Supplementary Provisions, Article 2Transitional Measures Concerning Existing Additives

第二条（既存添加物に関する経過措置）

The Minister of Health and Welfare must prepare a table stating the names of the following additives (excluding additives that are chemically synthesized compounds prescribed in Article 2, paragraph (3) of the Food Sanitation Act prior to the amendment under the provisions of Article 1 (hereinafter referred to as the "Former Food Sanitation Act"), and natural flavoring agents prescribed in Article 2, paragraph (3) of the Food Sanitation Act after the amendment under the provisions of Article 1 (hereinafter referred to as the "New Food Sanitation Act") and things that have been generally served for human consumption, and are used as additives) (hereinafter referred to as the "list of existing additives") and issue public notice of it within three months from the date of promulgation of this Act.

厚生大臣は、次に掲げる添加物（第一条の規定による改正前の食品衛生法（以下「旧食品衛生法」という。）第二条第三項に規定する化学的合成品たる添加物並びに第一条の規定による改正後の食品衛生法（以下「新食品衛生法」という。）第二条第三項に規定する天然香料及び一般に食品として飲食に供されている物であって添加物として使用されるものを除く。）の名称を記載した表（以下「既存添加物名簿」という。）を作成し、これをこの法律の公布の日から三月以内に公示しなければならない。

Additives that, at the time of promulgation of this Act, are actually being sold, or being manufactured, imported, processed, used, stored or displayed for the purpose of sale;

この法律の公布の際現に販売され、又は販売の用に供するために、製造され、輸入され、加工され、使用され、貯蔵され、若しくは陳列されている添加物

Additives contained in formulations or food that, at the time of promulgation of this Act, are actually being sold, or being manufactured, imported, processed, used, stored or displayed for the purpose of sale.

この法律の公布の際現に販売され、又は販売の用に供するために、製造され、輸入され、加工され、使用され、貯蔵され、若しくは陳列されている製剤又は食品に含まれる添加物

Any person who finds it necessary to correct the list of existing additives publicly notified pursuant to the provisions of the preceding paragraph may, as provided by Ministry of Health and Welfare Order, file an application to that effect with the Minister of Health and Welfare, only within six months from the date of that public notice.

何人も、前項の規定により公示された既存添加物名簿に関し、訂正する必要があると認めるときは、厚生省令で定めるところにより、その公示の日から六月以内に限り、その旨を厚生大臣に申し出ることができる。

In the case where an application under the preceding paragraph has been filed and the Minister of Health and Welfare finds that the application is well-founded, the Minister of Health and Welfare must add the name of the additive pertaining to the application to the list of existing additives or delete it from the list of existing additives, and notify the person who filed the application to that effect.

厚生大臣は、前項の申出があった場合において、その申出に理由があると認めるときは、その申出に係る添加物の名称を既存添加物名簿に追加し、又は既存添加物名簿から消除するとともに、その旨をその申出をした者に通知しなければならない。

The Minister of Health and Welfare must issue public notice of the list of existing additives to which additions or deletions have been made pursuant to the provisions of the preceding paragraph no later than one month before the day on which this Act comes into effect (hereinafter referred to as the "Effective Date").

厚生大臣は、前項の規定による追加又は消除を行った既存添加物名簿をこの法律の施行の日（以下「施行日」という。）の一月前までに公示しなければならない。
