Supplementary Provisions, Article 57Transfer of Reserves from the Surviving Pension Fund Association to a Surviving Employees' Pension Fund

①An old-age defined-benefit early leaver, etc. (meaning a person to whom the surviving Pension Fund Association owes an obligation concerning the payment of the old-age benefit pursuant to the provisions of Article 91-2, paragraph (3) of the pre-amendment Defined-Benefit Corporate Pension Act, which remains in force pursuant to the provisions of Article 63, paragraph (1) of the Supplementary Provisions, or Article 91-3, paragraph (3) of the pre-amendment Defined-Benefit Corporate Pension Act, which remains in force pursuant to the provisions of Article 63, paragraph (2) of the Supplementary Provisions (hereinafter referred to in this Article through Article 59 of the Supplementary Provisions as the "provisions of Article 91-2, paragraph (3), etc. of the pre-amendment Defined-Benefit Corporate Pension Act that remain in force"), or a person to whom the surviving Pension Fund Association owes an obligation concerning the payment of the surviving Pension Fund Association old-age benefit pursuant to the provisions of Article 46, paragraph (3), Article 47, paragraph (3) or Article 49-2, paragraph (1) of the Supplementary Provisions; the same applies hereinafter in this Article through Article 59 of the Supplementary Provisions) may, where the person has acquired the status as a member of a surviving employees' pension Fund and the articles of Association of the surviving Pension Fund Association and that surviving employees' pension Fund provide in advance that the reserves specified by the articles of Association of the surviving Pension Fund Association (meaning the reserves to be appropriated for the old-age benefit under the provisions of Article 91-2, paragraph (3), etc. of the pre-amendment Defined-Benefit Corporate Pension Act that remain in force paid by the surviving Pension Fund Association, or for the surviving Pension Fund Association old-age benefit under Article 46, paragraph (3), Article 47, paragraph (3) or Article 49-2, paragraph (1) of the Supplementary Provisions; the same applies hereinafter in this Article through Article 59 of the Supplementary Provisions) may be transferred from the surviving Pension Fund Association to that surviving employees' pension Fund, apply to the surviving Pension Fund Association for the transfer of those reserves; provided, however, that this does not apply where the old-age defined-benefit early leaver, etc. holds the right to receive the old-age benefit under the provisions of Article 91-2, paragraph (3), etc. of the pre-amendment Defined-Benefit Corporate Pension Act that remain in force or the surviving Pension Fund Association old-age benefit under Article 46, paragraph (3), Article 47, paragraph (3) or Article 49-2, paragraph (1) of the Supplementary Provisions.

③When that surviving employees' pension Fund has received the transfer of reserves pursuant to the preceding paragraph, it is to pay old-age pension benefits, etc. to that old-age defined-benefit early leaver, etc., using the transferred Funds as the source and as provided by its articles of Association.

④When the surviving Pension Fund Association has transferred reserves pursuant to the provisions of paragraph (2), it is relieved of its obligation concerning the payment of the old-age benefit or the survivor benefit under the provisions of Article 91-2, paragraph (3), etc. of the pre-amendment Defined-Benefit Corporate Pension Act that remain in force, or of the surviving Pension Fund Association old-age benefit or the surviving Pension Fund Association survivor benefit under Article 46, paragraph (3), Article 47, paragraph (3) or Article 49-2, paragraph (1) of the Supplementary Provisions, pertaining to that old-age defined-benefit early leaver, etc.

⑤When that surviving employees' pension Fund has come to pay old-age pension benefits, etc. pursuant to the provisions of paragraph (3), it must notify that old-age defined-benefit early leaver, etc. to that effect.
