The date on which this Act comes into effect is specified by Imperial Ordinance.

①The Workers' Accident Relief Liability Insurance Act is abolished.

②With regard to the payment of insurance proceeds for accidents which occurred before the enforcement of this Act and the premiums pertaining to periods before the enforcement of this Act, the former Act continues to govern.

③With regard to the punishment of a person to whom the penal provisions of the former Act should have been applied before the enforcement of this Act, the former Act continues to govern.

④Premiums pertaining to the period after the enforcement of this Act which have already been paid by a person who, at the time of the enforcement of this Act, has actually concluded an insurance contract with the government for workers' accident relief liability insurance may be appropriated to the premiums of this insurance.

⑤In addition to what is prescribed in the preceding three paragraphs, the particulars necessary upon the abolition of the former Act are prescribed by order.

②The surviving family members who are eligible to receive a differential lump-sum payment of disability compensation pension are the persons specified in the following items. In this case, the order of priority of surviving family members who are to receive the differential lump-sum payment of disability compensation pension is in accordance with the order of the following items, and among the persons specified in each of those items, in accordance with the order in which they are listed in the respective items.

③The right to receive the payment of a differential lump-sum payment of disability compensation pension is extinguished by prescription when five years have elapsed from the time when it becomes exercisable.

④A differential lump-sum payment of disability compensation pension is deemed to be compensation benefits for surviving family for the purpose of applying the provisions of Article 10, and is deemed to be a lump-sum compensation payment for surviving family paid in the case referred to in Article 16-6, paragraph (1), item (ii) for the purpose of applying the provisions of Article 12, paragraph (3) and Article 20, paragraph (1) of the Premiums Collection Act.

⑤The provisions of Article 16-3, paragraph (2) and Article 16-9, paragraphs (1) and (2) apply mutatis mutandis to the differential lump-sum payment of disability compensation pension. In this case, the term "preceding paragraph" in Article 16-3, paragraph (2) is deemed to be replaced with "Article 58, paragraph (1)", and the term "Appended Table 1" is deemed to be replaced with "that paragraph".

①For the time being, with regard to the disability in the case where a worker gets injured or falls ill in the course of their duties and remains physically disabled after recovery, the government pays an advance lump-sum payment of disability compensation pension, as insurance proceeds, to a person who has the right to receive a disability compensation pension, based on their claim.

②The amount of an advance lump-sum payment of disability compensation pension is the amount specified by Order of the Ministry of Health, Labour and Welfare, up to the limit of the amount set forth in the right-hand column of the table in paragraph (1) of the preceding Article corresponding to the grade of disability pertaining to the relevant disability compensation pension set forth in the left-hand column of that table (if the claim set forth in the preceding paragraph is made in or after August of the year after the next fiscal year of the fiscal year to which the date on which the grounds for calculation occurred belongs, the amount that would be obtained if the basic daily payment amount obtained when the provisions of Article 8-4 are applied by deeming that advance lump-sum payment of disability compensation pension to be a disability compensation lump-sum payment were used as the basic daily payment amount in that table).

③If an advance lump-sum payment of disability compensation pension is paid, the payment of the disability compensation pension pertaining to the disability of the worker is suspended until the total amount of the amounts to be paid for each month reaches the amount of the advance lump-sum payment of disability compensation pension in accordance with the calculation method specified by Order of the Ministry of Health, Labour and Welfare.

④The right to receive the payment of an advance lump-sum payment of disability compensation pension is extinguished by prescription when two years have elapsed from the time when it becomes exercisable.

⑤An advance lump-sum payment of disability compensation pension is deemed to be a disability compensation pension for the purpose of applying the provisions of Article 12, paragraph (3) and Article 20, paragraph (1) of the Premiums Collection Act.

⑥While the payment of a disability compensation pension to be paid to a person who has received an advance lump-sum payment of disability compensation pension is suspended pursuant to the provisions of paragraph (3), the provisions of Article 36-2, paragraph (2) of the National Pension Act, Article 65, paragraph (2) of the National Pension Act prior to its amendment by Article 1 of the Act Partially Amending the National Pension Act, etc. (Act No. 34 of 1985; hereinafter referred to as "Act No. 34 of 1985" in this paragraph and paragraph (7) of the following Article) (hereinafter referred to as the "former National Pension Act" in this paragraph and paragraph (7) of the following Article), which is deemed to remain in force pursuant to the provisions of Article 32, paragraph (11) of the Supplementary Provisions of Act No. 34 of 1985 (including the cases where it is followed pursuant to Article 28, paragraph (10) of the Supplementary Provisions of Act No. 34 of 1985 and the cases where it is applied mutatis mutandis pursuant to Article 79-2, paragraph (5) of the former National Pension Act which is deemed to remain in force pursuant to the provisions of Article 32, paragraph (11) of the Supplementary Provisions of Act No. 34 of 1985; the same applies in paragraph (7) of the following Article), the proviso to Article 13-2, paragraph (2), item (i) of the Child Rearing Allowance Act (Act No. 238 of 1961), and the provisos to Article 3, paragraph (3), item (ii) and Article 17, item (i) of the Act on Special Child Rearing Allowance (Act No. 134 of 1964) do not apply to that disability compensation pension.

①For the time being, with regard to the death in the case where a worker dies in the course of their duties, the government pays an advance lump-sum payment of compensation pension for surviving family, as insurance proceeds, to a surviving family member who has the right to receive a compensation pension for surviving family, based on their claim.

②The amount of an advance lump-sum payment of compensation pension for surviving family is the amount specified by Order of the Ministry of Health, Labour and Welfare, up to the limit of the amount equivalent to 1,000 days of the basic daily payment amount (if the claim set forth in the preceding paragraph is made in or after August of the year after the next fiscal year of the fiscal year to which the date on which the grounds for calculation occurred belongs, the amount equivalent to the basic daily payment amount obtained when the provisions of Article 8-4 are applied by deeming that advance lump-sum payment of compensation pension for surviving family to be a lump-sum compensation payment for surviving family).

③If an advance lump-sum payment of compensation pension for surviving family is paid, the payment of the compensation pension for surviving family pertaining to the worker's death is suspended until the total amount of the amounts to be paid for each month reaches the amount of the advance lump-sum payment of compensation pension for surviving family in accordance with the calculation method specified by Order of the Ministry of Health, Labour and Welfare.

④With regard to the application of the provisions of Article 16-6 in the case where an advance lump-sum payment of compensation pension for surviving family has been paid, the term "amount of the compensation pension for surviving family" in paragraph (1), item (ii) of that Article is deemed to be replaced with "amount of the compensation pension for surviving family and the amount of the advance lump-sum payment of compensation pension for surviving family (if the grounds for paying that advance lump-sum payment of compensation pension for surviving family occurred in or before July of the fiscal year to which the date on which the right was extinguished belongs (if the month to which the date on which the right was extinguished belongs is any of the months from April through July, the previous fiscal year), the amount calculated pursuant to the provisions of Order of the Ministry of Health, Labour and Welfare in accordance with the method of calculating the amount of the compensation pension for surviving family under the provisions of the following paragraph)".

⑤The right to receive the payment of an advance lump-sum payment of compensation pension for surviving family is extinguished by prescription when two years have elapsed from the time when it becomes exercisable.

⑥An advance lump-sum payment of compensation pension for surviving family is deemed to be a compensation pension for surviving family for the purpose of applying the provisions of Article 12, paragraph (3) and Article 20, paragraph (1) of the Premiums Collection Act.

⑦While the payment of the compensation pension for surviving family to be paid to a person who has received an advance lump-sum payment of compensation pension for surviving family is suspended pursuant to the provisions of paragraph (3), the provisions of Article 36-2, paragraph (2) of the National Pension Act and Article 65, paragraph (2) of the former National Pension Act which is deemed to remain in force pursuant to the provisions of Article 32, paragraph (11) of the Supplementary Provisions of Act No. 34 of 1985, and the provisos to Article 13-2, paragraph (1), item (i) and paragraph (2), item (i) of the Child Rearing Allowance Act do not apply to that compensation pension for surviving family.

①For the time being, if a person who has the right to receive a disability pension for multiple-job workers dies, and the total amount of the amount of the disability pension for multiple-job workers paid to the person (for the disability pension for multiple-job workers paid, out of that disability pension for multiple-job workers, as the payment for the period up to July of the fiscal year to which the date of the death belongs (if the month to which the date of the death belongs is any of the months from April through July, the previous fiscal year; the same applies hereinafter in this paragraph), the amount calculated pursuant to the provisions of Order of the Ministry of Health, Labour and Welfare in the same manner as under the provisions of Article 16-6, paragraph (2)) and the amount of the advance lump-sum payment of disability pension for multiple-job workers pertaining to that disability pension for multiple-job workers (if the grounds for paying that advance lump-sum payment of disability pension for multiple-job workers occurred in or before July of the fiscal year to which the date of the death belongs, the amount calculated pursuant to the provisions of Order of the Ministry of Health, Labour and Welfare in accordance with the method of calculating the amount of the compensation pension for surviving family under the provisions of that paragraph) is less than the amount set forth in the right-hand column of the table in Article 58, paragraph (1) corresponding to the grade of disability pertaining to that disability pension for multiple-job workers set forth in the left-hand column of that table (if the date of the death is on or after August 1 of the year after the next fiscal year of the fiscal year to which the date on which the grounds for calculation occurred belongs, the amount that would be obtained if the amount calculated pursuant to the provisions of Order of the Ministry of Health, Labour and Welfare in the same manner as under the provisions of Article 8-3, paragraph (1) as applied mutatis mutandis pursuant to Article 8-4 were used as the basic daily payment amount in that table), the government pays to the surviving family members of that person, based on their claim, a differential lump-sum payment of disability pension for multiple-job workers in the amount equivalent to the difference, as insurance proceeds.

②The provisions of Article 16-3, paragraph (2), Article 16-9, paragraphs (1) and (2), and Article 58, paragraphs (2) and (3) apply mutatis mutandis to the differential lump-sum payment of disability pension for multiple-job workers. In this case, the term "preceding paragraph" in Article 16-3, paragraph (2) is deemed to be replaced with "Article 60-2, paragraph (1)", and the term "Appended Table 1" is deemed to be replaced with "that paragraph".

①For the time being, with regard to the disability in the case where a multiple-job worker gets injured or falls ill due to the work of two or more businesses in which the multiple-job worker is engaged and remains physically disabled after recovery, the government pays an advance lump-sum payment of disability pension for multiple-job workers, as insurance proceeds, to a person who has the right to receive a disability pension for multiple-job workers, based on their claim.

②The amount of an advance lump-sum payment of disability pension for multiple-job workers is the amount specified by Order of the Ministry of Health, Labour and Welfare prescribed in Article 59, paragraph (2), corresponding to the grade of disability pertaining to the relevant disability pension for multiple-job workers set forth in the left-hand column of the table in Article 58, paragraph (1).

③The provisions of Article 59, paragraphs (3), (4) and (6) apply mutatis mutandis to the advance lump-sum payment of disability pension for multiple-job workers. In this case, the term "disability compensation pension" in paragraphs (3) and (6) of that Article is deemed to be replaced with "disability pension for multiple-job workers".

①For the time being, with regard to the death in the case where a multiple-job worker dies due to the work of two or more businesses in which the multiple-job worker is engaged, the government pays an advance lump-sum payment of pension for surviving family of multiple-job workers, as insurance proceeds, to a surviving family member who has the right to receive a pension for surviving family of multiple-job workers, based on their claim.

②The amount of an advance lump-sum payment of pension for surviving family of multiple-job workers is the amount specified by Order of the Ministry of Health, Labour and Welfare prescribed in Article 60, paragraph (2).

③With regard to the application of the provisions of Article 16-6 as replaced pursuant to the provisions of Article 20-6, paragraph (3) in the case where an advance lump-sum payment of pension for surviving family of multiple-job workers has been paid, the term "amount of the pension for surviving family of multiple-job workers" in paragraph (1), item (ii) of that Article is deemed to be replaced with "amount of the pension for surviving family of multiple-job workers and the amount of the advance lump-sum payment of pension for surviving family of multiple-job workers (if the grounds for paying that advance lump-sum payment of pension for surviving family of multiple-job workers occurred in or before July of the fiscal year to which the date on which the right was extinguished belongs (if the month to which the date on which the right was extinguished belongs is any of the months from April through July, the previous fiscal year), the amount calculated pursuant to the provisions of Order of the Ministry of Health, Labour and Welfare in accordance with the method of calculating the amount of the pension for surviving family of multiple-job workers under the provisions of the following paragraph)".

④The provisions of Article 60, paragraphs (3), (5) and (7) apply mutatis mutandis to the advance lump-sum payment of pension for surviving family of multiple-job workers. In this case, the term "compensation pension for surviving family" in paragraph (3) of that Article is deemed to be replaced with "pension for surviving family of multiple-job workers", and the terms "the compensation pension for surviving family" and "that compensation pension for surviving family" in paragraph (7) of that Article are deemed to be replaced with "the pension for surviving family of multiple-job workers" and "that pension for surviving family of multiple-job workers", respectively.

①For the time being, if a person who has the right to receive a disability pension dies, and the total amount of the amount of the disability pension paid to the person (for the disability pension paid, out of that disability pension, as the payment for the period up to July of the fiscal year to which the date of the death belongs (if the month to which the date of the death belongs is any of the months from April through July, the previous fiscal year; the same applies hereinafter in this paragraph), the amount calculated pursuant to the provisions of Order of the Ministry of Health, Labour and Welfare in the same manner as under the provisions of Article 16-6, paragraph (2)) and the amount of the advance lump-sum payment of disability pension pertaining to that disability pension (if the grounds for paying that advance lump-sum payment of disability pension occurred in or before July of the fiscal year to which the date of the death belongs, the amount calculated pursuant to the provisions of Order of the Ministry of Health, Labour and Welfare in accordance with the method of calculating the amount of the compensation pension for surviving family under the provisions of that paragraph) is less than the amount set forth in the right-hand column of the table in Article 58, paragraph (1) corresponding to the grade of disability pertaining to that disability pension set forth in the left-hand column of that table (if the date of the death is on or after August 1 of the year after the next fiscal year of the fiscal year to which the date on which the grounds for calculation occurred belongs, the amount that would be obtained if the amount calculated pursuant to the provisions of Order of the Ministry of Health, Labour and Welfare in the same manner as under the provisions of Article 8-3, paragraph (1) as applied mutatis mutandis pursuant to Article 8-4 were used as the basic daily payment amount in that table), the government pays to the surviving family members of that person, based on their claim, a differential lump-sum payment of disability pension in the amount equivalent to the difference, as insurance proceeds.

②A differential lump-sum payment of disability pension is deemed to be a benefit for surviving family for the purpose of applying the provisions of Article 10.

③The provisions of Article 16-3, paragraph (2), Article 16-9, paragraphs (1) and (2), and Article 58, paragraphs (2) and (3) apply mutatis mutandis to the differential lump-sum payment of disability pension. In this case, the term "preceding paragraph" in Article 16-3, paragraph (2) is deemed to be replaced with "Article 61, paragraph (1)", and the term "Appended Table 1" is deemed to be replaced with "that paragraph".

①For the time being, with regard to the disability in the case where a worker gets injured or falls ill while commuting to or from work and remains physically disabled after recovery, the government pays an advance lump-sum payment of disability pension, as insurance proceeds, to a person who has the right to receive a disability pension, based on their claim.

②The amount of an advance lump-sum payment of disability pension is the amount specified by Order of the Ministry of Health, Labour and Welfare prescribed in Article 59, paragraph (2), corresponding to the grade of disability pertaining to the relevant disability pension set forth in the left-hand column of the table in Article 58, paragraph (1).

③The provisions of Article 59, paragraphs (3), (4) and (6) apply mutatis mutandis to the advance lump-sum payment of disability pension. In this case, the term "disability compensation pension" in paragraphs (3) and (6) of that Article is deemed to be replaced with "disability pension".

①For the time being, with regard to the death in the case where a worker dies while commuting to or from work, the government pays an advance lump-sum payment of pension for surviving family, as insurance proceeds, to a surviving family member who has the right to receive a pension for surviving family, based on their claim.

②The amount of an advance lump-sum payment of pension for surviving family is the amount specified by Order of the Ministry of Health, Labour and Welfare prescribed in Article 60, paragraph (2).

③The provisions of Article 60, paragraphs (3) through (5) and (7) apply mutatis mutandis to the advance lump-sum payment of pension for surviving family. In this case, the term "compensation pension for surviving family" in paragraph (3) of that Article is deemed to be replaced with "pension for surviving family", the terms "Article 16-6" and "amount of the compensation pension for surviving family" in paragraph (4) of that Article are deemed to be replaced with "Article 16-6 as replaced pursuant to the provisions of Article 22-4, paragraph (3)" and "amount of the pension for surviving family", respectively, and the terms "the compensation pension for surviving family" and "that compensation pension for surviving family" in paragraph (7) of that Article are deemed to be replaced with "the pension for surviving family" and "that pension for surviving family", respectively.

①Where a worker or their surviving family members are to receive a disability compensation pension or a compensation pension for surviving family, a disability pension for multiple-job workers or a pension for surviving family of multiple-job workers, or a disability pension or a pension for surviving family (hereinafter referred to as a "pension benefit" in this Article) (limited to cases where, at the time when they came to have the right to receive the pension benefit, they may claim an advance lump-sum payment of disability compensation pension or an advance lump-sum payment of compensation pension for surviving family, an advance lump-sum payment of disability pension for multiple-job workers or an advance lump-sum payment of pension for surviving family of multiple-job workers, or an advance lump-sum payment of disability pension or an advance lump-sum payment of pension for surviving family pertaining to the pension benefit (hereinafter referred to as an "advance lump-sum payment benefit" in this Article)), and they may receive, for the same reason, compensation for damages under the Civil Code or other laws (hereinafter simply referred to as "compensation for damages", limited to the part that compensates for the damage compensated for by the pension benefit) from the employer that hires or hired the worker, the compensation for damages is, for the time being, to be governed by the following provisions:

②Where a worker or their surviving family members may receive compensation for damages from the employer that hires or hired the worker, and have received, for the same reason, compensation for damages (limited to the part that compensates for the damage compensated for by the insurance proceeds) when they are to receive insurance proceeds, the government may decide not to pay the insurance proceeds, at a maximum of the amount of the compensation, in accordance with the standards specified by the Minister of Health, Labour and Welfare after hearing the opinion of the Labor Policy Council; provided, however, that this does not apply to the following insurance proceeds in the case where they are to receive the pension benefit prescribed in the preceding paragraph:
