Supplementary Provisions, Article 3Transitional Measures Accompanying the Partial Amendment of the Hotel Business Act
第三条(旅館業法の一部改正に伴う経過措置)
For the time being, the prefectural governor (or the mayor of the city, in a city with a health center; or the mayor of the ward, in a special ward; the same applies hereinafter) must investigate the state of the business of a person that has succeeded to the status of hotelier pursuant to the provisions of Article 3-2, paragraph (1) of the new Hotel Business Act at least once within the period until six months have elapsed from the day on which that status was succeeded to.
都道府県知事(保健所を設置する市又は特別区にあっては、市長又は区長。以下同じ。)は、当分の間、新旅館業法第三条の二第一項の規定により営業者の地位を承継した者の業務の状況について、当該地位が承継された日から起算して六月を経過するまでの間において、少なくとも一回調査しなければならない。
For the time being, if a hotelier (meaning a hotelier prescribed in Article 3-2, paragraph (1) of the new Hotel Business Act) has refused to allow a person to lodge (meaning "to lodge" as prescribed in Article 2, paragraph (5) of the Hotel Business Act; the same applies in the following paragraph) on the grounds that the person falls under either item (i) or item (iii) of Article 5, paragraph (1) of the new Hotel Business Act, the hotelier is to record the reasons for doing so and other matters by the method that Order of the Ministry of Health, Labour and Welfare prescribes.
営業者(新旅館業法第三条の二第一項に規定する営業者をいう。)は、当分の間、新旅館業法第五条第一項第一号又は第三号のいずれかに該当することを理由に宿泊(旅館業法第二条第五項に規定する宿泊をいう。次項において同じ。)を拒んだときは、厚生労働省令で定める方法により、その理由等を記録しておくものとする。
The provisions of Article 6 of the new Hotel Business Act apply to a person who has begun to lodge at a hotel business facility on or after the day on which this Act comes into effect (hereinafter referred to as "the effective date"), and the provisions then in force continue to govern a person who lodged at a hotel business facility before the effective date (including a person who continues to lodge at the same hotel business facility on or after the effective date).
