Article 75-19Measures before Engaging in Specified Automated Operation
第七十五条の十九（特定自動運行を行う前の措置）
A specified automated operation provider must provide education, pursuant to Cabinet Office Order, to the specified automated operation supervisor designated under the following paragraph, the person in charge of on-site measures designated under paragraph (3), and other persons used for specified automated operation (hereinafter referred to as "specified automated operation workers"), so that they will smoothly and reliably implement the measures that specified automated operation workers must implement under the provisions of this Act, the provisions of orders under this Act, and dispositions under the provisions of this Act, including the measures under Article 75-21, Article 75-22, and Article 75-23, paragraphs (1) through (3).
When engaging in specified automated operation, a specified automated operation provider must designate a specified automated operation supervisor from among persons who satisfy the requirements that Cabinet Office Order prescribes regarding the aptitude necessary for taking the measures, so as to have that supervisor take the measures that the specified automated operation supervisor must implement under the provisions of this Act, the provisions of orders under this Act, and dispositions under the provisions of this Act, including the measures under Article 75-21, Article 75-22, and Article 75-23, paragraphs (1) and (3).
When a specified automated operation provider engages in specified automated operation having taken the measures prescribed in paragraph (1), item (i) of the following Article, the provider must designate a person in charge of on-site measures, so as to have that person take the measures under Article 75-23, paragraphs (1) and (2).
特定自動運行実施者は、次条第一項第一号に規定する措置を講じて特定自動運行を行うときは、第七十五条の二十三第一項及び第二項の規定による措置を講じさせるため、現場措置業務実施者を指定しなければならない。
Article 75-20Rules to Be Observed During Specified Automated Operation
第七十五条の二十（特定自動運行中の遵守事項）
A specified automated operation provider must take one of the measures set forth in the following items with respect to a motor vehicle for specified automated operation that is engaged in specified automated operation:
特定自動運行実施者は、特定自動運行中の特定自動運行用自動車について、次の各号のいずれかの措置を講じなければならない。
the measure of installing, at the place prescribed in Article 75-12, paragraph (2), item (ii), (c), a device prescribed by Cabinet Office Order that enables confirmation, by video and audio, of the conditions of the road and traffic around the motor vehicle for specified automated operation and of the condition of that motor vehicle for specified automated operation, and of assigning a specified automated operation supervisor to that place;
当該特定自動運行用自動車の周囲の道路及び交通の状況並びに当該特定自動運行用自動車の状況を映像及び音声により確認することができる装置で内閣府令で定めるものを第七十五条の十二第二項第二号ハに規定する場所に備え付け、かつ、当該場所に特定自動運行主任者を配置する措置
the measure of having a specified automated operation supervisor ride in the motor vehicle for specified automated operation in order to have the supervisor take the measures under Article 75-23, paragraph (3) and other measures.
第七十五条の二十三第三項の規定による措置その他の措置を講じさせるため、特定自動運行主任者を当該特定自動運行用自動車に乗車させる措置
A specified automated operation provider that is carrying out specified automated operation must, as prescribed by Cabinet Office Order, display in a conspicuous place on the motor vehicle for specified automated operation a notice that specified automated operation is in progress.
特定自動運行実施者は、特定自動運行を行つているときは、内閣府令で定めるところにより、当該特定自動運行用自動車の見やすい箇所に特定自動運行中である旨を表示しなければならない。
Article 75-21Obligations of Specified Automated Operation Supervisors
第七十五条の二十一（特定自動運行主任者の義務）
A specified automated operation supervisor assigned pursuant to paragraph (1), item (i) of the preceding Article must monitor the operating status of the device prescribed in that item while the motor vehicle for specified automated operation is engaged in specified automated operation. In this case, if the specified automated operation supervisor finds that the device is not operating normally, the specified automated operation supervisor must immediately take measures to end that specified automated operation.
前条第一項第一号の規定により配置された特定自動運行主任者は、当該特定自動運行用自動車が特定自動運行を行つているときは、同号に規定する装置の作動状態を監視していなければならない。この場合において、当該装置が正常に作動していないことを認めたときは、当該特定自動運行主任者は、直ちに、当該特定自動運行を終了させるための措置を講じなければならない。
When specified automated operation has ended on a road, a specified automated operation supervisor must immediately confirm whether there are grounds for taking measures that the specified automated operation supervisor is required to carry out under the provisions of this Act, orders based on this Act, and dispositions made under the provisions of this Act, including measures under the following Article or Article 75-23, paragraph (1) or (3).
特定自動運行主任者は、道路において特定自動運行が終了したときは、直ちに、次条又は第七十五条の二十三第一項若しくは第三項の規定による措置その他のこの法律及びこの法律に基づく命令の規定並びにこの法律の規定に基づく処分により特定自動運行主任者が実施しなければならない措置を講ずべき事由の有無を確認しなければならない。
Article 75-22Measures When Specified Automated Operation Has Ended
第七十五条の二十二（特定自動運行が終了した場合の措置）
When specified automated operation has ended, if any of the measures or orders set forth in the following items has been taken or given in relation to the motor vehicle for specified automated operation or the specified automated operation supervisor, the specified automated operation supervisor must immediately take the measures necessary to have the motor vehicle for specified automated operation proceed in accordance with that measure or order:
特定自動運行主任者は、特定自動運行が終了した場合において、当該特定自動運行用自動車又は当該特定自動運行主任者に対し次の各号のいずれかの措置又は命令が行われているときは、直ちに、当該特定自動運行用自動車を当該措置又は命令に従つて通行させるため必要な措置を講じなければならない。
instructions given at the scene by a police officer as prescribed in the second sentence of Article 4, paragraph (1);
第四条第一項後段に規定する警察官の現場における指示
traffic control by an officer under Article 6, paragraph (1);
a prohibition, restriction or order by a police officer under Article 6, paragraph (2) as applied with terms replaced pursuant to Article 75-24;
an instruction by a police officer under Article 6, paragraph (3) as applied with terms replaced pursuant to Article 75-24;
a prohibition or restriction by a police officer under Article 6, paragraph (4);
第六条第四項の規定による警察官の禁止又は制限
a prohibition, restriction or order by a police officer under Article 75-3 as applied with terms replaced pursuant to Article 75-24.
When specified automated operation has ended, if an emergency motor vehicle or fire-services vehicle is approaching the motor vehicle for specified automated operation or is in the vicinity of it, the specified automated operation supervisor must immediately take the measures necessary to prevent the motor vehicle for specified automated operation from keeping that emergency motor vehicle or fire-services vehicle from proceeding.
特定自動運行主任者は、特定自動運行が終了した場合において、当該特定自動運行用自動車に緊急自動車若しくは消防用車両が接近し、又は当該特定自動運行用自動車の付近に緊急自動車若しくは消防用車両があるときは、直ちに、当該特定自動運行用自動車が当該緊急自動車又は消防用車両の通行を妨げないようにするため必要な措置を講じなければならない。
When specified automated operation has ended, if the motor vehicle for specified automated operation is found to have been parked illegally, the specified automated operation supervisor must immediately take the measures necessary to change the manner of parking the motor vehicle for specified automated operation or to move it from that place.
特定自動運行主任者は、特定自動運行が終了した場合において、当該特定自動運行用自動車が違法駐車と認められる場合は、直ちに、当該特定自動運行用自動車の駐車の方法を変更し、又は当該特定自動運行用自動車を当該場所から移動するため必要な措置を講じなければならない。
Article 75-23Measures in Case of a Traffic Accident in Specified Automated Operation
第七十五条の二十三（特定自動運行において交通事故があつた場合の措置）
When, in specified automated operation (including the case where specified automated operation has ended on a road; the same applies in paragraphs (3) and (6) and Article 117, paragraph (3)), there is a traffic accident involving a motor vehicle for specified automated operation (limited to one for which the measure prescribed in Article 75-20, paragraph (1), item (i) has been taken), the specified automated operation supervisor assigned pursuant to that item must take the measures of immediately notifying the fire-services organization nearest to the scene of the traffic accident and of sending a person in charge of on-site measures to the scene of the traffic accident (or, where it is clear that no person has been killed or injured in the traffic accident, the measure of sending a person in charge of on-site measures to the scene of the traffic accident). In this case, the specified automated operation supervisor of the motor vehicle for specified automated operation must immediately report the particulars of the traffic accident to a police officer at the police station nearest to the scene of the traffic accident (including a police box or residential police box; the same applies in paragraphs (3) and (4)).
特定自動運行（道路において当該特定自動運行が終了した場合を含む。第三項及び第六項並びに第百十七条第三項において同じ。）において特定自動運行用自動車（第七十五条の二十第一項第一号に規定する措置が講じられたものに限る。）に係る交通事故があつたときは、同号の規定により配置された特定自動運行主任者は、直ちに当該交通事故の現場の最寄りの消防機関に通報する措置及び現場措置業務実施者を当該交通事故の現場に向かわせる措置（当該交通事故による人の死傷がないことが明らかな場合にあつては、現場措置業務実施者を当該交通事故の現場に向かわせる措置）を講じなければならない。この場合において、当該特定自動運行用自動車の特定自動運行主任者は、直ちに当該交通事故の現場の最寄りの警察署（派出所又は駐在所を含む。第三項及び第四項において同じ。）の警察官に交通事故発生日時等を報告しなければならない。
A person in charge of on-site measures who has arrived at the scene of the traffic accident prescribed in the preceding paragraph must take the measures necessary to prevent road hazards at the scene of that traffic accident.
When, in specified automated operation, there is a traffic accident involving a motor vehicle for specified automated operation (limited to one for which the measure prescribed in Article 75-20, paragraph (1), item (ii) has been taken), the specified automated operation supervisor or other staff member who was made to ride in the motor vehicle for specified automated operation involved in the traffic accident pursuant to that item (referred to in paragraph (5) as the "specified automated operation supervisor or other staff member") must immediately aid injured persons, prevent road hazards, and otherwise take the necessary measures. In this case, the specified automated operation supervisor of the motor vehicle for specified automated operation (or, where it is unavoidable because the specified automated operation supervisor has died or been injured, another staff member; the same applies in the following paragraph) must report the particulars of the traffic accident to a police officer if one is at the scene, or, if no police officer is at the scene, immediately to a police officer at the nearest police station.
特定自動運行において特定自動運行用自動車（第七十五条の二十第一項第二号に規定する措置が講じられたものに限る。）に係る交通事故があつたときは、当該交通事故に係る特定自動運行用自動車に同号の規定により乗車させられた特定自動運行主任者その他の乗務員（第五項において「特定自動運行主任者等」という。）は、直ちに、負傷者を救護し、道路における危険を防止する等必要な措置を講じなければならない。この場合において、当該特定自動運行用自動車の特定自動運行主任者（特定自動運行主任者が死亡し、又は負傷したためやむを得ないときは、その他の乗務員。次項において同じ。）は、警察官が現場にいるときは当該警察官に、警察官が現場にいないときは直ちに最寄りの警察署の警察官に交通事故発生日時等を報告しなければならない。
On finding it to be necessary to do so in order to aid an injured person or prevent a road hazard, a police officer at the nearest police station who receives a report pursuant to the second sentence of the preceding paragraph may order the specified automated operation supervisor giving the report not to leave the scene until a police officer arrives.
In a case as referred to in the preceding three paragraphs, a police officer at the scene of the traffic accident may give a person in charge of on-site measures or a specified automated operation supervisor or other staff member at the scene of the traffic accident the instructions necessary to aid injured persons, prevent road hazards, or otherwise ensure the safety and fluidity of traffic.
前三項の場合において、当該交通事故の現場にある警察官は、当該交通事故の現場にある現場措置業務実施者又は特定自動運行主任者等に対し、負傷者を救護し、又は道路における危険を防止し、その他交通の安全と円滑を図るため必要な指示をすることができる。
The provisions of Article 72-2 and Article 73 apply mutatis mutandis to the case where there is a traffic accident in specified automated operation. In this case, in Article 72-2, paragraph (1), the phrase "paragraph (3) of the preceding Article" is deemed to be replaced with "Article 75-23, paragraph (5)", the phrase "the driver or staff member of" with "the person in charge of on-site measures (meaning a person in charge of on-site measures prescribed in Article 75-19, paragraph (3); the same applies hereinafter) or the specified automated operation supervisor or other staff member (meaning a specified automated operation supervisor or other staff member prescribed in Article 75-23, paragraph (3); the same applies hereinafter) for", the phrase "that paragraph" with "paragraph (5) of that Article", and the phrase "the scene" with "the scene of the traffic accident"; and in Article 73, the phrase "other than the driver or staff member" is deemed to be replaced with "other than the specified automated operation supervisor or other staff member", the phrase "the driver's or staff member's taking the measures prescribed in the first sentence of Article 72, paragraph (1)" with "the taking, by the person in charge of on-site measures for the vehicle or streetcar, of the measures prescribed in Article 75-23, paragraph (2), or the taking, by the specified automated operation supervisor or other staff member, of the measures prescribed in the first sentence of paragraph (3) of that Article", and "又は" (or) with "若しくは" (or, joining a smaller group of alternatives).
第七十二条の二及び第七十三条の規定は、特定自動運行において交通事故があつた場合について準用する。この場合において、第七十二条の二第一項中「前条第三項」とあるのは「第七十五条の二十三第五項」と、「の運転者等」とあるのは「に係る現場措置業務実施者（第七十五条の十九第三項に規定する現場措置業務実施者をいう。以下同じ。）又は特定自動運行主任者等（第七十五条の二十三第三項に規定する特定自動運行主任者等をいう。以下同じ。）」と、「同項」とあるのは「同条第五項」と、「現場」とあるのは「当該交通事故の現場」と、第七十三条中「運転者等以外」とあるのは「特定自動運行主任者等以外」と、「の運転者等が第七十二条第一項前段」とあるのは「に係る現場措置業務実施者が第七十五条の二十三第二項に規定する措置を講じ、又は特定自動運行主任者等が同条第三項前段」と、「又は」とあるのは「若しくは」と読み替えるものとする。
