Section 12-2 Adjudication Cases for Dispositions Regarding the Preservation of an Estate
第十二節の二 相続財産の保存に関する処分の審判事件
第百九十条の二
An adjudication case for a disposition regarding the preservation of an estate is subject to the jurisdiction of the family court which has jurisdiction over the place where the inheritance process has commenced.
相続財産の保存に関する処分の審判事件は、相続が開始した地を管轄する家庭裁判所の管轄に属する。
Changes by (Act No. 45 of 2026)
The provisions of Article 125, paragraphs (1) through (6), Article 146-2 and Article 147 apply mutatis mutandis to an adjudication case for a disposition regarding the preservation of an estate. In this case, the term "property of an adult under guardianship" in Article 125, paragraph (3) is deemed to be replaced with "an estate".
第百二十五条第一項から第六項まで、第百四十六条の二及び第百四十七条の規定は、相続財産の保存に関する処分の審判事件について準用する。この場合において、第百二十五条第三項中「成年被後見人の財産」とあるのは、「相続財産」と読み替えるものとする。
