Article 101-7Special Cognitive Assessments; Other Measures
If a person 75 years of age or older (but only one who currently holds a license) engages in conduct, in connection with driving a motor vehicle or motorized bicycle, that violates a provision of this Act, a provision of an order under this Act, or a disposition based on a provision of this Act and that Cabinet Order prescribes as conduct readily occurring when cognitive function has declined, a public safety commission is to specially conduct a cognitive assessment for the person, except where the person has undergone a cognitive assessment or equivalent examination pursuant to Article 97-2, paragraph (1), item (iii) or (v), Article 101-4, paragraph (2), or paragraph (3) of this Article on or after the day three months before the day on which the person engaged in that conduct and in any other case that Cabinet Office Order prescribes as one in which the person need not undergo a special cognitive assessment.
When seeking to administer a cognitive assessment pursuant to the preceding paragraph, a public safety commission must notify the person subject to the cognitive assessment in writing that it will administer a cognitive assessment, pursuant to Cabinet Office Order.
A person who has received notice under the preceding paragraph must undergo a cognitive assessment or equivalent examination by the time the period counted from the day following the date on which the person received the notice (for a person who has a compelling reason that Cabinet Order prescribes for not undergoing a cognitive assessment or equivalent examination, the period obtained by excluding from that period the period during which those circumstances exist) comes to exceed one month in total.
If a person who has undergone a cognitive assessment or equivalent examination pursuant to the preceding paragraph falls under the criteria that Cabinet Office Order prescribes as indicating a possibility that a decline in cognitive function will affect the person's driving of a motor vehicle or motorized bicycle, taking into account the results of that cognitive assessment or equivalent examination, the results of the cognitive assessment or equivalent examination that the person underwent most recently before the date on which the person underwent that cognitive assessment or equivalent examination, and other circumstances, a public safety commission is to conduct the training set forth in Article 108-2, paragraph (1), item (xii) for the person.
When seeking to administer training as set forth in Article 108-2, paragraph (1), item (xii) pursuant to the preceding paragraph, a public safety commission must notify the person subject to the training in writing that it will administer that training, pursuant to Cabinet Office Order.
A person notified as under the preceding paragraph must undergo the training set forth in Article 108-2, paragraph (1), item (xii) by the time that it has been a total of one month since the day following the date on which the person is so notified (other than any period during which the person has a compelling circumstance that Cabinet Order prescribes for not undergoing the training).
If a person who has undergone a cognitive assessment or equivalent examination pursuant to Article 97-2, paragraph (1), item (iii) or (v), and whose result falls under the criteria that Cabinet Office Order prescribes as indicating a possibility of dementia (hereinafter referred to in this Article as a "target person"), submits a written license application under Article 89, paragraph (1), the public safety commission is to, except where the person has come to fall under any of the following items on or after the date on which the person underwent that cognitive assessment or equivalent examination, conduct a special fitness screening to determine whether the person is a person falling under Article 90, paragraph (1), item (i)-2, or order the person to submit, by the deadline that the public safety commission specifies, a medical certificate from a physician who satisfies the requirements that Cabinet Office Order prescribes:
the person undergoes a fitness screening under this Article (excluding paragraph (5)) (for a fitness screening under paragraph (4), limited to one done on the ground that there is a suspicion that the person has come to fall under Article 103, paragraph (1), item (i)-2), or submits a medical certificate pursuant to this paragraph through paragraph (4) (for a medical certificate prescribed in paragraph (4), limited to one diagnosing whether the person falls under that item);
the person undergoes a cognitive assessment or equivalent examination and is found to no longer be a target person.
If a person who has undergone a cognitive assessment or equivalent examination pursuant to Article 101-4, paragraph (2) is found to be a target person, the public safety commission is to, except where the person falls under any of the following items, conduct a special fitness screening to determine whether the person has come to fall under Article 103, paragraph (1), item (i)-2, or order the person to submit, by the deadline that the public safety commission specifies, a medical certificate from a physician who satisfies the requirements that Cabinet Office Order prescribes:
the person comes to fall under any of the items of the preceding paragraph on or after the date on which the person underwent that cognitive assessment or equivalent examination; or
it is decided that the person will either undergo a fitness screening under the following paragraph or submit a medical certificate pursuant to that paragraph.
If a person who has undergone a cognitive assessment or equivalent examination pursuant to paragraph (3) of the preceding Article is found to be a target person, the public safety commission is to, except where the person has come to fall under any of the items of paragraph (1) on or after the date on which the person underwent that cognitive assessment or equivalent examination, conduct a special fitness screening to determine whether the person has come to fall under Article 103, paragraph (1), item (i)-2, or order the person to submit, by the deadline that the public safety commission specifies, a medical certificate from a physician who satisfies the requirements that Cabinet Office Order prescribes.
Beyond what is prescribed in the preceding three paragraphs, if there is reason to suspect that a person who has passed a driver's license test is a person falling under Article 90, paragraph (1), items (i) through (ii), or that a person who has obtained a license has come to fall under Article 103, paragraph (1), items (i) through (iii), a public safety commission may, with regard to the person who passed the driver's license test or the person who obtained the license, conduct a special fitness screening or order the person to submit, by the deadline that the public safety commission specifies, a medical certificate from a physician who satisfies the requirements that Cabinet Office Order prescribes. In such a case, the public safety commission is to take into consideration the contents of the questionnaire submitted pursuant to Article 89, paragraph (1), Article 101, paragraph (1), or Article 101-2, paragraph (1), the contents of the report under Article 101-5, and other circumstances.
