第五条（資産の譲渡とみなされる行為に関する経過措置）
The provisions of Article 79, paragraph (1) (Acts Deemed to Be Transfers of Assets) of the New Order apply to the establishment of a land leasehold right or servitude prescribed in that paragraph that an individual carries out on or after the Effective Date, and the provisions then in force continue to govern the establishment of a land leasehold right or servitude prescribed in Article 79, paragraph (1) (Acts Deemed to Be Transfers of Assets) of the Former Order that an individual carried out before the Effective Date.
新令第七十九条第一項（資産の譲渡とみなされる行為）の規定は、個人が施行日以後に行う同項に規定する借地権又は地役権の設定について適用し、個人が施行日前に行った旧令第七十九条第一項（資産の譲渡とみなされる行為）に規定する借地権又は地役権の設定については、なお従前の例による。
