附　則

Supplementary Provisions, Article 1

第一条

This Act comes into effect as of January 1, 1948.

この法律は、昭和二十三年一月一日から施行する。

Supplementary Provisions, Article 2

第二条

The following laws and regulations are repealed:

次に掲げる法令は、廃止する。

Act on Control of Foods and Drinks and Other Articles (Act No. 15 of 1900);

飲食物その他の物品取締に関する法律（明治三十三年法律第十五号）

Matter Concerning Enforcement of the Act on Control of Foods and Drinks and Other Articles and the Order on Control of Poisonous Foods and Drinks, etc. (Ministry of Health and Welfare Order No. 10 of 1947);

飲食物その他の物品取締に関する法律及び有毒飲食物等取締令の施行に関する件（昭和二十二年厚生省令第十号）

Regulations on Control of Foods and Drinks Businesses (Ministry of Health and Welfare Order No. 15 of 1947);

飲食物営業取締規則（昭和二十二年厚生省令第十五号）

Regulations on Control of Milk Businesses (Ministry of Home Affairs Order No. 37 of 1933);

Supplementary Provisions, Article 3

第三条

A person who, at the time this Act comes into effect, has obtained approval of business under the provisions of an order based on the Act on Control of Foods and Drinks and Other Articles prior to its repeal under the provisions of the preceding Article and is actually operating that business is deemed, in the case where that business is a business requiring approval under the provisions of Article 52, paragraph (1), to be a person who has obtained approval under the provisions of that paragraph.

この法律の施行の際現に前条の規定による廃止前の飲食物その他の物品取締に関する法律に基づく命令の規定による営業の許可を受けて当該営業を営んでいる者は、当該営業が第五十二条第一項の規定により許可を必要とする営業である場合においては、これを同項の規定による許可を受けた者とみなす。

The provisions of Article 52, paragraph (3) apply mutatis mutandis to the approval under the provisions of the preceding paragraph.

第五十二条第三項の規定は、前項の規定による許可について準用する。
