第八十三条
With respect to a person who was born on or before April 1, 1926 and to the beneficiary of an old-age pension under the former Employees' Pension Insurance Act for whom the grounds for payment arose before the Effective Date, the provisions of Articles 131 through 133 and Article 135 of the Employees' Pension Insurance Act prior to amendment by the provisions of Article 1 of the 2013 Amendment Act that remain in force pursuant to the provisions of Article 5, paragraph (1) of the Supplementary Provisions of the 2013 Amendment Act do not apply, and the provisions of Articles 131 through 133 and Article 135 of the former Employees' Pension Insurance Act remain in force. In this case, the phrase "any of Article 43, paragraphs (4) through (6)" in Article 131, paragraph (1), item (ii) of the former Employees' Pension Insurance Act is deemed to be replaced with "Article 43, paragraph (4)".
大正十五年四月一日以前に生まれた者及び施行日前に支給事由の生じた旧厚生年金保険法による老齢年金の受給権者については、平成二十五年改正法附則第五条第一項の規定によりなおその効力を有するものとされた平成二十五年改正法第一条の規定による改正前の厚生年金保険法第百三十一条から第百三十三条まで及び第百三十五条の規定を適用せず、旧厚生年金保険法第百三十一条から第百三十三条まで及び第百三十五条の規定は、なおその効力を有する。この場合において、旧厚生年金保険法第百三十一条第一項第二号中「第四十三条第四項から第六項までのいずれか」とあるのは、「第四十三条第四項」と読み替えるものとする。
With regard to an old-age pension benefit that a Fund pays for which the grounds for payment arose before the Effective Date (including that paid to a person prescribed in the preceding paragraph), the provisions then in force continue to govern, except in the case of applying the provisions of the preceding paragraph, the following Article and Article 84 of the Supplementary Provisions.
With regard to an old-age pension benefit that a Fund pays to a person prescribed in paragraph (1) who has made a request under Article 44-3, paragraph (1) of the Employees' Pension Insurance Act, in Article 132, paragraph (2) of the former Employees' Pension Insurance Act, which remains in force pursuant to the provisions of paragraph (1), the phrase "the amount prescribed" is deemed to be replaced with "the amount prescribed plus an amount specified by Cabinet Order".
第一項に規定する者であつて、厚生年金保険法第四十四条の三第一項の規定による申出をしたものに基金が支給する老齢年金給付については、第一項の規定によりなおその効力を有するものとされた旧厚生年金保険法第百三十二条第二項中「規定する額」とあるのは、「規定する額に政令で定める額を加算した額」とする。
