What this law does
- Technical intern training (技能実習) is carried out under a technical intern training plan (技能実習計画), drawn up for each trainee by the person or company in Japan that will host the training and accredited (認定) as appropriate by the Commissioner of the Immigration Services Agency and the Minister of Health, Labour and Welfare — or by the Organization for Technical Intern Training (外国人技能実習機構) where they hand that work to it. The plan sets out the stage of training, its goals, content and period, the trainee's pay, working hours, holidays, leave and housing, the food and housing costs the trainee bears, and, where a supervising organization (監理団体) oversees the training, which one; such a plan must be drawn up under that organization's guidance. This is the rule until 31 March 2027.(Art. 2(1), Art. 2(7), Art. 2(8), Art. 8(1), Art. 8(2), Art. 8(4), Art. 12(1), Art. 12(3)) (the provisions it rests on)

- Employment for skill development (育成就労) is carried out under a plan (育成就労計画) drawn up for each foreign national by the person or company in Japan that will employ them and accredited (認定) as appropriate by the Commissioner of the Immigration Services Agency and the Minister of Health, Labour and Welfare — or by the Employment-for-Skill-Development Organization (外国人育成就労機構) where they hand that work to it; where the foreign national is to work on dispatch (労働者派遣等), the dispatching employer and the client businesses draw up the plan together. The plan sets out the work, the skills and Japanese-language ability aimed at, the start and end dates, the foreign national's pay, working hours, holidays, leave and housing, the food and housing costs they bear, and, where a supervising and support organization (監理支援機関) oversees the employment, which one; such a plan must be drawn up under that organization's guidance. This is the rule from 1 April 2027.(Art. 2(1)(i), Art. 2(1)(iii), Art. 8(1), Art. 8(2), Art. 8(3), Art. 8(5)(i), Art. 12(1), Art. 12(3)) (the provisions it rests on)
- A plan is accredited only if, among other conditions, the skills are hard to acquire in the trainee's home country, the training lasts no more than one year in its first stage (第1号) and no more than two years in its second (第2号) or third (第3号) stage, a trainee entering the second or third stage has passed the skills test (技能検定) or evaluation exam the previous stage's plan set as its goal, and the trainee is paid at least what a Japanese person doing the work would be paid. The third stage is open only to hosts meeting a high standard an order of the competent ministers (主務省令) sets and, where the training is supervised, only under a supervising organization holding a general licence (一般監理事業). No one can be accredited within five years of finishing a sentence of imprisonment () or of having an earlier accreditation revoked, among other grounds. This is the rule until 31 March 2027.(Art. 9(1)(i), Art. 9(1)(iii), Art. 9(1)(iv), Art. 9(1)(viii), Art. 9(1)(ix), Art. 9(1)(x), Art. 8(4), Art. 10(1)(i), Art. 10(1)(vii)) (the provisions it rests on)
- A plan is accredited only if, among other conditions, the work needs skills in a field an order of the competent ministers (主務省令) names among the Specified Skilled Worker (特定技能) fields, the employment lasts no more than three years, the foreign national's skills and Japanese-language ability are assessed before it ends, the pay is at least what a Japanese person doing the work would be paid, and any fees the foreign national paid a sending agency abroad meet criteria such an order sets. The period can be extended to four years through an accredited change to the plan, in cases such an order names as good reason. No one can be accredited within five years of finishing a sentence of imprisonment (拘禁刑) or — with exceptions such an order sets for jointly run or dispatch arrangements — of having an earlier accreditation revoked, among other grounds. This is the rule from 1 April 2027.(Art. 2(1)(ii), Art. 9(1)(i), Art. 9(1)(iii), Art. 9(1)(iv), Art. 9(1)(ix), Art. 9(1)(xi), Art. 11(1), Art. 11(2), Art. 10(1)(i), Art. 10(1)(vii)) (the provisions it rests on)
- Anyone who wants to run, as a business, arranging trainees' employment and overseeing their hosts (監理事業) needs a licence from the competent ministers (主務大臣), and only a non-profit corporation in Japan of a kind an order of the competent ministers (主務省令) names can be granted one: a general licence (一般監理事業), or a specified licence (特定監理事業) limited to hosts that run only the first and second stages. The licence lasts a period a Cabinet Order sets, at least three years, and must be renewed to carry on. A supervising organization may take no fee or reward of any kind for this business from hosts, trainees, people seeking to become either, or anyone else, except supervision fees (監理費) of kinds and amounts such an order sets, charged to hosts or would-be hosts after showing them the use and the amount in advance. This is the rule until 31 March 2027.(Art. 2(9), Art. 2(10), Art. 23(1), Art. 25(1)(i), Art. 31(1), Art. 31(2), Art. 28(1), Art. 28(2)) (the provisions it rests on)
- Anyone who wants to run, as a business, arranging foreign nationals' employment and overseeing their employers (監理支援事業) needs a licence from the competent ministers (主務大臣), and only a non-profit corporation in Japan of a kind an order of the competent ministers (主務省令) names can be granted one; besides its own auditors' audit, it must have someone without close ties to the employers it oversees, who meets requirements such an order sets, audit how its officers carry out that business. The licence lasts a period a Cabinet Order sets — at least three years, or at least five where the competent ministers find the organization meets standards such an order sets for its audits and other work — and must be renewed to carry on. A supervising and support organization may take no fee or reward of any kind for this business from employers, foreign nationals or anyone else, except supervision and support fees (監理支援費) of kinds and amounts such an order sets, charged to employers or would-be employers after showing them the use and the amount. This is the rule from 1 April 2027.(Art. 2(1)(x), Art. 2(1)(xi), Art. 23(1), Art. 25(1)(i), Art. 25(1)(v), Art. 31(1), Art. 31(2), Art. 28(1), Art. 28(2)) (the provisions it rests on)
- A supervising organization must oversee the training according to the accredited plan, audit the hosts it supervises to standards an order of the competent ministers sets, and report each audit to the Commissioner of the Immigration Services Agency and the Minister of Health, Labour and Welfare. Through a supervision manager (監理責任者) at each office, it must guide hosts so that they do not break the Labor Standards Act, the Industrial Safety and Health Act or other labour laws in the training; where a host does break them, it must have the manager instruct the host to put it right and promptly report that to the relevant government bodies. This is the rule until 31 March 2027.(Art. 39(1), Art. 39(3), Art. 42(1), Art. 40(1), Art. 40(3), Art. 40(4), Art. 40(5)) (the provisions it rests on)
- A supervising and support organization must oversee the employment according to the accredited plan, audit the employers it oversees to standards an order of the competent ministers sets, report each audit to the Commissioner of the Immigration Services Agency and the Minister of Health, Labour and Welfare, and keep officers and staff closely tied to an employer out of the duties such an order names. Through a supervision and support manager (監理支援責任者) at each office, it must guide employers so that they do not break the Labor Standards Act, the Industrial Safety and Health Act or other labour laws; where an employer does break them, it must have the manager instruct the employer to put it right and promptly report that to the relevant government bodies. This is the rule from 1 April 2027.(Art. 39(1), Art. 39(4), Art. 39(5), Art. 42(1), Art. 40(1), Art. 40(3), Art. 40(4), Art. 40(5)) (the provisions it rests on)
- No one who supervises training (実習監理), nor their officers or staff, may force a trainee to train against their will by violence, threats, confinement or any other means that unfairly restrict mental or physical freedom. Nor may they make a contract with a trainee or would-be trainee, or with their spouse, lineal or cohabiting relatives or others close to them, setting a penalty or fixed damages for breaking a training contract, or have a trainee sign a savings contract alongside the training contract, or contract to manage a trainee's savings. Anyone who has trainees train, anyone who supervises them, and their officers and staff may not keep a trainee's passport or residence card (在留カード), or unfairly restrict a trainee's going out or other freedom in private life. This is the rule until 31 March 2027.(Art. 46(1), Art. 47(1), Art. 47(2), Art. 48(1), Art. 48(2)) (the provisions it rests on)
- No supervising and support organization or other person who provides supervision and support (監理支援), nor their officers or staff, may force a foreign national to work against their will by violence, threats, confinement or any other means that unfairly restrict mental or physical freedom. Nor may they make a contract with a foreign national employed or to be employed, or with their spouse, lineal or cohabiting relatives or others close to them, setting a penalty or fixed damages for breaking an employment-for-skill-development contract, or have them sign a savings contract alongside it, or contract to manage their savings. Employers, anyone seeking to employ such foreign nationals, supervisors and their officers and staff may not keep the passport or residence card (在留カード) of a foreign national employed or to be employed, or unfairly restrict their going out or other freedom in private life. This is the rule from 1 April 2027.(Art. 46(1), Art. 47(1), Art. 47(2), Art. 48(1), Art. 48(2)) (the provisions it rests on)
- A host that can no longer have a trainee continue training must report it without delay to the Commissioner of the Immigration Services Agency and the Minister of Health, Labour and Welfare or, where a supervising organization oversees the training, to that organization, which reports it on; a supervising organization must also notify them a month before stopping or suspending its business. In each case the host or supervising organization must work with other hosts, supervising organizations and others so that a trainee who wants to continue training can do so.This is the rule until 31 March 2027.(Art. 19(1), Art. 19(2), Art. 33(1), Art. 34(1), Art. 51(1)) (the provisions it rests on)
- A foreign national who wants to change employer may say so in writing to their employer, to its supervising and support organization, or to the Commissioner of the Immigration Services Agency and the Minister of Health, Labour and Welfare; the Employment-for-Skill-Development Organization must then offer them advice and help, including job placement, and the supervising and support organization must work with other employers and others so they can carry on. A new employer's plan for them is accredited only for the same skill and field and within three years in all (four where the period has been extended), and — unless an order of the competent ministers (主務省令) recognises unavoidable circumstances — only once they have worked for the employer they are leaving longer than a period of one to two years such an order sets and meet its standards on skills and Japanese, and the new employer meets its standards too. The same duty to help a foreign national who wants to carry on applies when an employer can no longer continue the employment and when a supervising and support organization stops its business; and when the employer's accreditation is revoked, the supervising and support organization must help a foreign national who wants to be taken on again. This is the rule from 1 April 2027.(Art. 8-2(1), Art. 8-4(3), Art. 8-4(5), Art. 8-5(1), Art. 9-2(1)(ii), Art. 9-2(1)(iii), Art. 9-2(1)(iv), Art. 51(1), Art. 51(2)) (the provisions it rests on)

It applies to
- People and companies in Japan that have foreign nationals do technical intern training under an accredited plan (実習実施者): either by taking on staff of their own overseas offices, or of a foreign organization with close ties to them, for individual-enterprise-type training (企業単独型), or by taking on trainees through a supervising organization for supervising-organization-type training (団体監理型).This is the rule until 31 March 2027.(Art. 2(2)(i), Art. 2(4)(i), Art. 2(6), Art. 2(7), Art. 2(8), Art. 8(1)) (the provisions it rests on)

The second also covers a business employing staff of a foreign business with close trading ties to it, of a kind an order of the competent ministers (主務省令) names, and, in fields with seasonal work such an order names, dispatching employers (派遣元事業主等) and the client businesses (派遣先) they send foreign nationals to, which draw up the plan together. This is the rule from 1 April 2027.(Art. 2(1)(ii), Art. 2(1)(iii)(a), Art. 2(1)(iii)(b), Art. 2(1)(vii), Art. 2(1)(viii), Art. 2(1)(ix), Art. 2(1)(x), Art. 8(1), Art. 8(2)) (the provisions it rests on)
4 more
- Non-profit corporations in Japan licensed to arrange trainees' employment and oversee their hosts (監理団体). The bans on forced training and on penalty and savings contracts bind anyone who supervises training (実習監理を行う者), and their officers and staff. This is the rule until 31 March 2027.(Art. 2(9), Art. 2(10), Art. 46(1), Art. 47(1), Art. 47(2)) (the provisions it rests on)
- Non-profit corporations in Japan licensed to arrange foreign nationals' employment and oversee their employers (監理支援機関). The bans on forced work and on penalty and savings contracts bind anyone who provides supervision and support (監理支援を行う者), and their officers and staff. This is the rule from 1 April 2027.(Art. 2(1)(x), Art. 2(1)(xi), Art. 46(1), Art. 47(1), Art. 47(2)) (the provisions it rests on)
- Foreign nationals in Japan doing technical intern training under the Technical Intern Training status of residence (在留資格), in one of three stages. The Act protects them, and asks them to devote themselves to the training, acquire the skills and work to take them back to their home country. This is the rule until 31 March 2027.(Art. 2(2), Art. 2(3), Art. 2(4), Art. 2(5), Art. 3(1), Art. 6(1)) (the provisions it rests on)

Special rules and exceptions (5)
- A supervising organization may run a job placement business matching only the hosts and trainees it supervises without the licence or permission Articles 30(1) and 33(1) of the Employment Security Act (職業安定法) otherwise require, though listed parts of that Act still apply to it, with the competent ministers in place of the Minister of Health, Labour and Welfare. This is the rule until 31 March 2027.(Art. 27(1), Art. 27(2)) (the provisions it rests on)
- A supervising and support organization may run a job placement business matching only the employers it oversees (other than client businesses under dispatch) and the foreign nationals it supports without the licence or permission Articles 30(1) and 33(1) of the Employment Security Act (職業安定法) otherwise require, though listed parts of that Act still apply to it, with the competent ministers in place of the Minister of Health, Labour and Welfare. The Employment-for-Skill-Development Organization may also run a job placement service matching only employers and would-be employers with foreign nationals employed or to be employed, without the permission Article 33(1) of that Act or Article 34(1) of the Mariners' Employment Security Act (船員職業安定法) requires. This is the rule from 1 April 2027.(Art. 27(1), Art. 27(2), Art. 87-2(1)) (the provisions it rests on)
- Technical intern training already under way under a plan accredited before the employment-for-skill-development rules came into force, and training under a plan applied for before then that starts within three months of that day, continue under the technical intern training rules as they stood before (なお従前の例). So does the work on that training of a body that was a supervising organization on that day, with its licence's period, renewal and change of category; and a plan for a trainee who completes the first stage of that training to go on to the second, or who completes the second and whom an order of the competent ministers (主務省令) names as suitable to go on to the third, is also accredited under those rules. Trainees in Japan with the Technical Intern Training status of residence (在留資格) on that day keep their status and period of stay under the earlier rules, and penalties for acts in that training follow those rules too. This is the rule from 1 April 2027.(Suppl. Prov. Art. 9(1), Suppl. Prov. Art. 9(2), Suppl. Prov. Art. 9(3), Suppl. Prov. Art. 10(1), Suppl. Prov. Art. 10(2), Suppl. Prov. Art. 8(1), Suppl. Prov. Art. 22(1)) (the provisions it rests on)
- An organization licensed for supervision and support once the employment-for-skill-development rules are in force is treated as holding a general licence (一般監理事業) and can supervise technical intern training that continues under the earlier rules, which govern that work in everything but the licence itself. This is the rule from 1 April 2027.(Suppl. Prov. Art. 13(1)) (the provisions it rests on)
- For a new employment-for-skill-development plan, a foreign national who once did technical intern training is treated as someone whose employment for skill development has ended, with the training time counted as time in it, so the plan is judged under Articles 8-6 and 9-3 as the 附則 (supplementary provisions) reads them — within three years in all and, among other conditions, in a skill an order of the competent ministers (主務省令) names as closely related to the earlier training. Article 8-6 does not apply at all to someone who did technical intern training kept under the earlier rules, unless they have since left Japan in a way that ended their re-entry permit and done no technical intern training after. None of this applies to a former trainee such an order names as suitable given the earlier plan's goals and content who either never did training kept under the earlier rules or left Japan in that way after it and did no training since. This is the rule from 1 April 2027.(Suppl. Prov. Art. 11(1), Suppl. Prov. Art. 11(2), Suppl. Prov. Art. 11(3), Art. 8-6(1), Art. 9-3(1)) (the provisions it rests on)
How it is enforced (16)
- The competent ministers (主務大臣) under this Act are the Minister of Justice and the Minister of Health, Labour and Welfare; they set the basic policy (基本方針) on technical intern training, license supervising organizations, and can require reports, inspect and give orders. The Act gives the decisions on training plans to the Commissioner of the Immigration Services Agency (出入国在留管理庁長官) and the Minister of Health, Labour and Welfare jointly, and a Cabinet Order can delegate the Minister of Justice's other powers to the Commissioner, apart from those on the basic policy and those delegated to the Minister of Land, Infrastructure, Transport and Tourism. The Commissioner and the Minister of Health, Labour and Welfare can pass their powers to their regional offices, as an order of the competent ministers (主務省令) sets. This is the rule until 31 March 2027.(Art. 103(1), Art. 7(1), Art. 23(1), Art. 13(1), Art. 36(1), Art. 8(1), Art. 9(1), Art. 104(1), Art. 104(5), Art. 104(6)) (the provisions it rests on)
- The competent ministers (主務大臣) under this Act are the Minister of Justice and the Minister of Health, Labour and Welfare; they draft the basic policy (基本方針) the Cabinet adopts, set an operating policy (分野別運用方針) for each field together with the government bodies in charge of it and others, license supervising and support organizations, and can require reports, inspect and give orders. Where the head of the body in charge of a field finds the workers it needs have been secured and asks them to, the competent ministers suspend accreditations in that field for a time, except for foreign nationals already in employment for skill development or whose accreditation was revoked, and may resume them when that head finds the field short of workers again and asks. The Act gives the decisions on plans to the Commissioner of the Immigration Services Agency (出入国在留管理庁長官) and the Minister of Health, Labour and Welfare jointly; a Cabinet Order can delegate most of the Minister of Justice's other powers to the Commissioner, and the Commissioner and the Minister of Health, Labour and Welfare can pass their powers to their regional offices. This is the rule from 1 April 2027.(Art. 103(1), Art. 7(1), Art. 7(3), Art. 7-2(1), Art. 23(1), Art. 13(1), Art. 36(1), Art. 12-2(1), Art. 12-2(2), Art. 12-2(3), Art. 12-2(4), Art. 8(1), Art. 104(5), Art. 104(6)) (the provisions it rests on)
- The Organization for Technical Intern Training (外国人技能実習機構), a single corporation the competent ministers supervise, can be given the accreditation of plans, the questioning and inspection of hosts and supervising organizations that goes with it, the fact-finding on licence applications, and the receipt of notifications and reports. It also gives trainees consultation, information and advice, and helps a trainee whose training has become hard to continue to carry on with it, giving hosts and supervising organizations guidance to that end. This is the rule until 31 March 2027.(Art. 57(1), Art. 59(1), Art. 99(1), Art. 12(1), Art. 14(1), Art. 24(1), Art. 18(1), Art. 87(1)(ii), Art. 87(1)(iii)) (the provisions it rests on)
- The Employment-for-Skill-Development Organization (外国人育成就労機構), a single corporation the competent ministers supervise, takes over all the rights and duties of the Organization for Technical Intern Training, which is dissolved. It can be given the accreditation of plans, the questioning and inspection of employers and supervising and support organizations that goes with it, the fact-finding on licence applications, and the receipt of notifications, reports and requests to change employer. It also gives foreign nationals consultation, information and advice, and may run a job placement service (職業紹介) matching them only with employers in the system so that they can start or carry on employment for skill development. This is the rule from 1 April 2027.(Suppl. Prov. Art. 15(4), Art. 57(1), Art. 59(1), Art. 99(1), Art. 8-3(1), Art. 12(1), Art. 14(1), Art. 24(1), Art. 87(1)(ii), Art. 87(1)(iii), Art. 87-2(1)) (the provisions it rests on)
- The competent ministers can, so far as needed to enforce the Act's rules on training plans, require hosts, supervising organizations and their officers and staff, past or present, to report and produce records, and have officials question people and enter and inspect workplaces; these powers are not for criminal investigation. The Commissioner of the Immigration Services Agency and the Minister of Health, Labour and Welfare can order a host that is not following its accredited plan, or that has broken this Act or an immigration or labour law, to put things right by a deadline where needed to keep the training proper. They can revoke the accreditation where, among other grounds, the host does not follow the plan, the plan no longer meets the criteria, or the host disobeys such an order or obstructs an inspection, and they must publish orders and revocations. This is the rule until 31 March 2027.(Art. 13(1), Art. 13(3), Art. 15(1), Art. 15(2), Art. 16(1), Art. 16(2)) (the provisions it rests on)
- The competent ministers can, so far as needed to enforce the Act's rules on employment plans, require employers, supervising and support organizations and their officers and staff, past or present, to report and produce records, and have officials question people and enter and inspect workplaces; these powers are not for criminal investigation. The Commissioner of the Immigration Services Agency and the Minister of Health, Labour and Welfare can order an employer that is not following its accredited plan, or that has broken this Act or an immigration or labour law, to put things right by a deadline where needed to keep the employment proper. They can revoke the accreditation where, among other grounds, the employer does not follow the plan, the plan no longer meets the criteria, or the employer disobeys such an order or obstructs an inspection, and they must publish orders and revocations. This is the rule from 1 April 2027.(Art. 13(1), Art. 13(3), Art. 15(1), Art. 15(2), Art. 16(1), Art. 16(2)) (the provisions it rests on)
