Supplementary Provisions, Article 7Transitional Measures Concerning Compensation of Expenses for the Procedure for a Request for Retrial
第七条（再審請求手続に関する費用補償に関する経過措置）
The provisions of Article 188-2, paragraphs (2) and (3) of the Code of Criminal Procedure as amended by the provisions of Article 2 (limited to the amending provisions set forth in Article 1, item (iii) of the Supplementary Provisions) also apply to expenses that were required for the procedure for a request for retrial pertaining to a ruling to commence a retrial and that arose before the day on which the provisions set forth in that item come into effect, in the case where an acquittal becomes final and binding on or after that day in a case in which the ruling to commence a retrial has become final and binding.
第二条の規定（附則第一条第三号に掲げる改正規定に限る。）による改正後の刑事訴訟法第百八十八条の二第二項及び第三項の規定は、再審開始の決定が確定した事件について同号に掲げる規定の施行の日以後に無罪の判決が確定した場合における当該再審開始の決定に係る再審の請求の手続に要した費用であって同日前に生じたものについても適用する。
