Article 101-41Reasons and Days under Article 61-10, paragraph (1) of the Act as Applied with Replaced Terms pursuant to paragraph (5) of that Article

第百一条の四十一（法第六十一条の十第五項の規定により読み替えて適用する同条第一項の理由及び日）

The reasons specified by Order of the Ministry of Health, Labour and Welfare as reasons found to make it inappropriate to rely on the day on which the leave under Article 65, paragraph (1) of the Labor Standards Act began, under Article 61-10, paragraph (1) of the Act as applied with replaced terms pursuant to paragraph (5) of that Article, and the days specified by Order of the Ministry of Health, Labour and Welfare in accordance with those reasons, are the reasons set out in the following items and the days specified in those items according to the categories of reasons set out in those items.

法第六十一条の十第五項の規定により読み替えて適用する同条第一項の労働基準法第六十五条第一項の規定による休業を開始した日によることが適当でないと認められるものとして厚生労働省令で定める理由及び当該理由に応じて厚生労働省令で定める日は、次の各号に掲げる理由及び当該各号に掲げる理由の区分に応じて当該各号に定める日とする。

with regard to the child pertaining to the application for post-birth leave, the child was born before the day on which leave under Article 65, paragraph (1) of the Labor Standards Act begins: the day following the day on which the child was born;

出生後休業の申出に係る子について、労働基準法第六十五条第一項の規定による休業を開始する日前に当該子を出生したこと　当該子を出生した日の翌日

with regard to the child pertaining to the application for post-birth leave, leave for maternity protection preceding that leave was taken before the day on which leave under Article 65, paragraph (1) of the Labor Standards Act begins: the day on which that preceding leave began.

出生後休業の申出に係る子について、労働基準法第六十五条第一項の規定による休業を開始する日前に当該休業に先行する母性保護のための休業をしたこと　当該先行する休業を開始した日
