Article 140-4 (Publication of Employer Names, etc.) — Ordinance for Enforcement of the Employment Insurance Act

The Director of the Prefectural Labor Bureau may, in a case falling under any of the following items, publish the matters specified in the items of the following paragraph.

都道府県労働局長は、次の各号に該当する場合は、次項各号に定める事項を公表することができる。

Where an employer, or an employers' organization or a federation thereof, has received or attempted to receive, by deception or other wrongful acts, an employment adjustment grant or any other benefit paid under the provisions of Chapter IV of the Act;

事業主又は事業主団体若しくはその連合団体が偽りその他不正の行為により、雇用調整助成金その他の法第四章の規定により支給される給付金の支給を受け、又は受けようとした場合

Where an agent, etc. has made a false notification, report, certificate, etc., and an employer, or an employers' organization or a federation thereof, has thereby received or attempted to receive an employment adjustment grant or any other benefit paid under the provisions of Chapter IV of the Act; or

代理人等が偽りの届出、報告、証明等を行い事業主又は事業主団体若しくはその連合団体が雇用調整助成金その他の法第四章の規定により支給される給付金の支給を受け、又は受けようとしたことがある場合

Where a training institution has made a false notification, report, certificate, etc., and an employer, or an employers' organization or a federation thereof, has thereby received or attempted to receive an employment adjustment grant or any other benefit paid under the provisions of Chapter IV of the Act.

訓練機関が偽りの届出、報告、証明等を行い事業主又は事業主団体若しくはその連合団体が雇用調整助成金その他の法第四章の規定により支給される給付金の支給を受け、又は受けようとしたことがある場合

The matters that may be published pursuant to the provisions of the preceding paragraph are, according to the category of cases set out in the following items, the matters specified in those items.

前項の規定により公表することができる事項は、次の各号に掲げる場合の区分に応じ、当該各号に定める事項とする。

In a case falling under item (i) of the preceding paragraph: the following matters:

前項第一号に該当する場合　次に掲げる事項

The name of the employer, or the employers' organization or federation thereof, that committed the deception or other wrongful act, and the name and location of its place of business;

偽りその他不正の行為を行つた事業主又は事業主団体若しくはその連合団体の氏名並びに事業所の名称及び所在地

The outline of the business of the employer, or the employers' organization or federation thereof, that committed the deception or other wrongful act;

偽りその他不正の行為を行つた事業主又は事業主団体若しくはその連合団体の事業の概要

The name of the benefit that was received or attempted to be received, by deception or other wrongful acts, as an employment adjustment grant or any other benefit paid under the provisions of Chapter IV of the Act, the date on which the payment was revoked, the amount ordered to be returned, and the status of that return; and

偽りその他不正の行為により、雇用調整助成金その他の法第四章の規定により支給される給付金の支給を受け、又は受けようとした当該給付金の名称、支給を取り消した日、返還を命じた額及び当該返還の状況

The particulars of the deception or other wrongful act;

偽りその他不正の行為の内容

In a case falling under item (ii) of the preceding paragraph: the following matters:

前項第二号に該当する場合　次に掲げる事項

The name of the agent, etc. that made the false notification, report, certificate, etc., and the name and location of its place of business;

偽りの届出、報告、証明等を行つた代理人等の氏名並びに事業所の名称及び所在地

The name of the benefit that an employer, or an employers' organization or a federation thereof, received or attempted to receive as an employment adjustment grant or any other benefit paid under the provisions of Chapter IV of the Act through the false notification, report, certificate, etc., the date on which the payment was revoked, the amount ordered to be returned, and the status of that return; and

偽りの届出、報告、証明等を行い事業主又は事業主団体若しくはその連合団体が雇用調整助成金その他の法第四章の規定により支給される給付金の支給を受け、又は受けようとした当該給付金の名称、支給を取り消した日、返還を命じた額及び当該返還の状況

The particulars of the false notification, report, certificate, etc.;

偽りの届出、報告、証明等の内容

In a case falling under item (iii) of the preceding paragraph: the following matters:

前項第三号に該当する場合　次に掲げる事項

The name of the training institution that made the false notification, report, certificate, etc., and the name and location of the training institution;

偽りの届出、報告、証明等を行つた訓練機関の氏名並びに訓練機関の名称及び所在地

The name of the benefit that an employer, or an employers' organization or a federation thereof, received or attempted to receive as an employment adjustment grant or any other benefit paid under the provisions of Chapter IV of the Act through the false notification, report, certificate, etc., the date on which the payment was revoked, the amount ordered to be returned, and the status of that return; and

偽りの届出、報告、証明等を行い事業主又は事業主団体若しくはその連合団体が雇用調整助成金その他の法第四章の規定により支給される給付金の支給を受け、又は受けようとした当該給付金の名称、支給を取り消した日、返還を命じた額及び当該返還の状況
