Section 4 Job Applicant Benefits for Specially Insured Persons in Short-Term Employment

①The confirmation under Article 38, paragraph (2) of the Act is to be made by the Chief of the Public Employment Security Office, with regard to a person who falls under any of the items of paragraph (1) of that Article, when the Chief makes the confirmation that the person has become an insured person, or when the Chief comes to know, through a notification by an insured person or an investigation conducted ex officio, that the insured person is a person listed in those items.

②The provisions of Article 9 apply mutatis mutandis to the confirmation under the preceding paragraph.

The reasons specified by Order of the Ministry of Health, Labour and Welfare under Article 39, paragraph (1) of the Act are the reasons listed in the items of Article 18.

①When the Chief of the competent Public Employment Security Office finds that a person who has submitted a separation slip pursuant to Article 19, paragraph (1) as applied mutatis mutandis in the following Article is a specially qualified recipient, the Chief must determine the day on which that person is to receive the certification of unemployment under Article 40, paragraph (3) of the Act (hereinafter in this Article referred to as the "day of recognition of unemployment") and the day on which the special lump sum payment is to be paid (hereinafter in this Article referred to as the "payment day"), notify that person thereof, and enter the necessary matters in, and issue, the specially qualified recipient's certificate (in the case of a person who has made the submission under Article 19, paragraph (1) as applied mutatis mutandis in the following Article by presenting an Individual Number Card and who wishes to be issued an employment insurance special recipient qualification notice (meaning a notice stating the person's name, insured person number, sex, date of birth, reason for separation from service, daily basic allowance amount, prescribed duration of benefits, processing status of benefits and other matters specified by the Director-General of the Employment Security Bureau; hereinafter referred to as the "special recipient qualification notice"), the special recipient qualification notice).

②If the Chief of the competent Public Employment Security Office finds it necessary, the Chief may change the day of recognition of unemployment and the payment day.

③When the Chief of the competent Public Employment Security Office has changed the day of recognition of unemployment and the payment day pursuant to the provisions of the preceding paragraph, the Chief must notify the specially qualified recipient concerned to that effect.

The provisions of Article 19, paragraphs (1) and (4), Article 20, Article 22, Articles 44 through 47, Article 49, Article 50 and Article 54 apply mutatis mutandis to the payment of the special lump sum payment. In this case, in those provisions, the phrase "Article 13, paragraph (1)" is deemed to be replaced with "Article 39, paragraph (1)"; the phrase "qualified recipient's certificate" is deemed to be replaced with "specially qualified recipient's certificate"; the phrases "based on that recipient qualification" and "recipient qualification pertaining to" are deemed to be replaced with "based on that special recipient qualification" and "special recipient qualification pertaining to", respectively; the phrases "that qualified recipient" and "the qualified recipient has been issued" are deemed to be replaced with "that specially qualified recipient" and "the specially qualified recipient has been issued", respectively; the phrase "notice of recipient qualification" is deemed to be replaced with "special recipient qualification notice prescribed in Article 68, paragraph (1)"; the phrase "day of recognition of unemployment" is deemed to be replaced with "day of the certification of unemployment under Article 40, paragraph (3) of the Act"; the phrases "receive recognition of unemployment", "made recognition of unemployment", "conducted recognition of unemployment" and "that recognition of unemployment" are deemed to be replaced with "receive the certification of unemployment under Article 40, paragraph (3) of the Act", "made the certification of unemployment under Article 40, paragraph (3) of the Act", "conducted the certification of unemployment under Article 40, paragraph (3) of the Act" and "that certification of unemployment under Article 40, paragraph (3) of the Act", respectively; the phrase "written declaration for recognition of unemployment (Form No. 14)" is deemed to be replaced with "specially qualified recipient's written declaration for recognition of unemployment (Form No. 24)"; the phrases "for a qualified recipient" and "to a qualified recipient" are deemed to be replaced with "for a specially qualified recipient" and "to a specially qualified recipient", respectively; the phrases "of the qualified recipient" and "of a qualified recipient" are deemed to be replaced with "of the specially qualified recipient" and "of a specially qualified recipient", respectively; the phrases "a qualified recipient (" and "A qualified recipient who receives payment of the basic allowance by the method" are deemed to be replaced with "a specially qualified recipient (" and "A specially qualified recipient who receives payment of the basic allowance by the method", respectively; the phrase "qualified recipient paid by bank transfer" is deemed to be replaced with "specially qualified recipient paid by bank transfer"; the phrase "Article 31, paragraph (1) of the Act" is deemed to be replaced with "Article 31, paragraph (1) of the Act as applied mutatis mutandis pursuant to Article 40, paragraph (4) of the Act"; the phrases "for the qualified recipient" and "for the deceased qualified recipient" are deemed to be replaced with "for the specially qualified recipient" and "for the deceased specially qualified recipient", respectively; the phrase "recognition of unemployment or" is deemed to be replaced with "the certification of unemployment under Article 40, paragraph (3) of the Act or"; the phrase "the provisions of this Subsection (excluding the provisions of Articles 19 and 20)" is deemed to be replaced with "the provisions of this Subsection as applied mutatis mutandis in Article 69 (excluding the provisions of Articles 19 and 20) and the provisions of Article 68 and Article 70, paragraph (2)"; and in Article 20, Article 22, Article 45, Article 49 and Article 50, the phrases "A qualified recipient who", "a qualified recipient who", "a qualified recipient intends" and "the qualified recipient must" are deemed to be replaced with "A specially qualified recipient who", "a specially qualified recipient who", "a specially qualified recipient intends" and "the specially qualified recipient must", respectively.

①With regard to a specially qualified recipient who falls under Article 41, paragraph (1) of the Act, the provisions of the preceding two Articles do not apply, and the provisions of Section 2 apply to that person, deeming the person to be a qualified recipient.

②A person who has been issued a specially qualified recipient's certificate must, when the person has come to fall under Article 41, paragraph (1) of the Act, return the specially qualified recipient's certificate in the person's custody to the Chief of the competent Public Employment Security Office. In this case, the Chief of the competent Public Employment Security Office must enter the necessary matters in a qualified recipient's certificate and issue it to that person.

③When a person who has been issued a special recipient qualification notice has come to fall under Article 41, paragraph (1) of the Act, the Chief of the competent Public Employment Security Office must issue to that person a notice of recipient qualification stating the necessary matters.
