Supplementary Provisions, Article 20Review, Etc.

①Taking into account that provisions on crimes relating to sexual harm have the characteristic that the subjects of punishment are to be determined appropriately in light of how society perceives them, and that their amendment responds to the actual state of sexual harm in each era and changes in social awareness of it, the government, when five years have elapsed after this Act comes into effect, is to take into consideration the status of enforcement of the provisions of the respective Acts as amended by this Act and the provisions of the Act on the Punishment of Acts of Photographing Sexual Poses, etc. and the Erasure, etc. of Electronic or Magnetic Records of Images of Sexual Poses Recorded on Seized Articles (Act No. 67 of 2023) (hereinafter referred to as the "provisions of the new Penal Code, etc."), and, also taking into account the actual state of sexual harm after the enforcement of the provisions of the new Penal Code, etc. and how society perceives it and social awareness of it, in particular awareness of sexual consent, promptly examine the way measures for dealing with cases of sex crimes in accordance with the actual state of such cases should be, and, if it finds it necessary, take required measures based on the results.

②The Government is to conduct the necessary surveys on the difficulty of reporting sexual harm and other aspects of the actual state of sexual harm, so that the review referred to in the preceding paragraph will be more evidence-based.
