Supplementary Provisions, Article 3Transitional Measures Concerning Continuous Employment Benefits for the Elderly

第三条(高年齢雇用継続給付に関する経過措置)

The provisions of Article 61, paragraph (5) of the amended Employment Insurance Act apply to basic continuous employment benefits for the elderly for an insured person for whom the day on which the person reached 60 years of age (or, if the person falls under Article 61, paragraph (1), item (i) of the Employment Insurance Act on that day, the day on which the person ceased to fall under ; the same applies hereinafter in this paragraph) falls on or after the date on which the provisions listed in Article 1, item (vi) of the Supplementary Provisions come into effect (hereinafter referred to as the "item (vi) effective date" in this Article), and with regard to basic continuous employment benefits for the elderly for an insured person for whom the day on which the person reached 60 years of age falls before the item (vi) effective date, the provisions then in force continue to govern.

の規定は、六十歳に達した日(その日においてに該当する場合にあっては、に該当しなくなった日。以下この項において同じ。)が附則第一条第六号に掲げる規定の施行の日(以下この条において「第六号施行日」という。)以後である被保険者に対する高年齢雇用継続基本給付金について適用し、六十歳に達した日が第六号施行日前である被保険者に対する高年齢雇用継続基本給付金については、なお従前の例による。

The provisions of Article 61, paragraph (5) of the amended Employment Insurance Act as applied mutatis mutandis pursuant to Article 61-2, paragraph (3) of the Employment Insurance Act apply to re-employment benefits for the elderly for a person who has become an insured person by taking stable employment on or after the item (vi) effective date, and with regard to re-employment benefits for the elderly for a person who became an insured person by taking stable employment before the item (vi) effective date, the provisions then in force continue to govern.

において準用するの規定は、第六号施行日以後に安定した職業に就くことにより被保険者となった者に対する高年齢再就職給付金について適用し、第六号施行日前に安定した職業に就くことにより被保険者となった者に対する高年齢再就職給付金については、なお従前の例による。
