.

使用者は、年次有給休暇管理簿第五十三条による労働者名簿又は第五十五条による賃金台帳をあわせて調製することができる。

Article 56

第五十六条

The starting point of a preservation period of records under Article 109 of the Act shall be as follows:

法第百九条の規定による記録を保存すべき期間の計算についての起算日は次のとおりとする。

Date of the death, retirement or dismissal of a worker for a roster of workers

労働者名簿については、労働者の死亡、退職又は解雇の日

Date when the last entry is made for a wage ledger

賃金台帳については、最後の記入をした日

Date of the retirement or death of a worker for documents concerning the hiring or retirement of a worker

雇入れ又は退職に関する書類については、労働者の退職又は死亡の日

For documents concerning accident compensation, the day on which the accident compensation was completed

災害補償に関する書類については、災害補償を終わつた日

The end date of the employment contract of a worker for important documents concerning wages or labor relationship

賃金その他労働関係に関する重要な書類については、その完結の日

Notwithstanding the provisions of the preceding paragraph, with respect to the calculation of the period for which a wage ledger or important documents concerning wages and other labor relations are to be preserved, in the case where the due date for payment of the wages pertaining to the record is later than the day listed in item (ii) or item (v) of that paragraph, that due date for payment is to be the day from which the period is counted.

前項の規定にかかわらず、賃金台帳又は賃金その他労働関係に関する重要な書類を保存すべき期間の計算については、当該記録に係る賃金の支払期日が同項第二号又は第五号に掲げる日より遅い場合には、当該支払期日を起算日とする。

The provisions of the preceding paragraph apply mutatis mutandis to the records for each worker concerning the status of the working hours of workers provided in (a) of item (iv) of paragraph (3) of Article 24-2-2, Article 24-2-2-2, (a) of item (iv) of paragraph (3) of Article 24-2-3 and Article 24-2-3-2, the minutes provided in paragraph (2) of Article 24-2-4 (including as applied mutatis mutandis pursuant to Article 34-2-3), the annual paid leave management register, and the records for each covered worker concerning the matters listed in (a) through (f) of item (iv) of paragraph (15) of Article 34-2.

前項の規定は、第二十四条の二の二第三項第四号イ、第二十四条の二の二の二第二十四条の二の三第三項第四号イ及び第二十四条の二の三の二に規定する労働者の労働時間の状況に関する労働者ごとの記録、第二十四条の二の四第二項第三十四条の二の三において準用する場合を含む。)に規定する議事録、年次有給休暇管理簿並びに第三十四条の二第十五項第四号イからヘまでに掲げる事項に関する対象労働者ごとの記録について準用する。

Article 57

第五十七条

In the case where an employer falls under any of the following items, the employer must report the respective facts to the Director of the Labor Standards Office Concerned without delay, according to Form No. 23-2 for item (i), according to Form No. 22 of the Ordinance on Industrial Safety and Health for item (ii), and by the method provided in paragraph (1) of Article 97 of that Ordinance for item (iii).

使用者は、次の各号のいずれかに該当する場合においては、遅滞なく、第一号については様式第二十三号の二により、第二号については労働安全衛生規則様式第二十二号により、第三号については同令第九十七条第一項に規定する方法により、それぞれの事実を所轄労働基準監督署長に報告しなければならない。

When an employer has commenced a business

事業を開始した場合

When a fire or an explosion has arisen in an auxiliary dormitory, or it has been collapsed

事業の附属寄宿舎において火災若しくは爆発又は倒壊の事故が発生した場合

When a worker has died or been absent from work due to an injury, suffocation or acute toxication in an auxiliary dormitory

労働者が事業の附属寄宿舎内で負傷し、窒息し、又は急性中毒にかかり、死亡し又は休業した場合

In the case referred to in item (iii) of the preceding paragraph, if the number of days of absence from work is less than four, the employer must, notwithstanding the provisions of that paragraph, report those facts for the periods from January to March, from April to June, from July to September and from October to December to the Director of the Labor Standards Office Concerned by the method provided in paragraph (2) of Article 97 of the Ordinance on Industrial Safety and Health, by the last day of the month following the last month of each of those periods every year.

前項第三号に掲げる場合において、休業の日数が四日に満たないときは、使用者は、同項の規定にかかわらず、労働安全衛生規則第九十七条第二項に規定する方法により、一月から三月まで、四月から六月まで、七月から九月まで及び十月から十二月までの期間における当該事実を毎年各各の期間における最後の月の翌月末日までに、所轄労働基準監督署長に報告しなければならない。

An employer who accepts a worker's deposit based on an agreement submitted under the provisions of paragraph (2) of Article 18 of the Act shall report on the condition of the savings management for the twelve month period ending on 31 March each year to the Director of the Labor Standards Office Concerned according to Form No. 24.

法第十八条第二項の規定により届け出た協定に基づき労働者の預金の受入れをする使用者は、毎年、三月三十一日以前一年間における預金の管理の状況を、四月三十日までに、様式第二十四号により、所轄労働基準監督署長に報告しなければならない。

Article 58

第五十八条

When an administrative government agency has an employer or worker submit a report on necessary matters or order them to appear to the premises of the agency pursuant to the provisions of paragraph (1) of Article 104-2 of the Act, this agency shall give notice of the following items:

行政官庁は、法第百四条の二第一項の規定により、使用者又は労働者に対し、必要な事項を報告させ、又は出頭を命ずるときは、次の事項を通知するものとする。

Article 59

第五十九条

Applicants shall submit two copies each of written applications for permission, approval, recognition, or designation stipulated by the Act and orders based on the Act.

及びこれに基く命令に定める許可、認可、認定又は指定の申請書は、各々二通これを提出しなければならない。

Article 59-2

第五十九条の二

The forms (except Form No. 24) of an application of permission, approval, recognition, or designation, a notification, a report, a roster of workers, or a wage ledger prescribed by the Act and orders based on the Act show what should be written as a minimum, and shall not preclude the use of vertical or horizontal writing, or any other format.

及びこれに基く命令に定める許可、認可、認定若しくは指定の申請、届出、報告、労働者名簿又は賃金台帳に用いるべき様式(様式第二十四号を除く。)は、必要な事項の最少限度を記載すべきことを定めるものであつて、横書、縦書その他異なる様式を用いることを妨げるものではない。

An employer must state its name on the forms and other necessary documents to be used for applications for permission, approval, recognition or designation, notifications or reports prescribed by the Act and orders based thereon, and submit them to the administrative agency.

使用者は、及びこれに基づく命令に定める許可、認可、認定若しくは指定の申請、届出又は報告に用いるべき様式その他必要な書類に氏名を記載し、行政官庁に提出しなければならない。

With respect to applications for permission, approval, recognition or designation, notifications or reports made by an employer to an administrative agency under the provisions of the Act and orders based thereon (hereinafter referred to as "notifications, etc." in this paragraph and the following Article), in the case where the employer makes those notifications, etc. using the electronic data processing system provided in paragraph (1) of Article 6 of the Act on Promotion of Administration Utilizing Information and Communications Technology (Act No. 151 of 2002; referred to as the "Information and Communications Technology Utilization Act" in the following Article) pursuant to the provisions of that paragraph, the employer may, in lieu of stating its name under the provisions of the preceding paragraph, and besides the measures listed in the items of paragraph (1) of Article 6 of the Ordinance for Enforcement of the Act on Promotion of Administration Utilizing Information and Communications Technology with Regard to Laws and Regulations under the Jurisdiction of the Ministry of Health, Labour and Welfare (Order of the Ministry of Health, Labour and Welfare No. 40 of 2003), record the name of the employer in an electronic or magnetic record.

及びこれに基づく命令の規定により、使用者が行政官庁に対して行う許可、認可、認定若しくは指定の申請、届出又は報告(以下この項及び次条において「届出等」という。)について、当該使用者が、情報通信技術を活用した行政の推進等に関する法律(平成十四年法律第百五十一号。次条において「情報通信技術活用法」という。)第六条第一項の規定により、同項に規定する電子情報処理組織を使用して当該届出等を行う場合には、前項の規定による氏名の記載については、厚生労働省の所管する法令に係る情報通信技術を活用した行政の推進等に関する法律施行規則(平成十五年厚生労働省令第四十号)第六条第一項各号に掲げる措置のほか、当該使用者の氏名を電磁的記録に記録することをもつて代えることができる。

Article 59-3

第五十九条の三

With respect to notifications, etc., in the case where a labor and social security attorney or a labor and social security attorney corporation (hereinafter referred to as a "labor and social security attorney, etc." in this Article) makes the notifications, etc. on behalf of an employer based on the provisions of item (i)-2 of paragraph (1) of Article 2 of the Certified Social Insurance and Labor Consultant Act (Act No. 89 of 1968), using the electronic data processing system provided in paragraph (1) of Article 6 of the Information and Communications Technology Utilization Act pursuant to the provisions of paragraph (1) of Article 57 (limited to the case falling under item (iii) of that paragraph) or paragraph (2) of that Article or paragraph (1) of Article 6 of the Information and Communications Technology Utilization Act, the labor and social security attorney, etc. must transmit, together with those notifications, etc., an electronic or magnetic record capable of certifying that the labor and social security attorney, etc. has concluded a contract to perform the duties of the employer on the employer's behalf.

届出等について、社会保険労務士又は社会保険労務士法人(以下この条において「社会保険労務士等」という。)が、第五十七条第一項同項第三号に該当する場合に限る。)若しくは第二項又は情報通信技術活用法第六条第一項の規定により、同項に規定する電子情報処理組織を使用して社会保険労務士法(昭和四十三年法律第八十九号)第二条第一項第一号の二の規定に基づき当該届出等を使用者に代わつて行う場合には、当該社会保険労務士等が当該使用者の職務を代行する契約を締結していることにつき証明することができる電磁的記録を当該届出等と併せて送信しなければならない。
