Supplementary Provisions, Article 2Transitional Measures Concerning the Requirements for Designation, etc. of Medical Institutions Providing Services Covered by Health Insurance, etc.

①The provisions of Article 65, paragraph (3), items (iii) and (iv), Article 71, paragraph (2), items (ii) and (iii), Article 80, items (viii) and (ix), Article 81, items (v) and (vi), Article 89, paragraph (4), items (v) and (vi), and Article 95, items (viii) and (ix) of the Health Insurance Act (Act No. 70 of 1922) do not apply with regard to the sentence concerned of a person who has been sentenced for an act committed before the day of enforcement of this Cabinet Order (hereinafter referred to as the "Effective Date") and has thereby come to fall under those provisions.

②The provisions of Article 80, item (x), Article 81, item (vii) and Article 95, item (x) of the Health Insurance Act do not apply with regard to the violation concerned of a person who has come to fall under those provisions due to a violation committed before the Effective Date.

③The provisions of Article 89, paragraph (4), item (iv) of the Health Insurance Act do not apply with regard to the rescission concerned of a person whose designation under Article 88, paragraph (1) of that Act relating to a designated home-nursing provider is rescinded before the Effective Date or on or after the Effective Date by reason of having fallen under any of the items of Article 95 of that Act before the Effective Date.
