第四十二条（基金中途脱退者に係る措置）
A Fund early leaver may apply to a surviving employees' pension Fund for the transfer of the amount equivalent to the Fund withdrawal lump sum to the surviving Pension Fund Association.
基金中途脱退者は、存続厚生年金基金に基金脱退一時金相当額の存続連合会への移換を申し出ることができる。
Upon receiving an application under the preceding paragraph, the surviving employees' pension Fund concerned is to transfer the amount equivalent to the Fund withdrawal lump sum pertaining to that application to the surviving Pension Fund Association.
当該存続厚生年金基金は、前項の規定による申出があったときは、存続連合会に当該申出に係る基金脱退一時金相当額を移換するものとする。
When the surviving Pension Fund Association has received the transfer of the amount equivalent to the Fund withdrawal lump sum pursuant to the preceding paragraph, it is to pay a surviving Pension Fund Association old-age benefit or surviving Pension Fund Association survivor benefit to the Fund early leaver concerned or that person's surviving family, using the transferred Funds as the source of Funds, as provided by Cabinet Order.
存続連合会は、前項の規定により基金脱退一時金相当額の移換を受けたときは、当該移換金を原資として、政令で定めるところにより、当該基金中途脱退者又はその遺族に対し、存続連合会老齢給付金又は存続連合会遺族給付金の支給を行うものとする。
When a surviving employees' pension Fund has transferred the amount equivalent to the Fund withdrawal lump sum pursuant to the provisions of paragraph (2), it is released from its obligation concerning the payment of the withdrawal lump-sum payment to the Fund early leaver concerned.
存続厚生年金基金は、第二項の規定により基金脱退一時金相当額を移換したときは、当該基金中途脱退者に係る脱退一時金の支給に関する義務を免れる。
When the surviving Pension Fund Association has come to pay a surviving Pension Fund Association old-age benefit or surviving Pension Fund Association survivor benefit pursuant to the provisions of paragraph (3), it must notify the Fund early leaver concerned or that person's surviving family to that effect.
When the surviving Pension Fund Association is unable to give the notice under the preceding paragraph because the whereabouts of the Fund early leaver or that person's surviving family is unknown, it must, in lieu of that notice, give public notice of the matters to be notified.
Measures concerning Fund Early Leavers
A Fund early leaver may apply to a surviving employees' pension Fund for the transfer of the amount equivalent to the Fund withdrawal lump sum to the surviving Pension Fund Association.
