Supplementary Provisions, Article 1Effective Date

第一条(施行期日)

This Act comes into effect as of the day specified by Cabinet Order within a period not exceeding one year from the date of promulgation; provided, however, that the provisions set forth in the following items come into effect as of the days specified in those items.

この法律は、公布の日から起算して一年を超えない範囲内において政令で定める日から施行する。ただし、次の各号に掲げる規定は、当該各号に定める日から施行する。

Supplementary Provisions, Article 2Preparatory Acts

第二条(準備行為)

The formulation of the guidelines prescribed in Article 30-2, paragraph (3) of the Act on Comprehensively Advancing Labor Measures, and Stabilizing the Employment of Workers, and Enriching Workers' Vocational Lives as amended by (hereinafter referred to as the "new Act on Comprehensively Advancing Labor Measures") (including as applied by replacing terms pursuant to the provisions of Article 38, paragraph (2) of the new Act on Comprehensively Advancing Labor Measures), and the procedures and other acts necessary in connection therewith, may be carried out even before this Act comes into effect, in accordance with the provisions of Article 30-2, paragraphs (3) through (5) of the new Act on Comprehensively Advancing Labor Measures (including as those provisions are applied by replacing terms pursuant to the provisions of Article 38, paragraph (2) of the new Act on Comprehensively Advancing Labor Measures).

の規定による改正後の労働施策の総合的な推進並びに労働者の雇用の安定及び職業生活の充実等に関する法律(以下「新労働施策総合推進法」という。)第三十条の二第三項(新労働施策総合推進法第三十八条第二項の規定により読み替えて適用する場合を含む。)に規定する指針の策定及びこれに関し必要な手続その他の行為は、この法律の施行前においても、新労働施策総合推進法第三十条の二第三項から第五項まで(これらの規定を新労働施策総合推進法第三十八条第二項の規定により読み替えて適用する場合を含む。)の規定の例により行うことができる。

Supplementary Provisions, Article 3Transitional Measures Concerning Small and Medium-Sized Employers

第三条(中小事業主に関する経過措置)

With regard to a small and medium-sized employer (meaning an employer other than the national government, a local government, or an agency engaged in administrative execution, whose amount of stated capital or total amount of contributions is 300 million yen or less (50 million yen or less for an employer whose principal business is retail or services, and 100 million yen or less for an employer whose principal business is wholesale), and an employer other than the national government, a local government, or an agency engaged in administrative execution, whose number of regularly employed workers is 300 or less (50 or less for an employer whose principal business is retail, and 100 or less for an employer whose principal business is wholesale or services); the same applies in paragraph (2) of the following Article), until the date specified by Cabinet Order within a period not exceeding three years from the date of promulgation, the term "must take" in Article 30-2, paragraph (1) of the new Act on Comprehensively Advancing Labor Measures (including as applied by replacing terms pursuant to the provisions of Article 47-4 of the Act on Ensuring the Proper Operation of Worker Dispatching Services and Protecting Dispatched Workers as amended by ; the same applies in paragraph (2) of the following Article) is deemed to be replaced with "must endeavor to take"; the term "Article 30-2, paragraphs (1) and (2)" in Article 30-4, Article 33, paragraph (2), and Article 36, paragraph (1) of the new Act on Comprehensively Advancing Labor Measures (including as those provisions are applied by replacing terms pursuant to the provisions of Article 38, paragraph (2) of the new Act on Comprehensively Advancing Labor Measures) is deemed to be replaced with "Article 30-2, paragraph (2)"; and the term "and Article 30-2, paragraphs (1) and (2)" in Article 35 of the new Act on Comprehensively Advancing Labor Measures is deemed to be replaced with "and Article 30-2, paragraph (2)".

中小事業主(国、地方公共団体及び行政執行法人以外の事業主であって、その資本金の額又は出資の総額が三億円(小売業又はサービス業を主たる事業とする事業主については五千万円、卸売業を主たる事業とする事業主については一億円)以下であるもの及びその常時使用する労働者の数が三百人(小売業を主たる事業とする事業主については五十人、卸売業又はサービス業を主たる事業とする事業主については百人)以下であるものをいう。次条第二項において同じ。)については、公布の日から起算して三年を超えない範囲内において政令で定める日までの間、新労働施策総合推進法第三十条の二第一項(の規定による改正後の労働者派遣事業の適正な運営の確保及び派遣労働者の保護等に関する法律第四十七条の四の規定により読み替えて適用する場合を含む。次条第二項において同じ。)中「講じなければ」とあるのは「講じるように努めなければ」と、新労働施策総合推進法第三十条の四、第三十三条第二項及び第三十六条第一項(これらの規定を新労働施策総合推進法第三十八条第二項の規定により読み替えて適用する場合を含む。)中「第三十条の二第一項及び第二項」とあるのは「第三十条の二第二項」と、新労働施策総合推進法第三十五条中「並びに第三十条の二第一項及び第二項」とあるのは「及び第三十条の二第二項」とする。

Supplementary Provisions, Article 4Transitional Measures concerning Special Provisions on the Promotion of the Resolution of Disputes

第四条(紛争の解決の促進に関する特例に関する経過措置)

With regard to a dispute pertaining to conciliation under (including as applied by replacing terms pursuant to the provisions of ; the same applies in the following paragraph) that is actually pending, at the time this Act comes into effect, before the dispute coordinating committee referred to in or a conciliator appointed pursuant to the provisions of as applied by replacing terms pursuant to the provisions of , and that falls under a dispute prescribed in Article 30-4 of the new Act on Comprehensively Advancing Labor Measures (including as applied by replacing terms pursuant to the provisions of Article 38, paragraph (2) of the new Act on Comprehensively Advancing Labor Measures and the preceding Article; hereinafter the same applies in this paragraph), the provisions then in force continue to govern, notwithstanding the provisions of Article 30-4 of the new Act on Comprehensively Advancing Labor Measures.

この法律の施行の際現にの紛争調整委員会又はの規定により読み替えて適用するの規定により指名するあっせん員に係属している(の規定により読み替えて適用する場合を含む。次項において同じ。)のあっせんに係る紛争であって、新労働施策総合推進法第三十条の四(新労働施策総合推進法第三十八条第二項及び前条の規定により読み替えて適用する場合を含む。以下この項において同じ。)に規定する紛争に該当するものについては、新労働施策総合推進法第三十条の四の規定にかかわらず、なお従前の例による。

With regard to a dispute pertaining to conciliation under that is actually pending, on the date specified by Cabinet Order referred to in the preceding Article, before the dispute coordinating committee referred to in or a conciliator appointed pursuant to the provisions of as applied by replacing terms pursuant to the provisions of , and that falls under a dispute between a worker and a small and medium-sized employer with respect to the particulars prescribed in Article 30-2, paragraph (1) of the new Act on Comprehensively Advancing Labor Measures, the provisions then in force continue to govern, notwithstanding the provisions of Article 30-4 of the new Act on Comprehensively Advancing Labor Measures (including as applied by replacing terms pursuant to the provisions of Article 38, paragraph (2) of the new Act on Comprehensively Advancing Labor Measures).

前条の政令での紛争調整委員会又はの規定により読み替えて適用するの規定により指名するあっせん員に係属しているのあっせんに係る紛争であって、新労働施策総合推進法第三十条の二第一項に定める事項についての労働者と中小事業主との間の紛争に該当するものについては、新労働施策総合推進法第三十条の四(新労働施策総合推進法第三十八条第二項の規定により読み替えて適用する場合を含む。)の規定にかかわらず、なお従前の例による。

Supplementary Provisions, Article 5Transitional Measures Concerning Penal Provisions

第五条(罰則に関する経過措置)

With regard to the application of penal provisions to acts committed before this Act comes into effect, the provisions then in force continue to govern.

この法律の施行前にした行為に対する罰則の適用については、なお従前の例による。

Supplementary Provisions, Article 6Delegation to Cabinet Order

第六条(政令への委任)

In addition to what is provided for in these Supplementary Provisions, the transitional measures necessary in connection with the enforcement of this Act are specified by Cabinet Order.

この附則に定めるもののほか、この法律の施行に関して必要な経過措置は、政令で定める。

Supplementary Provisions, Article 7Review

第七条(検討)

The Government is to, in the case where five years have passed after this Act comes into effect, review the state of enforcement of the provisions as amended by this Act, and, when it finds it necessary, take the required measures based on the results of that review.

政府は、この法律の施行後五年を経過した場合において、この法律による改正後の規定の施行の状況について検討を加え、必要があると認めるときは、その結果に基づいて所要の措置を講ずるものとする。
