第六章の二 登録情報処理機関
第九十六条の二（登録）
The registration under Article 7, paragraph (4) (hereinafter referred to simply as "registration" in this Chapter) is made upon application by a person who intends to engage in the work of receiving the provision of the matters prescribed in Article 33, paragraph (4), Article 75, paragraph (5) or Article 94-5, paragraph (2) (including as applied mutatis mutandis pursuant to Article 94-5-2, paragraph (2)), confirming the identity of the person who provided them by a method prescribed by Order of the Ministry of Land, Infrastructure, Transport and Tourism and confirming other matters prescribed by Order of the Ministry of Land, Infrastructure, Transport and Tourism, and responding to inquiries from the Minister of Land, Infrastructure, Transport and Tourism under Article 7, paragraph (5) (including as applied mutatis mutandis pursuant to Article 59, paragraph (4)) and Article 94-5, paragraph (10) (including as applied mutatis mutandis pursuant to Article 94-5-2, paragraph (5)) (hereinafter referred to as "information processing services").
第七条第四項の登録（以下この章において単に「登録」という。）は、第三十三条第四項、第七十五条第五項又は第九十四条の五第二項（第九十四条の五の二第二項において準用する場合を含む。）に規定する事項の提供を受け、当該提供をした者について国土交通省令で定める方法による本人であることの確認その他の国土交通省令で定める事項の確認を行い、並びに第七条第五項（第五十九条第四項において準用する場合を含む。）及び第九十四条の五第十項（第九十四条の五の二第五項において準用する場合を含む。）の規定による国土交通大臣の照会に対して回答する業務（以下「情報処理業務」という。）を行おうとする者の申請により行う。
Article 96-3Disqualification Clause
第九十六条の三（欠格条項）
A person who falls under any of the following items cannot receive registration:
次の各号のいずれかに該当する者は、登録を受けることができない。
a person who has been sentenced to a fine or a heavier punishment for violating this Act or an order under this Act, and for whom two years have not yet passed since the day on which the person finished serving the sentence or ceased to be subject to its enforcement;
この法律又はこの法律に基づく命令に違反し、罰金以上の刑に処せられ、その執行を終わり、又は執行を受けることがなくなつた日から二年を経過しない者
a person whose registration has been revoked pursuant to Article 96-13 and for whom two years have not elapsed from the day of the revocation;
a juridical person any of whose officers conducting its business falls under either of the preceding two items.
法人であつて、その業務を行う役員のうちに前二号のいずれかに該当する者があるもの
Article 96-4Registration Criteria, etc.
第九十六条の四（登録基準等）
If a person who has applied for registration pursuant to Article 96-2 has computers and the programs necessary for information processing services, the Minister of Land, Infrastructure, Transport and Tourism must grant the registration. In this case, the procedures necessary for registration are prescribed by Order of the Ministry of Land, Infrastructure, Transport and Tourism.
Registration is to be made by entering the following matters in the register of registered information processing bodies:
登録は、登録情報処理機関登録簿に次に掲げる事項を記載してするものとする。
date of registration and registration number;
登録年月日及び登録番号
the name or title and address of the registered information processing body and, in the case of a juridical person, the name of its representative;
登録情報処理機関の氏名又は名称及び住所並びに法人にあつては、その代表者の氏名
the location of the place of business at which the registered information processing body performs information processing services;
characters, numbers, symbols and other codes for identifying the registered information processing body that is the source of transmission in automatic public transmission;
the classification of the matters prescribed in the provisions listed in the items of Article 7, paragraph (4) that the registered information processing body receives;
in addition to what is listed in the preceding items, matters prescribed by Order of the Ministry of Land, Infrastructure, Transport and Tourism.
前各号に掲げるもののほか、国土交通省令で定める事項
The Minister of Land, Infrastructure, Transport and Tourism must make the register of registered information processing bodies available for public inspection, as provided by Order of the Ministry of Land, Infrastructure, Transport and Tourism.
国土交通大臣は、国土交通省令で定めるところにより、登録情報処理機関登録簿を公衆の閲覧に供しなければならない。
A registered information processing body must make its name or title, the registration number entered in the register of registered information processing bodies, its terms and conditions and fees concerning information processing services, and other matters prescribed by Order of the Ministry of Land, Infrastructure, Transport and Tourism available for public inspection by automatic public transmission conducted by connecting to a telecommunications line.
Article 96-5Renewal of Registration
第九十六条の五（登録の更新）
Registration ceases to be effective upon the lapse of each period of five years or more and ten years or less specified by Cabinet Order, unless it is renewed for that period.
登録は、五年以上十年以内において政令で定める期間ごとにその更新を受けなければ、その期間の経過によつて、その効力を失う。
The provisions of the preceding three Articles apply mutatis mutandis to the renewal of a registration referred to in the preceding paragraph.
Article 96-6Obligations Relating to Performance of Services
第九十六条の六（業務の実施に係る義務）
When requested to perform information processing services, a registered information processing body must perform them without delay, except where there is a justifiable reason.
A registered information processing body must perform information processing services fairly and by a method that conforms to the standards prescribed by Order of the Ministry of Land, Infrastructure, Transport and Tourism.
A registered information processing body must not entrust all or part of its information processing services to another person, except in cases prescribed by Order of the Ministry of Land, Infrastructure, Transport and Tourism.
Article 96-7Filing Notification of a Change
第九十六条の七（変更の届出）
When a registered information processing body intends to change any of the matters listed in Article 96-4, paragraph (2), items (ii) through (iv) or (vi), it must notify the Minister of Land, Infrastructure, Transport and Tourism to that effect by two weeks before the day on which it intends to make the change.
登録情報処理機関は、第九十六条の四第二項第二号から第四号まで又は第六号に掲げる事項を変更しようとするときは、変更しようとする日の二週間前までに、その旨を国土交通大臣に届け出なければならない。
第九十六条の八（業務規程）
A registered information processing body must establish rules concerning the implementation of information processing services (hereinafter referred to as "operational rules") and notify the Minister of Land, Infrastructure, Transport and Tourism of them before commencing information processing services. The same applies when it intends to change them.
The operational rules must provide for the method of implementing information processing services, fees concerning information processing services and other matters prescribed by Order of the Ministry of Land, Infrastructure, Transport and Tourism.
Article 96-9Suspension or Discontinuance of Business
第九十六条の九（業務の休廃止）
When a registered information processing body intends to suspend or discontinue all or part of its information processing services, it must notify the Minister of Land, Infrastructure, Transport and Tourism to that effect in advance, as provided by Order of the Ministry of Land, Infrastructure, Transport and Tourism.
Article 96-10Preparation of Financial Statements and their Inspection
第九十六条の十（財務諸表等の備付け及び閲覧等）
Within three months after the end of each business year, a registered information processing body must prepare an inventory of property, a balance sheet, a profit and loss statement or statement of income and expenditure, and a business report for that business year (including, where an electronic or magnetic record (meaning a record made in an electronic form, magnetic form or any other form that cannot be perceived by human senses and is used for information processing by a computer; the same applies hereinafter in this Article) has been prepared in lieu of preparing them, that electronic or magnetic record; referred to as "financial statements, etc." in the following paragraph and Article 113), and keep them at its office for five years.
A person who intends to provide the matters prescribed in Article 33, paragraph (4), Article 75, paragraph (5) or Article 94-5, paragraph (2) (including as applied mutatis mutandis pursuant to Article 94-5-2, paragraph (2)) and other interested parties may make any of the following requests at any time during the business hours of the registered information processing body. However, in order to make a request under item (ii) or (iv), they must pay the costs determined by the registered information processing body.
第三十三条第四項、第七十五条第五項又は第九十四条の五第二項（第九十四条の五の二第二項において準用する場合を含む。）に規定する事項を提供しようとする者その他の利害関係人は、登録情報処理機関の業務時間内は、いつでも、次に掲げる請求をすることができる。ただし、第二号又は第四号の請求をするには、登録情報処理機関の定めた費用を支払わなければならない。
when financial statements, etc. have been prepared in written form, a request for inspection or copying of said documents;
財務諸表等が書面をもつて作成されているときは、当該書面の閲覧又は謄写の請求
a request for a certified transcript or abstract of the documents under the preceding item;
前号の書面の謄本又は抄本の請求
when financial statements, etc. have been prepared in the form of electronic or magnetic records, a request for inspection or copying of the output of matters recorded in said electronic or magnetic records as displayed by way of a method specified by an Order of the Ministry of Land, Infrastructure, Transport and Tourism;
a request for the provision of particulars recorded in the electronic or magnetic record under the preceding item by way of electronic or magnetic means specified by an Order of the Ministry of Land, Infrastructure, Transport and Tourism, or a request for the issuance of documents containing said matters.
第九十六条の十一（適合命令）
If the Minister of Land, Infrastructure, Transport and Tourism finds that a registered information processing body has ceased to conform to the provisions of Article 96-4, paragraph (1), the Minister may order that registered information processing body to take the measures necessary to conform to the provisions of that paragraph.
国土交通大臣は、登録情報処理機関が第九十六条の四第一項の規定に適合しなくなつたと認めるときは、その登録情報処理機関に対し、同項の規定に適合するため必要な措置をとるべきことを命ずることができる。
Article 96-12Order for Improvement
第九十六条の十二（改善命令）
If the Minister of Land, Infrastructure, Transport and Tourism finds that a registered information processing body is in violation of the provisions of Article 96-6, the Minister may order that registered information processing body to carry out information processing services, or to take the measures necessary for improving the methods of information processing services or other methods of business.
Article 96-13Revocation of Registration, etc.
第九十六条の十三（登録の取消し等）
If a registered information processing body falls under any of the following items, the Minister of Land, Infrastructure, Transport and Tourism may revoke its registration, or order the suspension of all or part of its information processing services for a specified period.
if it has come to fall under Article 96-3, item (i) or (iii);
第九十六条の三第一号又は第三号に該当するに至つたとき。
if it has violated the provisions of Articles 96-7 through 96-9, Article 96-10, paragraph (1), or the following Article;
第九十六条の七から第九十六条の九まで、第九十六条の十第一項又は次条の規定に違反したとき。
if it has refused, without justifiable grounds, a request under the items of Article 96-10, paragraph (2);
正当な理由がないのに第九十六条の十第二項各号の規定による請求を拒んだとき。
if it has violated an order under the provisions of the preceding two Articles;
前二条の規定による命令に違反したとき。
if it has received registration by wrongful means.
不正の手段により登録を受けたとき。
Article 96-14Maintenance of Record Book
第九十六条の十四（帳簿の記載）
A registered information processing body must, as provided by an Order of the Ministry of Land, Infrastructure, Transport and Tourism, keep books, enter in them the matters specified by an Order of the Ministry of Land, Infrastructure, Transport and Tourism concerning information processing services, and preserve them.
