附 則

This Act comes into effect on September 1, 1952.

この法律は、昭和二十七年九月一日から施行する。

In the case where, at the time this Act comes into effect, an employer is managing the savings of workers with authorization under the provisions of Article 18, paragraph (2) of the Labor Standards Act prior to the amendment, the notification under the provisions of that paragraph as amended is deemed to have been made after this Act comes into effect.

この法律の施行の際使用者が改正前の労働基準法第十八条第二項の規定による認可を受けて、労働者の貯蓄金を管理している場合においては、この法律の施行後は、改正後の同項の規定による届出があつたものとみなす。

The provisions of Article 76, paragraph (2) and paragraph (3) of the Labor Standards Act as amended are to apply also to a worker who, at the time this Act comes into effect, is receiving compensation for absence from work under the provisions of paragraph (1) of that Article, and, when there are grounds falling under any of the following items with regard to that worker, the employer must revise the compensation for absence from work according to the ratio specified in the relevant item in accordance with the categories of the following items, and must provide compensation for absence from work in the revised amount from January 1953:

改正後の労働基準法第七十六条第二項及び第三項の規定は、この法律施行の際同条第一項の規定による休業補償を受けている労働者についても適用あるものとし、且つ、その労働者につき左の各号の一に該当する事由があるときは、使用者は、左の各号の区分によつて当該各号に定める比率に応じて休業補償を改訂し、昭和二十八年一月から、改訂された額により休業補償を行わなければならない。

for a person who was injured or contracted a disease in the course of employment during the period from September 1, 1947 to March 31, 1951 at a workplace that regularly employs 100 or more workers, if the average amount of pay for January through March 1952 exceeds 120 percent of the monthly average amount per person of the ordinary wages paid, in the case where they worked the prescribed working hours, to workers of the same kind at the same workplace as that worker in the fiscal year that includes the day on which the person was injured or contracted the disease (hereinafter referred to in this paragraph as the "average amount of pay in the fiscal year"), that ratio;

常時百人以上の労働者を使用する事業場において昭和二十二年九月一日から昭和二十六年三月三十一日までの間に業務上負傷し、又は疾病にかかつた者については、昭和二十七年一月から三月までの平均給与額が、その負傷し又は疾病にかかつた日の属する会計年度において当該労働者と同一の事業場の同種の労働者に対して所定労働時間労働した場合に支払われた通常の賃金の一箇月一人当り平均額(以下本項において会計年度における平均給与額という。)の百分の百二十をこえる場合は、その比率

for a person who was injured or contracted a disease in the course of employment during the period from September 1, 1947 to March 31, 1951 at a workplace that regularly employs 100 or more workers and who does not fall under the case referred to in the preceding item, if the average amount of pay for July through September 1952 exceeds 120 percent of the average amount of pay in the fiscal year, that ratio;

常時百人以上の労働者を使用する事業場において昭和二十二年九月一日から昭和二十六年三月三十一日までの間において業務上負傷し、又は疾病にかかつた者で前号の場合に該当しないものについては、昭和二十七年七月から九月までの平均給与額が、会計年度における平均給与額の百分の百二十をこえる場合は、その比率

for a person who was injured or contracted a disease in the course of employment in or after April 1951 at a workplace that regularly employs 100 or more workers, if the average amount of pay for July through September 1952 exceeds 120 percent of the average amount of pay for the quarter that includes the day on which that worker was injured or contracted the disease, that ratio;

常時百人以上の労働者を使用する事業場において昭和二十六年四月以後において業務上負傷し、又は疾病にかかつた者については、昭和二十七年七月から九月までの平均給与額が、当該労働者の負傷し、又は疾病にかかつた日の属する四半期の平均給与額の百分の百二十をこえる場合は、その比率

in the case where a person who was injured or contracted a disease in the course of employment at a workplace that regularly employs fewer than 100 workers falls under any of the preceding items, the ratio specified by order;

常時百人未満の労働者を使用する事業場において業務上負傷し、又は疾病にかかつた者が、前各号に該当する場合においては、命令で定める比率

for a person hired on a day-to-day basis, the ratio specified by order.

日々雇い入れられる者については、命令で定める比率
