第三条（経過措置）
The provisions of Article 316-5, item (xi), Article 316-11 (limited to the part pertaining to Article 316-5, item (xi)) and Part II, Chapter III, Section 3 of the Code of Criminal Procedure as amended by the provisions of Article 1 do not apply to criminal cases pending at the time of the enforcement of this Act. The same applies to criminal cases in which the judgment became final before the date of enforcement of this Act and in which a ruling to commence retrial becomes final on or after that date.
第一条の規定による改正後の刑事訴訟法第三百十六条の五第十一号、第三百十六条の十一（第三百十六条の五第十一号に係る部分に限る。）及び第二編第三章第三節の規定は、この法律の施行の際現に係属している刑事被告事件については、適用しない。この法律の施行の日前判決が確定した刑事被告事件であってこの法律の施行の日以後再審開始の決定が確定したものについても、同様とする。
