第三条
A work that has been recorded on a recording medium as of the effective date of this Act pursuant to the provisions of Article 31, paragraph (2) of the Copyright Act prior to its amendment by this Act and that is associated with a rare or out-of-print material (meaning a "rare or out-of-print material" as prescribed in Article 31, paragraph (1), item (3) of the new Act) may be transmitted via automatic public transmission (this includes making a work available for transmission) using a copy of that work, pursuant to the provisions of Article 31, paragraph (3) of the new Act.
この法律の施行の際現にこの法律による改正前の著作権法第三十一条第二項の規定により記録媒体に記録されている著作物であって、絶版等資料（新法第三十一条第一項第三号に規定する「絶版等資料」をいう。）に係るものについては、新法第三十一条第三項の規定により当該著作物の複製物を用いて自動公衆送信（送信可能化を含む。）を行うことができる。

国立国会図書館は、絶版等資料に係る著作物について、図書館等又はこれに類する外国の施設で政令で定めるものにおいて公衆に提示することを目的とする場合には、前項の規定により記録媒体に記録された当該著作物の複製物を用いて自動公衆送信を行うことができる。

「著作物」
A creative expression of thoughts or feelings falling within the literary, academic, artistic or musical domain — a work in the narrow sense, as distinct from 著作物等 (works, performances, phonograms, broadcasts and cablecasts), which the Ministry's English also calls 'work'.

「自動公衆送信」
A transmission to the public (公衆送信) made automatically in response to requests from the public, other than broadcasting or cablecasting.

「送信可能化」
Making something capable of being sent by automatic public transmission (自動公衆送信), either by recording or inputting information into an automatic public transmission server connected to a telecommunications network used by the public (or adding or converting a recording medium to serve as that server's), or by connecting to such a network a server that already holds or receives the information.
