Supplementary Provisions, Article 1Effective Date
第一条（施行期日）
This Cabinet Order comes into effect on January 1, 2010; provided, however, that the provisions amending Article 27-2, paragraph (1) of the Order for Enforcement of the National Health Insurance Act in Article 1 (limited to the part adding ", Article 35-2, paragraph (1)" after "), Article 33-4, paragraph (1) or (2), Article 34, paragraph (1), Article 34-2, paragraph (1), Article 34-3, paragraph (1), Article 35, paragraph (1)"), the provisions amending Article 42, paragraph (3), item (iv) of the Order for Enforcement of the Health Insurance Act in Article 2 (limited to the part adding ", Article 35-2, paragraph (1)" after "), Article 33-4, paragraph (1) or (2), Article 34, paragraph (1), Article 34-2, paragraph (1), Article 34-3, paragraph (1), Article 35, paragraph (1)"), and the provisions amending Article 7, paragraph (1) of the Order for Enforcement of the Act on Assurance of Medical Care for Elderly People in Article 3 (limited to the part adding ", Article 35-2, paragraph (1)" after "), Article 33-4, paragraph (1) or (2), Article 34, paragraph (1), Article 34-2, paragraph (1), Article 34-3, paragraph (1), Article 35, paragraph (1)") come into effect on April 1 of the same year.
この政令は、平成二十二年一月一日から施行する。ただし、第一条中国民健康保険法施行令第二十七条の二第一項の改正規定（「）第三十三条の四第一項若しくは第二項、第三十四条第一項、第三十四条の二第一項、第三十四条の三第一項、第三十五条第一項」の下に「、第三十五条の二第一項」を加える部分に限る。）、第二条中健康保険法施行令第四十二条第三項第四号の改正規定（「）第三十三条の四第一項若しくは第二項、第三十四条第一項、第三十四条の二第一項、第三十四条の三第一項、第三十五条第一項」の下に「、第三十五条の二第一項」を加える部分に限る。）及び第三条中高齢者の医療の確保に関する法律施行令第七条第一項の改正規定（「）第三十三条の四第一項若しくは第二項、第三十四条第一項、第三十四条の二第一項、第三十四条の三第一項、第三十五条第一項」の下に「、第三十五条の二第一項」を加える部分に限る。）は、同年四月一日から施行する。
Supplementary Provisions, Article 3Transitional Measures Accompanying the Partial Amendment of the Order for Enforcement of the Health Insurance Act
第三条（健康保険法施行令の一部改正に伴う経過措置）
The provisions of Article 42, paragraph (3), item (iv) of the Order for Enforcement of the Health Insurance Act as amended by the provisions of Article 2 (including as applied mutatis mutandis pursuant to Article 44, paragraph (1) of that Order) apply to the base amount for calculating high-cost medical expenses where the month in which the medical treatment was received is on or after August 2010, and to the base amount for the combined long-term care calculation for persons aged 70 or over where the month that includes the reference date prescribed in Article 43-2, paragraph (1), item (i) of that Order (including as applied mutatis mutandis pursuant to Article 44, paragraph (2) of that Order) (including the day deemed to be the reference date pursuant to Article 43-4, paragraph (1) or Article 44, paragraph (4) of that Order; hereinafter referred to as the "reference date" in this Article) is on or after that month, and with regard to the base amount for calculating high-cost medical expenses where the month in which the medical treatment was received is on or before July of that year, and the base amount for the combined long-term care calculation for persons aged 70 or over where the month that includes the reference date is on or before that month, the provisions then in force continue to govern.
第二条の規定による改正後の健康保険法施行令第四十二条第三項第四号（同令第四十四条第一項において準用する場合を含む。）の規定は、療養のあった月が平成二十二年八月以後の場合における高額療養費算定基準額及び健康保険法施行令第四十三条の二第一項第一号（同令第四十四条第二項において準用する場合を含む。）に規定する基準日（同令第四十三条の四第一項又は第四十四条第四項の規定により基準日とみなされる日を含む。以下この条において「基準日」という。）の属する月が同月以後の場合における七十歳以上介護合算算定基準額について適用し、療養のあった月が同年七月までの場合における高額療養費算定基準額及び基準日の属する月が同月までの場合における七十歳以上介護合算算定基準額については、なお従前の例による。
