Supplementary Provisions, Article 8Transitional Measures Concerning Provisional Orders
第八条（保全処分に関する経過措置）
With regard to a case relating to a petition made before the Effective Date under Article 55, paragraph (1) or (2), Article 68-2, paragraph (1) or Article 77, paragraph (1) (including where these provisions apply mutatis mutandis pursuant to Article 188 of the Former Civil Enforcement Act) of the Civil Enforcement Act prior to the amendment by the provisions of Article 3 (hereinafter referred to as the "Former Civil Enforcement Act"), or under Article 187-2, paragraph (1) or (2) of the Former Civil Enforcement Act, the provisions then in force continue to govern, notwithstanding the provisions of the Civil Enforcement Act as amended by the provisions of Article 3.
施行日前にされた第三条の規定による改正前の民事執行法（以下「旧民事執行法」という。）第五十五条第一項若しくは第二項、第六十八条の二第一項若しくは第七十七条第一項（これらの規定を旧民事執行法第百八十八条において準用する場合を含む。）又は旧民事執行法第百八十七条の二第一項若しくは第二項の申立てに係る事件については、第三条の規定による改正後の民事執行法の規定にかかわらず、なお従前の例による。
