Article 57 · (Certificates for Minors)第五十七条年少者の証明書

    For a child employed pursuant to paragraph (2) of the preceding Article, an employer must keep at the workplace a certificate issued by the head of that child's school certifying that the employment does not hinder the child's attendance at school, or written consent from the person who has parental authority for, or is the legal guardian of a minor for, the child.

    使用者は、前条第二項の規定によつて使用する児童については、修学に差し支えないことを証明する学校長の証明書及び親権者又は未成年後見人の同意書を事業場に備え付けなければならない。

Article 58 · (Labor Contracts with Minors)第五十八条未成年者の労働契約

    It is prohibited for a person with parental authority over a minor or the legal guardian of a minor to enter into a labor contract in place of that minor.

    親権者又は未成年後見人は、未成年者に代つて労働契約を締結してはならない。

    A person with parental authority over a minor, the legal guardian of a minor, or the relevant government agency may cancel a labor contract prospectively if they consider it disadvantageous to the minor.

    親権者若しくは未成年後見人又は行政官庁は、労働契約が未成年者に不利であると認める場合においては、将来に向つてこれを解除することができる。

Article 59第五十九条

    A minor may claim their wages for themselves. It is prohibited for a person with parental authority over a minor or the legal guardian of a minor to collect the minor's wages in place of the minor.

    未成年者は、独立して賃金を請求することができる。親権者又は未成年後見人は、未成年者の賃金を代つて受け取つてはならない。

Article 121第百二十一条

    If a person violating this Act is an agent, employee, or other staff member who was acting on behalf of the person in control of the business in connection with a particular that concerns a worker at that business, the fine under the relevant Article is also assessed against the person in control of the business; provided, however, that this does not apply if the person in control of the business has taken the necessary measures to prevent the violation (if the person in control of the business is a juridical person, the representative thereof is deemed to be the person in control of the business; and if the person in control of the business is a minor or an adult ward without the same legal capacity to act as an adult in connection with that business or a person subject to a ruling appointing a specified assistant, the statutory representative thereof is deemed person in control of the business (if the statutory representative is a juridical person, the representative thereof). The same applies hereinafter in this Article).

    この法律の違反行為をした者が、当該事業の労働者に関する事項について、事業主のために行為した代理人、使用人その他の従業者である場合においては、事業主に対しても各本条の罰金刑を科する。ただし、事業主(事業主が法人である場合においてはその代表者、事業主が営業に関し成年者と同一の行為能力を有しない未成年者又は成年被後見人特定補助人を付する処分の審判を受けた者である場合においてはその法定代理人(法定代理人が法人であるときは、その代表者)を事業主とする。次項において同じ。)が違反の防止に必要な措置をした場合においては、この限りでない。

Supplementary Provisions, Article 2 · Transitional Measures Concerning Adult Wards, etc.附則第二条成年被後見人等に関する経過措置

    With regard to an adult ward, a guardian of an adult and a supervisor of a guardian of an adult prescribed in Article 2, paragraph (1) of the Supplementary Provisions of the Civil Code Amendment Act to whom the provisions then in force are to continue to apply pursuant to the provisions of that paragraph, and a person under curatorship, a curator and a supervisor of a curator prescribed in Article 3, paragraph (1) of the Supplementary Provisions of the Civil Code Amendment Act to whom the provisions then in force are to continue to apply pursuant to the provisions of that paragraph, the provisions then in force continue to govern, notwithstanding the provisions of the respective Acts as amended by this Act (including where those provisions are applied mutatis mutandis pursuant to other Acts).

    民法等改正法附則第二条第一項の規定によりなお従前の例によることとされる同項に規定する成年被後見人、成年後見人及び成年後見監督人並びに民法等改正法附則第三条第一項の規定によりなお従前の例によることとされる同項に規定する被保佐人、保佐人及び保佐監督人については、この法律による改正後のそれぞれの法律の規定(これらの規定を他の法律において準用する場合を含む。)にかかわらず、なお従前の例による。

Supplementary Provisions, Article 4 · Transitional Measures Concerning Penal Provisions附則第四条罰則に関する経過措置

    With regard to the application of penal provisions to acts committed before this Act comes into effect and to acts committed after this Act comes into effect in the cases where the provisions then in force are to continue to apply pursuant to the provisions of Article 2, paragraph (1) or Article 3, paragraph (1) of the Supplementary Provisions of the Civil Code Amendment Act, the provisions then in force continue to govern.

    この法律の施行前にした行為及び民法等改正法附則第二条第一項又は第三条第一項の規定によりなお従前の例によることとされる場合におけるこの法律の施行後にした行為に対する罰則の適用については、なお従前の例による。
