第八十六条（改正前厚生年金保険法による給付）
The provisions of Article 44-2, Article 46, paragraph (5), and Article 60, paragraph (3) of the pre-amendment Employees' Pension Insurance Act remain in force with regard to the calculation of the amount of, and the suspension of payment of, pension insurance benefits under the Employees' Pension Insurance Act that are paid to a person all or part of whose period of having been an insured covered by employees' pension insurance is a period of having been a member of an employees' pension Fund. In this case, the words set forth in the middle column of the following table in the provisions of the pre-amendment Employees' Pension Insurance Act set forth in the left-hand column of the table are deemed to be replaced with the words set forth in the right-hand column, respectively, and Cabinet Order provides for any other necessary replacement of terms and other necessary matters in connection with the application of the provisions of the pre-amendment Employees' Pension Insurance Act that remain in force pursuant to the provisions of this paragraph.

厚生年金保険の被保険者であった期間の全部又は一部が厚生年金基金の加入員であった期間である者に支給する厚生年金保険法による年金たる保険給付の額の計算及びその支給の停止については、改正前厚生年金保険法第四十四条の二、第四十六条第五項及び第六十条第三項の規定は、なおその効力を有する。この場合において、次の表の上欄に掲げる改正前厚生年金保険法の規定中同表の中欄に掲げる字句は、それぞれ同表の下欄に掲げる字句に読み替えるものとするほか、この項の規定によりなおその効力を有するものとされた改正前厚生年金保険法の規定の適用に関し必要な読替えその他必要な事項は、政令で定める。

The provisions of Article 44-2, paragraph (1) of the pre-amendment Employees' Pension Insurance Act that remain in force pursuant to the provisions of the preceding paragraph do not apply to the period of having been a member of a surviving employees' pension Fund in the case where the surviving employees' pension Fund is dissolved before a person all or part of whose period of having been an insured covered by employees' pension insurance is a period of having been a member of an employees' pension Fund acquires the right to receive an employees' old-age pension (excluding the period of having been a member that constitutes the basis for calculating the amount of a benefit in the form of a pension for which the surviving Pension Fund Association or another surviving employees' pension Fund has succeeded to the obligation to pay).
In the case prescribed in the preceding paragraph, where a member or former member of the surviving employees' pension Fund is a beneficiary of an employees' old-age pension, notwithstanding the provisions of Article 44-2, paragraph (1) of the pre-amendment Employees' Pension Insurance Act that remain in force pursuant to the provisions of paragraph (1), the amount of that employees' old-age pension is to be the amount calculated by following the example of the provisions of Article 44-2, paragraph (1) of that Act on the assumption that the period of having been a member of the surviving employees' pension Fund (excluding the period of having been a member that constitutes the basis for calculating the amount of a benefit in the form of a pension for which the surviving Pension Fund Association or another surviving employees' pension Fund has succeeded to the obligation to pay) is not a period of having been a member of an employees' pension Fund, and the amount of that employees' old-age pension is to be revised from the month following the month in which the surviving employees' pension Fund was dissolved.
