Supplementary Provisions, Article 3, paragraph (1)

第一項

The provisions of Article 39, paragraphs (1) and (2) of the new Labor Standards Act apply to a worker for whom the day on which the worker's continuous service exceeds six months falls on or after the date on which this Act comes into effect (hereinafter referred to as the "effective date"), and with regard to a worker who has been in continuous service for more than six months before the effective date, the provisions then in force continue to govern. In this case, with regard to the application of the provisions of paragraphs (1) and (2) of that Article to a worker whose day of hiring falls before the effective date, the term "the day of hiring" in paragraph (1) of that Article is deemed to be replaced with "the date on which the Act Partially Amending the Labor Standards Act and the Act on Temporary Measures for Promoting the Reduction of Working Hours (Act No. 79 of 1993) comes into effect (referred to as the "effective date" in the following paragraph)", the term "one year and six months" in paragraph (2) of that Article with "one year and six months counting from the effective date", and the term "six months" with "six months counting from the effective date".

新労働基準法第三十九条第一項及び第二項の規定は、六箇月を超えて継続勤務する日がこの法律の施行の日(以下「施行日」という。)以後である労働者について適用し、施行日前に六箇月を超えて継続勤務している労働者については、なお従前の例による。この場合において、その雇入れの日が施行日前である労働者に関する同条第一項及び第二項の規定の適用については、同条第一項中「その雇入れの日」とあるのは「労働基準法及び労働時間の短縮の促進に関する臨時措置法の一部を改正する法律(平成五年法律第七十九号)の施行の日(次項において「施行日」という。)」と、同条第二項中「一年六箇月」とあるのは「施行日から起算して一年六箇月」と、「六箇月を」とあるのは「施行日から起算して六箇月を」とする。
