A court clerk must prepare records regarding a date for proceedings for a provisional order prior to a ruling; provided, however, that this does not apply if the presiding judge finds it to be unnecessary to prepare the records.
裁判所書記官は、審判前の保全処分の手続の期日について、調書を作成しなければならない。ただし、裁判長においてその必要がないと認めるときは、この限りでない。
The provisions of Article 46 do not apply to proceedings for a provisional order prior to a ruling.
