第二条（雇用保険の適用除外等に関する経過措置）
With regard to a person who became an insured person of the employment insurance before the date on which this Act comes into effect (hereinafter referred to as "the effective date"), who was 65 years of age or more on the day on which the person became that insured person, and who has been continuously employed in a covered undertaking of the employment insurance by the same employer until the effective date, the provisions of Article 6, item (i) of the Employment Insurance Act as amended by Article 1 (hereinafter referred to as the "new Employment Insurance Act") do not apply while the person continues to be employed in that covered undertaking on and after the effective date.
この法律の施行の日（以下「施行日」という。）前に雇用保険の被保険者となり、かつ、その被保険者となつた日における年齢が六十五歳以上である者であつて、引き続き施行日まで同一の事業主の雇用保険の適用事業に雇用されているものについては、第一条の規定による改正後の雇用保険法（以下「新雇用保険法」という。）第六条第一号の規定は、施行日以降引き続き当該適用事業に雇用されている間は、適用しない。
With regard to the insured persons of the employment insurance to whom the provisions of Article 6, item (i) of the new Employment Insurance Act are not to apply pursuant to the provisions of the preceding paragraph, the provisions of Article 10, paragraph (3), Article 37-2 and Article 37-3 of the new Employment Insurance Act apply by deeming a person other than a person who falls under the category of a specially insured person in short-term employment prescribed in Article 38, paragraph (1) of the Employment Insurance Act or an insured day worker prescribed in Article 43, paragraph (1) of that Act (hereinafter referred to as "specially insured persons in short-term employment, etc." in this paragraph) on the effective date (hereinafter referred to as a "generally insured person" in this paragraph) to have become a continuously insured elderly person prescribed in Article 37-2, paragraph (1) of the new Employment Insurance Act on the effective date, and a person who falls under the category of specially insured persons in short-term employment, etc. on the effective date and who has become a generally insured person after the effective date within the period prescribed in the preceding paragraph to have become such a continuously insured elderly person on the day on which the person became that generally insured person.
前項の規定により新雇用保険法第六条第一号の規定を適用しないこととされた雇用保険の被保険者のうち、施行日に雇用保険法第三十八条第一項に規定する短期雇用特例被保険者又は同法第四十三条第一項に規定する日雇労働被保険者（以下この項において「短期雇用特例被保険者等」という。）に該当する者以外の者（以下この項において「一般被保険者」という。）については施行日に、施行日に短期雇用特例被保険者等に該当し、かつ、施行日後前項に規定する期間内に一般被保険者となつた者については当該一般被保険者となつた日に、新雇用保険法第三十七条の二第一項に規定する高年齢継続被保険者となつたものとみなして、新雇用保険法第十条第三項、第三十七条の二及び第三十七条の三の規定を適用する。
