第五十四条
A person to whom the surviving Pension Fund Association owes an obligation concerning the payment of the surviving Pension Fund Association old-age benefit pursuant to the provisions of Article 42, paragraph (3) or Article 43, paragraph (3) of the Supplementary Provisions (hereinafter referred to in this Article and in paragraph (1) of the following Article as a "post-effective-date Fund early leaver, etc.") may, where the person has acquired the status as a member of a surviving employees' pension Fund and the articles of Association of the surviving Pension Fund Association and that surviving employees' pension Fund provide in advance that the reserves specified by the articles of Association of the surviving Pension Fund Association (meaning the reserves to be appropriated for the surviving Pension Fund Association old-age benefit under Article 42, paragraph (3) or Article 43, paragraph (3) of the Supplementary Provisions; the same applies hereinafter in this Article and in paragraph (1) of the following Article) may be transferred from the surviving Pension Fund Association to that surviving employees' pension Fund, apply to the surviving Pension Fund Association for the transfer of those reserves; provided, however, that this does not apply where the post-effective-date Fund early leaver, etc. holds the right to receive the surviving Pension Fund Association old-age benefit under Article 42, paragraph (3) or Article 43, paragraph (3) of the Supplementary Provisions.
存続連合会が附則第四十二条第三項又は第四十三条第三項の規定により存続連合会老齢給付金の支給に関する義務を負っている者（以下この条及び次条第一項において「施行後基金中途脱退者等」という。）は、存続厚生年金基金の加入員の資格を取得した場合であって、存続連合会及び当該存続厚生年金基金の規約において、あらかじめ、存続連合会から当該存続厚生年金基金に存続連合会の規約で定める積立金（附則第四十二条第三項又は第四十三条第三項の存続連合会老齢給付金に充てるべき積立金をいう。以下この条及び次条第一項において同じ。）の移換ができる旨が定められているときは、存続連合会に当該積立金の移換を申し出ることができる。ただし、施行後基金中途脱退者等が附則第四十二条第三項又は第四十三条第三項の存続連合会老齢給付金の受給権を有するときは、この限りでない。
When an application has been made under the preceding paragraph, the surviving Pension Fund Association is to transfer to that surviving employees' pension Fund the reserves to which the application pertains.
