第五条（施行前の準備）
A person seeking to be licensed as referred to in Article 3, paragraph (1) of the new Hotel Business Act and to run the business of operating an inn or hotel prescribed in Article 2, paragraph (2) of the new Hotel Business Act may apply for that license even before the effective date, in the same manner as prescribed in Article 3, paragraph (1) of the new Hotel Business Act.
新旅館業法第三条第一項の許可を受けて新旅館業法第二条第二項に規定する旅館・ホテル営業を営もうとする者は、施行日前においても、新旅館業法第三条第一項の規定の例により、その許可の申請をすることができる。
If an application for a license under the provisions of the preceding paragraph has been filed, the prefectural governor (or the mayor of the city, in a city with a health center; or the mayor of the ward, in a special ward) may grant that license even before the effective date, in the same manner as prescribed in Article 3, paragraphs (2) through (6) of the new Hotel Business Act. In this case, the person that has been granted that license is deemed to have been licensed as referred to in paragraph (1) of that Article on the effective date.
都道府県知事（保健所を設置する市又は特別区にあっては、市長又は区長）は、前項の規定による許可の申請があった場合には、施行日前においても、新旅館業法第三条第二項から第六項までの規定の例により、その許可を与えることができる。この場合において、その許可を受けた者は、施行日において同条第一項の許可を受けたものとみなす。
