主務省令（しゅむしょうれい）

In Chapter IV, on funds transfer transaction analysis (為替取引分析), a joint Cabinet Office Order and Order of the Ministry of Finance (内閣府令・財務省令) where a funds transfer transaction analysis service provider (為替取引分析業者) carries on the work of Article 2, paragraph (21), item (i), and a Cabinet Office Order (内閣府令) in any other case.

次の各号に掲げる場合の区分に応じ、当該各号に定める命令

手続実施基本契約（てつづきじっしきほんけいやく）

A contract on carrying out dispute resolution services, etc. (紛争解決等業務) concluded between a designated dispute resolution organization (指定紛争解決機関) and a business operator involved in financial instruments transactions (金融商品取引関係業者) — a financial instruments business operator, etc. or a securities finance company.

技能検定（ぎのうけんてい）

An evaluation of a person's motor vehicle driving skills, carried out as a Cabinet Office Order (内閣府令) sets.

電磁的方法（でんじてきほうほう）

From Article 88-5, paragraph (3) on, where it is first used for voting at the organizational meeting of a financial instruments membership corporation (金融商品会員制法人) instead of in writing, a means using an electronic data processing system or other information and communications technology, of a kind a Cabinet Office Order (内閣府令) specifies.

取扱有価証券（とりあつかいゆうかしょうけん）

Share certificates, bonds with share options (新株予約権付社債券) and other securities a Cabinet Office Order (内閣府令) specifies, whose solicitation for purchase and sale an authorized association (認可協会) does not forbid in its rules, other than securities listed on a financial instruments exchange, over-the-counter traded securities (店頭売買有価証券) and securities the Prime Minister specifies as restricted in circulation under those rules.

連携金融商品債務引受業務（れんけいきんゆうしょうひんさいむひきうけぎょうむ）

Carrying on as a business an act specified by Cabinet Office Order (内閣府令) by which a financial instruments clearing organization has a third party take on a clearing member's (清算参加者) obligations under a subject transaction (対象取引) other than those in Article 156-62, item (i), and itself takes on the obligations of that clearing member's counterparty; a clearing organization may do so, with the Prime Minister's authorization, under a contract with a collaborating clearing organization, etc. (連携清算機関等).

第百五十六条の六十二第一号に掲げる取引以外の対象取引に係る清算参加者の債務を第三者に負担させ、当該対象取引に係る清算参加者の相手方の債務は自らが負担する行為として内閣府令で定める行為を業として行うこと

景品類（けいひんるい）

外国銀行代理銀行（がいこくぎんこうだいりぎんこう）

A bank that carries on foreign bank agency services (外国銀行代理業務) after obtaining authorization under Article 52-2, paragraph (1) or (2), or after filing a notification under paragraph (3) of that Article.

第五十二条の二第一項若しくは第二項の認可を受け、又は同条第三項の規定による届出をして外国銀行代理業務を営んでいる銀行

履行保証金信託契約（りこうほしょうきんしんたくけいやく）

In Chapter III, a trust agreement with a trust company, etc. (信託会社等) whose purpose is to use the trust property for depositing security for providing funds transfer services (履行保証金) when the Prime Minister orders it, under which the trustee does what that purpose needs, including managing the property.

当該信託会社等が内閣総理大臣の命令に応じて信託財産を履行保証金の供託に充てることを信託の目的として当該信託財産の管理その他の当該目的の達成のために必要な行為をすべき旨の信託契約

金融機関（きんゆうきかん）

In Article 128, paragraph (3) and the provisions after it, where a financial institution carrying on trust business (信託業務を営む金融機関) is meant: one authorised under Article 1, paragraph (1) of the Act on Engagement in Trust Business by Financial Institutions (Act No. 43 of 1943).

金融機関の信託業務の兼営等に関する法律（昭和十八年法律第四十三号）第一条第一項の認可を受けた金融機関

主務省令（しゅむしょうれい）

In this Act, an order (命令) issued, as a Cabinet Order (政令) provides, by the Minister of Health, Labour and Welfare or the Prime Minister.

行政機関（ぎょうせいきかん）

The following bodies: bodies placed in the Cabinet (内閣) under an Act (法律) or placed under the Cabinet's jurisdiction, the Imperial Household Agency (宮内庁), the bodies provided for in Article 49, paragraph (1) or (2) of the Act for Establishment of the Cabinet Office (Act No. 89 of 1999) and in Article 3, paragraph (2) of the National Government Organization Act (Act No. 120 of 1948), the Board of Audit (会計検査院), bodies placed within any of these, and officials of these bodies whom the law allows to exercise authority independently; and the organs of local governments (地方公共団体) other than their assemblies (議会).

取引情報（とりひきじょうほう）

Information on transactions that a Cabinet Office Order (内閣府令) specifies as needing to be made clear, for investor protection, to show the state of the transactions of financial instruments business operators, etc. (金融商品取引業者等).

前条第三項に規定する取引情報

保険会社（ほけんがいしゃ）

An insurance company as defined in Article 2, paragraph (2) of the Insurance Business Act.

保険業法第二条第二項（定義）に規定する保険会社

上場株券等（じょうじょうかぶけんとう）

In Articles 67-18 to 78-5, share certificates, bonds with share options (新株予約権付社債券) and other securities a Cabinet Office Order (内閣府令) specifies that are listed on a financial instruments exchange (金融商品取引所).

金融商品取引所に上場されている株券、新株予約権付社債券その他の有価証券で内閣府令で定めるもの

特定関係者（とくていかんけいしゃ）

In Article 174-3, a company in which the violator (違反者) holds a majority of the voting rights of all shareholders, etc., or another person a Cabinet Office Order (内閣府令) specifies as closely connected with the violator; or a person who shares a household with the violator, or another person a Cabinet Office Order specifies as having a special relationship with them.

有価証券報告書（ゆうかしょうけんほうこくしょ）

An annual securities report: the report that a company issuing securities listed on a financial instruments exchange, or otherwise falling under Article 24, paragraph (1), must submit to the Prime Minister for each business year, setting out its trade name, the state of its corporate group and its accounts, and other important matters about its business, within three months after the year ends for a domestic company.

開示が行われている場合（かいじがおこなわれているばあい）

In Chapter II and in Articles 40-4, 40-5, paragraph (1) and 66-14-2, a case in which disclosure has been made as Article 4, paragraph (7) defines it: where a notification under Article 4, paragraph (1), (2) or (3) for an earlier public offering, secondary distribution or general solicitation of the same securities has taken effect (unless the issuer is exempt from filing annual securities reports under the proviso to Article 24, paragraph (1)), or a case a Cabinet Office Order (内閣府令) treats as equivalent.

The national government bodies listed in Article 2(1): bodies placed in the Cabinet (内閣) under an Act (法律) or placed under the Cabinet’s jurisdiction; the Cabinet Office (内閣府), the Imperial Household Agency (宮内庁) and the commissions and agencies placed under Article 49(1) and (2) of the Act for Establishment of the Cabinet Office; the ministries, commissions and agencies provided for in Article 3(2) of the National Government Organization Act; the facilities (such as research institutions and training facilities) and special bodies (特別の機関) placed within these that a Cabinet Order (政令) names; and the Board of Audit (会計検査院).

An administrative organ (行政機関) as defined in Article 2, paragraph (1) of the Act on Access to Information Held by Administrative Organs: the national bodies listed there — those placed in or under the Cabinet (内閣) by law, the Cabinet Office (内閣府), the Imperial Household Agency (宮内庁), the ministries, commissions and agencies, certain facilities and special bodies a Cabinet Order (政令) designates, and the Board of Audit (会計検査院).
