Article 108-32National Center for Facilitating Traffic Safety Activities
第百八条の三十二（全国交通安全活動推進センター）
At the application of a general incorporated association or general incorporated foundation that aims to contribute to the safety and fluidity of road traffic, and which is found to be able to carry out the operations prescribed in the following paragraph in a proper and reliable manner, the National Public Safety Commission may designate a maximum of one such association or foundation nationwide as the national center for facilitating traffic safety activities (hereinafter referred to as the "national center").
The national center is to carry out the following operations:
全国センターは、次に掲げる事業を行うものとする。
training persons in charge of traffic accident consultations; persons in charge of inquiries and consultations on the regulation of on-road vehicle parking, road traffic, and road usage; persons in charge of instruction in competent driving; and persons handling other activities of prefectural centers;
carrying out informative activities on correct traffic rules, traffic accident prevention, and other issues of road traffic safety in the areas of two or more prefectures;
適正な交通の方法、交通事故防止その他道路における交通の安全に関する事項について二以上の都道府県の区域における広報活動を行うこと。
carrying out educational activities on correct traffic rules, traffic accident prevention, and other issues of road traffic safety in the areas of two or more prefectures;
適正な交通の方法、交通事故防止その他道路における交通の安全についての二以上の都道府県の区域における啓発活動を行うこと。
carrying out educational activities on proper on-road vehicle parking and road usage in the areas of two or more prefectures (other than as under the preceding item);
carrying out investigations and research on the regulation of on-road vehicle parking and road traffic, road usage, and instruction in competent driving;
conducting training in the necessary skills and knowledge to improve the quality of persons that are involved in traffic safety education for persons using the road (other than training for the operations managers as prescribed in the Road Transportation Act and the Act on Motor Vehicle Cargo Transportation Services, and other training that Rules of the National Public Safety Commission prescribe);
道路を通行する者に対する交通安全教育を行う者の資質の向上に必要とされる技能及び知識に関する研修（道路運送法及び貨物自動車運送事業法に規定する運行管理者に対するものその他国家公安委員会規則で定めるものを除く。）を行うこと。
providing communication and coordination in connection with the operations of prefectural centers; and
都道府県センターの事業について、連絡調整を行うこと。
operations incidental to those set forth in the preceding items.
前各号の事業に附帯する事業
The provisions of paragraphs (3), (4), (7), and (8) of the preceding Article apply mutatis mutandis to the national center. In such a case, the term "a public safety commission" in paragraph (3) of that Article is deemed to be replaced with "the National Public Safety Commission"; the phrases "a public safety commission" and "paragraph (1)" in paragraph (4) of that Article are deemed to be replaced with "the National Public Safety Commission" and "paragraph (1) of the following Article", respectively; the phrase "the items of paragraph (2)" in paragraph (7) of that Article is deemed to be replaced with "the items of paragraph (2) of the following Article"; and the phrase "paragraph (1)" in paragraph (8) of that Article is deemed to be replaced with "paragraph (1) of the following Article".
Article 108-32-2Accreditation of Education for Licensed Drivers, etc.
第百八条の三十二の二（運転免許取得者等教育の認定）
For each of the categories of program that Rules of the National Public Safety Commission prescribe, a person using a driving school or other such facility to provide persons who currently hold a license (other than a provisional license), specified holders of an expired license, or specified persons stripped of driving privileges with education aimed at improving their driving skills and deepening their road traffic knowledge (hereinafter referred to as "education for licensed drivers, etc.") may apply with the public safety commission having jurisdiction over the location of the facility to receive accreditation showing that the education for licensed drivers, etc. that the person provides through a program at that facility conforms to all of the following:
it is provided by a person who has been issued an instructor certificate or by any other person that Rules of the National Public Safety Commission prescribe as being able to effectively and appropriately provide education for licensed drivers, etc.;
教習指導員資格者証の交付を受けた者その他の運転免許取得者等教育を効果的かつ適切に行うことができる者として国家公安委員会規則で定める者により行われるものであること。
equipment conforming to the criteria that Cabinet Order prescribes which is referred to in item (iv) of paragraph (1) of Article 99, or anything else that Rules of the National Public Safety Commission prescribe as equipment for effectively and appropriately providing education for licensed drivers, etc. is used to provide it; and
第九十九条第一項第四号の政令で定める基準に適合した設備その他の運転免許取得者等教育を効果的かつ適切に行うための設備として国家公安委員会規則で定める設備を用いて行われるものであること。
the program is provided in accordance with the traffic safety education guidelines, and conforms to any of the following criteria:
当該課程が、交通安全教育指針に従つて行われるものであり、かつ、次に掲げる基準のいずれかに適合するものであること。
criteria that Rules of the National Public Safety Commission prescribe as criteria for a program that is as effective as the training set forth in Article 108-2, paragraph (1), item (xi);
第百八条の二第一項第十一号に掲げる講習と同等の効果がある課程の基準として国家公安委員会規則で定める基準
criteria that Rules of the National Public Safety Commission prescribe as criteria for a program that is as effective as the training set forth in Article 108-2, paragraph (1), item (xii); or
第百八条の二第一項第十二号に掲げる講習と同等の効果がある課程の基準として国家公安委員会規則で定める基準
beyond what is set forth in (a) and (b), criteria that Rules of the National Public Safety Commission prescribe as criteria for a program that is effective in improving driving skills and deepening road traffic knowledge.
イ及びロに掲げるもののほか、運転技能を向上させるとともに道路交通に関する知識を深めさせる効果がある課程の基準として国家公安委員会規則で定める基準
Upon granting the accreditation referred to in the preceding paragraph, a public safety commission must issue public notice of this pursuant to Rules of the National Public Safety Commission.
A person providing education for licensed drivers, etc. must not use a name prefixed with the words "accredited by the public safety commission" for a program of that education for licensed drivers, etc. without obtaining the accreditation referred to in paragraph (1).
運転免許取得者等教育を行う者は、当該運転免許取得者等教育の課程について、第一項の認定を受けないで、公安委員会認定という文字を冠した名称を用いてはならない。
Article 98, paragraphs (3) through (5) apply mutatis mutandis to persons providing education for licensed drivers, etc. under the accreditation referred to in paragraph (1). In such a case, the phrase "motor vehicle driving instruction" in paragraph (3) of that Article is deemed to be replaced with "education for licensed drivers, etc. as referred to in Article 108-32-2, paragraph (1) which has been accredited as referred to in that paragraph" and the phrase "instruction at the driving school" in that paragraph is deemed to be replaced with "education for licensed drivers, etc."; and the phrase "instruction in motor vehicle driving skills or knowledge at the driving school" in paragraph (4) of that Article is deemed to be replaced with "the education for licensed drivers, etc. referred to in Article 108-32-2, paragraph (1)".
第九十八条第三項から第五項までの規定は、第一項の認定を受けて運転免許取得者等教育を行う者について準用する。この場合において、同条第三項中「自動車の運転に関する教習」とあるのは「第百八条の三十二の二第一項の認定を受けた同項の運転免許取得者等教育」と、「自動車教習所における教習」とあるのは「運転免許取得者等教育」と、同条第四項中「自動車教習所における自動車の運転に関する技能又は知識の教習」とあるのは「第百八条の三十二の二第一項の運転免許取得者等教育」と読み替えるものとする。
If a public safety commission finds that education for licensed drivers, etc. that has been accredited as referred to in paragraph (1) no longer conforms to one of the items of that paragraph, it may revoke the accreditation.
公安委員会は、第一項の認定を受けた運転免許取得者等教育が同項各号のいずれかに適合しなくなつたと認めるときは、その認定を取り消すことができる。
Beyond what is prescribed in the preceding paragraphs, Rules of the National Public Safety Commission provide for applying for accreditation as referred to in paragraph (1) and other necessary particulars of accreditation as referred to in that paragraph.
Article 108-32-3Accreditation of Examination for Licensed Drivers, etc.
第百八条の三十二の三（運転免許取得者等検査の認定）
For each of the categories of method that Rules of the National Public Safety Commission prescribe, a person using a driving school or other such facility to conduct an examination to confirm the effect, on the driving of a motor vehicle or motorized bicycle, of the decline in physical function or driving skills that arises with aging in a person who currently holds a license, a specified holder of an expired license, or a specified person stripped of driving privileges (hereinafter referred to as an "examination for licensed drivers, etc.") may apply with the public safety commission having jurisdiction over the location of the facility to receive accreditation showing that the examination for licensed drivers, etc. that the person conducts by that method at that facility conforms to all of the following:
it is conducted by a person who has passed the screening that a public safety commission conducts regarding skills and knowledge relating to examinations for licensed drivers, etc., or by any other person that Rules of the National Public Safety Commission prescribe as being able to effectively and appropriately conduct examinations for licensed drivers, etc.;
公安委員会が運転免許取得者等検査に関する技能及び知識に関して行う審査に合格した者その他の運転免許取得者等検査を効果的かつ適切に行うことができる者として国家公安委員会規則で定める者により行われるものであること。
equipment conforming to the criteria that Cabinet Order prescribes which is referred to in item (iv) of paragraph (1) of Article 99, or anything else that Rules of the National Public Safety Commission prescribe as equipment for effectively and appropriately conducting examinations for licensed drivers, etc. is used to conduct it; and
第九十九条第一項第四号の政令で定める基準に適合した設備その他の運転免許取得者等検査を効果的かつ適切に行うための設備として国家公安委員会規則で定める設備を用いて行われるものであること。
the method conforms to any of the following criteria:
当該方法が次に掲げる基準のいずれかに適合するものであること。
criteria that Rules of the National Public Safety Commission prescribe as criteria for a method that is as effective as a cognitive assessment;
認知機能検査と同等の効果がある方法の基準として国家公安委員会規則で定める基準
criteria that Rules of the National Public Safety Commission prescribe as criteria for a method that is as effective as a driving skills assessment; or
運転技能検査と同等の効果がある方法の基準として国家公安委員会規則で定める基準
beyond what is set forth in (a) and (b), criteria that Rules of the National Public Safety Commission prescribe as criteria for a method that is effective in confirming the effect, on the driving of a motor vehicle or motorized bicycle, of the decline in physical function or driving skills that arises with aging.
The provisions of paragraphs (2) through (6) of the preceding Article apply mutatis mutandis to examinations for licensed drivers, etc. In such a case, the phrase "the preceding paragraph" in paragraph (2) of that Article is deemed to be replaced with "paragraph (1) of the following Article"; the phrase "program" in paragraph (3) of that Article is deemed to be replaced with "method", and the phrase "paragraph (1)" in that paragraph with "paragraph (1) of the following Article"; the phrase "the accreditation referred to in paragraph (1)" in paragraph (4) of that Article is deemed to be replaced with "the accreditation referred to in paragraph (1) of the following Article", and the phrase "Article 108-32-2, paragraph (1)" in that paragraph with "Article 108-32-3, paragraph (1)"; the phrase "paragraph (1)" in paragraph (5) of that Article with "paragraph (1) of the following Article"; and the phrase "the preceding paragraphs" in paragraph (6) of that Article with "paragraphs (2) through the preceding paragraph and paragraph (1) of the following Article", and the phrase "paragraph (1)" in that paragraph with "that paragraph".
Article 108-32-4Traffic Safety Education by Sellers of Specified Small Motorized Bicycles, etc.
第百八条の三十二の四（特定小型原動機付自転車の販売者等による交通安全教育）
A person engaged in the business of selling or renting specified small motorized bicycles must endeavor to provide the purchaser or user of the specified small motorized bicycle with the traffic safety education necessary for ensuring the safe driving of specified small motorized bicycles, in accordance with the traffic safety education guidelines.
特定小型原動機付自転車を販売し、又は貸し渡すことを業とする者は、当該特定小型原動機付自転車の購入者又は利用者に対し、交通安全教育指針に従つて特定小型原動機付自転車の安全な運転を確保するために必要な交通安全教育を行うように努めなければならない。
