Supplementary Provisions, Article 2Transitional Measures Accompanying the Partial Amendment of the Order for Enforcement of the Health Insurance Act

The provisions of Article 42, paragraph (3) of the Order for Enforcement of the Health Insurance Act as amended by the provisions of Article 1 (limited to the part relating to item (vi) of that paragraph, and including as applied mutatis mutandis pursuant to Article 44, paragraph (1) of the Order for Enforcement of the Health Insurance Act) apply to the base amount for calculating high-cost medical expenses under Article 41, paragraphs (3) through (5) and (7) of the Order for Enforcement of the Health Insurance Act (including as applied mutatis mutandis pursuant to Article 44, paragraph (1) of that Order) where the month in which the medical treatment was received is on or after August 2021, and to the base amount for the combined long-term care calculation for persons aged 70 or over under Article 43-2, paragraph (2) of that Order (including as applied mutatis mutandis pursuant to Article 44, paragraph (5) of that Order) (including the base amount for the combined long-term care calculation for persons aged 70 or over under Article 43-2, paragraph (2) of that Order as applied mutatis mutandis in Article 43-2, paragraph (3) of that Order, to which the provisions of Article 43-3, paragraph (2) of that Order are applied mutatis mutandis pursuant to Article 43-3, paragraph (3) of that Order (including as applied mutatis mutandis pursuant to Article 44, paragraph (5) of that Order), and the base amount for the combined long-term care calculation for persons aged 70 or over under Article 43-2, paragraph (2) of that Order as applied mutatis mutandis in Article 43-2, paragraph (4) of that Order, to which the provisions of Article 43-3, paragraph (2) of that Order are applied mutatis mutandis pursuant to Article 43-3, paragraph (4) of that Order) where the month that includes the reference date prescribed in Article 41-2, paragraph (1) of that Order (including as applied mutatis mutandis pursuant to Article 44, paragraph (2) of that Order) (including the day deemed to be the reference date pursuant to Article 43-4, paragraph (1) or Article 44, paragraph (7) of that Order; hereinafter referred to as the "reference date" in this Article) is on or after August 2021, and with regard to that base amount for calculating high-cost medical expenses where the month in which the medical treatment was received is on or before July of that year, and that base amount for the combined long-term care calculation for persons aged 70 or over where the month that includes the reference date is on or before that month, the provisions then in force continue to govern.
