Supplementary Provisions, Article 28-2Special Provisions on Periods as a Member of the Former Army Mutual Aid Association, etc.

①For a person whose insured period (limited to a category I EPI insured period; the same applies in paragraph (1) of the following Article and Article 28-4, paragraph (1) of the Supplementary Provisions) is one year or more, if within the period specified by Cabinet Order as a period as a member of the former Army Mutual Aid Association under the former Army Mutual Aid Association Order (Imperial Ordinance No. 947 of 1940) or of another mutual aid Association specified by Cabinet Order (hereinafter referred to as the "period as a member of a former mutual aid Association") there is a period from June 1942 to August 1945, that period is deemed, with respect to insurance benefits paid in relation to the person's old age or death, to be a period during which the person was an insured other than an insured mine worker and a mariner insured under this Act; provided, however, that this does not apply where the provisions of Article 43, paragraph (1), Article 9-2, paragraph (2), item (ii) of the Supplementary Provisions (including where that provision is followed under Article 9-3, paragraphs (1) and (3) of the Supplementary Provisions (including where those provisions are followed under paragraph (5) of that Article) and under Article 9-4, paragraph (1) of the Supplementary Provisions (including where that provision is followed under paragraph (2) of the following Article and Article 28-4, paragraph (2) of the Supplementary Provisions) and paragraph (4) of that Article (including where that provision is followed under Article 9-4, paragraph (6) of the Supplementary Provisions)), and Article 58, paragraph (1) (excluding item (iv)) and Article 60, paragraph (1) are applied.
