Article 8Protected Phonograms

第八条（保護を受けるレコード）

Only a phonogram that falls under one of the following items is protected under this Act:

レコードは、次の各号のいずれかに該当するものに限り、この法律による保護を受ける。

a phonogram whose producer is a Japanese national;

日本国民をレコード製作者とするレコード

a phonogram in which sounds are first fixed in Japan;

レコードでこれに固定されている音が最初に国内において固定されたもの

any of the following phonograms, other than one also set forth in either of the preceding two items:

前二号に掲げるもののほか、次のいずれかに掲げるレコード

a phonogram whose producer is the national of a contracting state of the Convention for the Protection of Performers, etc. (the nationals of a contracting state include corporations established based on the laws and regulations of that state and corporations that have principal offices in that state; the same applies hereinafter);

実演家等保護条約の締約国の国民（当該締約国の法令に基づいて設立された法人及び当該締約国に主たる事務所を有する法人を含む。以下同じ。）をレコード製作者とするレコード

a phonogram in which sounds are first fixed in a contracting state of the Convention for the Protection of Performers, etc.;

レコードでこれに固定されている音が最初に実演家等保護条約の締約国において固定されたもの

any of the following phonograms, other than one also set forth in the preceding three items:

前三号に掲げるもののほか、次のいずれかに掲げるレコード

a phonogram whose producer is the national of a contracting party to the WPPT (the nationals of a contracting party include corporations established based on the laws and regulations of that party and corporations that have principal offices in that party; the same applies hereinafter);

実演・レコード条約の締約国の国民（当該締約国の法令に基づいて設立された法人及び当該締約国に主たる事務所を有する法人を含む。以下同じ。）をレコード製作者とするレコード

a phonogram in which sounds are first fixed in a contracting party to the WPPT;

レコードでこれに固定されている音が最初に実演・レコード条約の締約国において固定されたもの

any of the following phonograms, other than one also set forth in the preceding items:

前各号に掲げるもののほか、次のいずれかに掲げるレコード

a phonogram whose producer is the national of a World Trade Organization member state (the nationals of a member state include corporations established based on the laws and regulations of that state and corporations that have principal offices in that state; the same applies hereinafter);

世界貿易機関の加盟国の国民（当該加盟国の法令に基づいて設立された法人及び当該加盟国に主たる事務所を有する法人を含む。以下同じ。）をレコード製作者とするレコード

a phonogram in which sounds are first fixed in a World Trade Organization member state;

レコードでこれに固定されている音が最初に世界貿易機関の加盟国において固定されたもの

a phonogram, other than one set forth in the preceding items, that Japan is under the obligation to protect pursuant to the Convention for the Protection of Producers of Phonograms Against Unauthorized Duplication of Their Phonograms (referred to as "the Convention for the Protection of Phonograms" in Article 121-2, item (ii)).

前各号に掲げるもののほか、許諾を得ないレコードの複製からのレコード製作者の保護に関する条約（第百二十一条の二第二号において「レコード保護条約」という。）により我が国が保護の義務を負うレコード
