Supplementary Provisions, Article 55Transfer of Reserves for Pension Benefits or Other Reserves from the Surviving Pension Fund Association to a Defined-Benefit Corporate Pension

①A pre-effective-date Fund early leaver, etc. or a post-effective-date Fund early leaver, etc. (hereinafter referred to in this Article and the following Article as an "old-age Fund early leaver, etc.") may, where the person has acquired the status as a participant in a defined-benefit corporate pension and the articles of Association of the surviving Pension Fund Association and that defined-benefit corporate pension provide in advance that the reserves for pension benefits or other reserves specified by the articles of Association of the surviving Pension Fund Association (meaning, for a pre-effective-date Fund early leaver, etc., the reserves for pension benefits, and for a post-effective-date Fund early leaver, etc., the reserves; the same applies hereinafter in this Article and the following Article) may be transferred from the surviving Pension Fund Association to the asset management and investment institution, etc. of that defined-benefit corporate pension, apply to the surviving Pension Fund Association for the transfer of those reserves for pension benefits or other reserves; provided, however, that this does not apply where the old-age Fund early leaver, etc. holds the right to receive the old-age pension benefit paid by the surviving Pension Fund Association or the surviving Pension Fund Association old-age benefit under Article 42, paragraph (3) or Article 43, paragraph (3) of the Supplementary Provisions.
