Supplementary Provisions, Article 1Effective Date

第一条(施行期日)

This Act comes into effect on April 1, 2020; provided, however, that the provisions set forth in the following items come into effect as of the days specified in those items.

この法律は、令和二年四月一日から施行する。ただし、次の各号に掲げる規定は、当該各号に定める日から施行する。

Supplementary Provisions, Article 2Transitional Measures Concerning the Calculation of the Insured Period

第二条(被保険者期間の計算に関する経過措置)

The provisions of Article 14, paragraph (3), Article 37-3, paragraph (1), Article 39, paragraph (1) and Article 3 of the Supplementary Provisions of the Employment Insurance Act as amended by the provisions of (hereinafter referred to as the "amended Employment Insurance Act") apply to the insured period (meaning the insured period prescribed in Article 14, paragraph (1) of the Employment Insurance Act; the same applies hereinafter in this Article) of a person whose date of separation from service pertaining to the calculation of the insured period (hereinafter referred to as the "date of separation" in this Article) falls on or after the date on which the provisions listed in item (ii) of the preceding Article come into effect (hereinafter referred to as the "item (ii) effective date" in this Article), and with regard to the insured period of a person whose date of separation falls before the item (ii) effective date, the provisions then in force continue to govern.

の規定による改正後の雇用保険法(以下「改正後雇用保険法」という。)、、及び附則第三条の規定は、被保険者期間(に規定する被保険者期間をいう。以下この条において同じ。)の計算に係る離職の日(以下この条において「離職日」という。)が前条第二号に掲げる規定の施行の日(以下この条において「第二号施行日」という。)以後である者に係る被保険者期間について適用し、離職日が第二号施行日前である者に係る被保険者期間については、なお従前の例による。

Supplementary Provisions, Article 3Transitional Measures Concerning Continuous Employment Benefits for the Elderly

第三条(高年齢雇用継続給付に関する経過措置)

The provisions of Article 61, paragraph (5) of the amended Employment Insurance Act apply to basic continuous employment benefits for the elderly for an insured person for whom the day on which the person reached 60 years of age (or, if the person falls under Article 61, paragraph (1), item (i) of the Employment Insurance Act on that day, the day on which the person ceased to fall under ; the same applies hereinafter in this paragraph) falls on or after the date on which the provisions listed in Article 1, item (vi) of the Supplementary Provisions come into effect (hereinafter referred to as the "item (vi) effective date" in this Article), and with regard to basic continuous employment benefits for the elderly for an insured person for whom the day on which the person reached 60 years of age falls before the item (vi) effective date, the provisions then in force continue to govern.

の規定は、六十歳に達した日(その日においてに該当する場合にあっては、に該当しなくなった日。以下この項において同じ。)が附則第一条第六号に掲げる規定の施行の日(以下この条において「第六号施行日」という。)以後である被保険者に対する高年齢雇用継続基本給付金について適用し、六十歳に達した日が第六号施行日前である被保険者に対する高年齢雇用継続基本給付金については、なお従前の例による。

The provisions of Article 61, paragraph (5) of the amended Employment Insurance Act as applied mutatis mutandis pursuant to Article 61-2, paragraph (3) of the Employment Insurance Act apply to re-employment benefits for the elderly for a person who has become an insured person by taking stable employment on or after the item (vi) effective date, and with regard to re-employment benefits for the elderly for a person who became an insured person by taking stable employment before the item (vi) effective date, the provisions then in force continue to govern.

において準用するの規定は、第六号施行日以後に安定した職業に就くことにより被保険者となった者に対する高年齢再就職給付金について適用し、第六号施行日前に安定した職業に就くことにより被保険者となった者に対する高年齢再就職給付金については、なお従前の例による。

Supplementary Provisions, Article 4Transitional Measures Concerning Childcare Leave Benefits

第四条(育児休業給付金に関する経過措置)

The provisions of Articles 61-7 and 61-8 of the amended Employment Insurance Act apply to a person who begins the leave prescribed in Article 61-7, paragraph (1) of the amended Employment Insurance Act on or after the date on which this Act comes into effect (hereinafter referred to as "the effective date"), and with regard to a person who began the leave prescribed in prior to the amendment by the provisions of (hereinafter referred to as the "pre-amendment Employment Insurance Act") before the effective date, the provisions then in force continue to govern.

及びの規定は、この法律の施行の日(以下「施行日」という。)以後にに規定する休業を開始する者について適用し、施行日前にの規定による改正前の雇用保険法(以下「改正前雇用保険法」という。)に規定する休業を開始した者については、なお従前の例による。

Supplementary Provisions, Article 5Transitional Measures Concerning Amounts Borne by the National Treasury for the Employment Insurance

第五条(雇用保険の国庫負担に関する経過措置)

The provisions of Article 66, paragraph (1) of the amended Employment Insurance Act apply to the amount to be borne by the national treasury for fiscal year 2020 and subsequent fiscal years. In this case, childcare leave benefits paid on or after the effective date to a person who began the leave prescribed in of the pre-amendment Employment Insurance Act before the effective date, with regard to whom the provisions then in force continue to govern pursuant to the provisions of the preceding Article, are deemed to be childcare leave benefits under the provisions of Article 61-7, paragraph (1) of the amended Employment Insurance Act, and the provisions of Article 66, paragraph (1), item (iv) of the amended Employment Insurance Act apply to them.

の規定は、令和二年度以後の年度に係る国庫の負担額について適用する。この場合において、前条の規定によりなお従前の例によることとされた施行日前にに規定する休業を開始した者に対して施行日以後に支給される育児休業給付金については、の規定による育児休業給付金とみなして、の規定を適用する。

Supplementary Provisions, Article 11Review

第十一条(検討)

The government is to review, with regard to the provisions of Article 37-5 of the amended Employment Insurance Act, how the amended Employment Insurance Act should be applied to workers employed in the covered undertakings of two or more employers and other matters, approximately five years after the provisions listed in Article 1, item (v) of the Supplementary Provisions come into effect, while taking into consideration the circumstances of persons who have become elderly insured persons pursuant to those provisions and the conditions, etc. of payment of benefits based on the amended Employment Insurance Act to those persons, and if it finds it necessary, take the required measures based on the results.

政府は、附則第一条第五号に掲げる規定の施行後五年を目途として、の規定について、当該規定により高年齢被保険者となった者の状況及び当該者に対する改正後雇用保険法に基づく給付の支給状況等を勘案しつつ、二以上の事業主の適用事業に雇用される労働者に対する改正後雇用保険法の適用の在り方等について検討を加え、必要があると認めるときは、その結果に基づいて所要の措置を講ずるものとする。

Supplementary Provisions, Article 31Transitional Measures Concerning Penal Provisions

第三十一条(罰則に関する経過措置)

With regard to the application of penal provisions to acts committed before this Act (or, for the provisions set forth in the items of Article 1 of the Supplementary Provisions, those provisions; the same applies hereinafter in this Article and the following Article) comes into effect and to acts committed after this Act comes into effect in the cases where the provisions then in force continue to govern pursuant to the provisions of these Supplementary Provisions, the provisions then in force continue to govern.

この法律(附則第一条各号に掲げる規定にあっては、当該規定。以下この条及び次条において同じ。)の施行前にした行為及びこの附則の規定によりなお従前の例によることとされる場合におけるこの法律の施行後にした行為に対する罰則の適用については、なお従前の例による。

Supplementary Provisions, Article 32Delegation to Cabinet Order

第三十二条(政令への委任)

Beyond what is provided for in these Supplementary Provisions, the transitional measures necessary in connection with the enforcement of this Act are specified by Cabinet Order.

この附則に定めるもののほか、この法律の施行に伴い必要な経過措置は、政令で定める。
