    The court may make a ruling for commencement of guardianship, curatorship or assistance (hereinafter collectively referred to as a "Ruling for Commencement of Guardianship, etc.") under Japanese law where a person who is to become an adult ward, person under curatorship or person undersubject to a ruling for commencement of assistance has domicile or residence in Japan or has Japanese nationality.

    裁判所は、成年被後見人、被保佐人又は被補助人補助開始の審判を受ける者となるべき者が日本に住所若しくは居所を有するとき又は日本の国籍を有するときは、日本法により、後見開始、保佐開始又は補助開始の審判（以下「後見開始の審判等」と総称する。）をすることができる。

    Guardianship, curatorship of a minor or assistance (hereinafter collectively referred to as "Guardianship of Minors, etc.") is governed by the national law of a ward, person under curatorshipminor ward or person under assistance (collectively referreda person subject to as a "Ward, etc." in paragraph (2))a ruling for commencement of assistance.

    後見、保佐未成年後見又は補助（以下「未成年後見等」と総称する。）は、未成年被後見人、被保佐人又は被補助人（次項において「被後見人等」と総称する。）又は補助開始の審判を受けた者の本国法による。

    Notwithstanding the provisions of the preceding paragraph, in the following cases where a foreign national is a Ward, etc.minor ward or a person subject to a ruling for commencement of assistance, a ruling of appointment of a guardian, curator of a minor or assistant and other ruling concerning Guardianship of Minors, etc. is governed by Japanese law:

    前項の規定にかかわらず、外国人が未成年被後見人等又は補助開始の審判を受けた者である場合であって、次に掲げるときは、未成年後見人、保佐人又は補助人の選任の審判その他の未成年後見等に関する審判については、日本法による。

    With regard to an adult ward, a guardian of an adult and a supervisor of a guardian of an adult prescribed in Article 2, paragraph (1) of the Supplementary Provisions of the Civil Code, etc. Amendment Act with respect to whom the provisions then in force continue to govern pursuant to the provisions of that paragraph, and a person under curatorship, a curator and a supervisor of a curator prescribed in Article 3, paragraph (1) of the Supplementary Provisions of the Civil Code, etc. Amendment Act with respect to whom the provisions then in force continue to govern pursuant to the provisions of that paragraph, the provisions then in force continue to govern, notwithstanding the provisions of the respective Acts as amended by this Act (including where those provisions are applied mutatis mutandis pursuant to other Acts).

    民法等改正法附則第二条第一項の規定によりなお従前の例によることとされる同項に規定する成年被後見人、成年後見人及び成年後見監督人並びに民法等改正法附則第三条第一項の規定によりなお従前の例によることとされる同項に規定する被保佐人、保佐人及び保佐監督人については、この法律による改正後のそれぞれの法律の規定（これらの規定を他の法律において準用する場合を含む。）にかかわらず、なお従前の例による。
