A court clerk must prepare records regarding a date for proceedings for a provisional order prior to a ruling; provided, however, that this does not apply if the presiding judge finds it to be unnecessary to prepare the records.
裁判所書記官は、審判前の保全処分の手続の期日について、調書を作成しなければならない。ただし、裁判長においてその必要がないと認めるときは、この限りでない。
A court clerk must
prepare records, as provided by the Rules of the Supreme Court, prepare an electronic record regarding a date for proceedings for a provisional order prior to a ruling; provided, however, that this does not apply if the presiding judge finds it to be unnecessary to prepare the records.裁判所書記官は、審判前の保全処分の手続の期日について、最高裁判所規則で定めるところにより、電子調書を作成しなければならない。ただし、裁判長においてその必要がないと認めるときは、この限りでない。
