What this law does
- A descendant who comes to stay in Japan by birth or another event applies for the special permission for permanent residence at the municipal office on Form 1, with a photograph taken within the previous six months that meets Appended Table I, a document showing birth in Japan (or the other event) and one showing descent from a person who lost Japanese nationality under the Treaty of Peace with Japan. Someone staying under a status of residence (在留資格) who applies under Article 5 of the Act uses Form 2, with a photograph and a document showing they belong to that group, and shows their residence card (在留カード). The Commissioner of the Immigration Services Agency (出入国在留管理庁長官) must grant the permission to a descendant who comes to stay by birth or another event if they apply within 60 days of that event.(Art. 1(1), Art. 1(1)(i), Art. 1(1)(ii), Art. 1(1)(iii), Art. 1(1)(iv), Art. 1(1)(v), Art. 2(1), Art. 2(2), Art. 2(3), Appended Table 1, Special Act on the Immigration Control of, inter alia, those who have lost Japanese Nationality pursuant to the Treaty of Peace with Japan Art. 4(3), Special Act on the Immigration Control of, inter alia, those who have lost Japanese Nationality pursuant to the Treaty of Peace with Japan Art. 5(3), Special Act on the Immigration Control of, inter alia, those who have lost Japanese Nationality pursuant to the Treaty of Peace with Japan Art. 4(2)) (the provisions it rests on)

- The certificate gives the holder's name in Roman letters, a number of four Roman letters and eight digits, the date of the residence notification beside the place of residence, and a photograph from the age of one, and records its contents on an IC chip; the West Bank and Gaza are written as Palestine, and a holder with two or more foreign nationalities has the one their permission, previous certificate or notified change shows. A holder whose name uses Chinese characters (漢字) may ask, with proof and together with an application or a change notification, to have it written in them beside the Roman letters, and the Commissioner may write it in Chinese characters instead where Roman letters would put the holder at a serious disadvantage. A name so written can be changed only by a notification of change, unless the Commissioner finds it appropriate.(Art. 4(1), Art. 4(2), Art. 4(3), Art. 4(4), Art. 4(5), Art. 4(6), Art. 4(9), Art. 5(1), Art. 5(2), Art. 5(3), Art. 5(4), Art. 5(6), Special Act on the Immigration Control of, inter alia, those who have lost Japanese Nationality pursuant to the Treaty of Peace with Japan Art. 8(3)) (the provisions it rests on)
- A residence notification is made on Form 5. A notification of a change of name or other details is made on Form 6 with a photograph and proof of the change, an application to renew on Form 7 with a photograph, one for a new certificate after a loss on Form 8 with a photograph and proof of the loss, and one after damage, or to exchange the certificate, on Form 9 or 10 with a photograph; for all but the residence notification the applicant shows their passport (旅券), or explains in writing why they cannot, and, except after a loss, the certificate. A fee is paid with revenue stamps (収入印紙) on Form 12, and a document in a foreign language needs a translation attached.(Art. 6(1), Art. 7(1), Art. 7(2), Art. 8(1), Art. 8(2), Art. 9(1), Art. 9(2), Art. 10(1), Art. 10(2), Art. 10(3), Art. 12(1), Art. 24(1)) (the provisions it rests on)
- A special permanent resident need not come to the municipal office in person where someone acts for them as this Order allows. A residence notification can be made, and the certificate handed back after it collected, by a person they ask (16 or over, other than a cohabiting relative) or by their legal representative; the other notifications and applications by an attorney or administrative scrivener (行政書士) who has notified the regional immigration services bureau (地方出入国在留管理局) through their association, at the holder's request, or by a legal representative — and, for a holder under 16 or unable through illness or another reason, by a relative or cohabitant the Commissioner finds suitable. A holder for whom coming to the municipal office to collect a new certificate (other than a specified one) is seriously difficult may receive it by restricted-delivery post (本人限定受取郵便) where the Commissioner finds it appropriate, and a specified certificate sent on request is received without attending.(Art. 21(1), Art. 21(2), Art. 21(2)(i), Art. 21(2)(ii), Appended Table 2, Special Act on the Immigration Control of, inter alia, those who have lost Japanese Nationality pursuant to the Treaty of Peace with Japan Art. 19(1), Special Act on the Immigration Control of, inter alia, those who have lost Japanese Nationality pursuant to the Treaty of Peace with Japan Art. 19(3), Art. 21(2)(iii), Art. 21(2)(iv)) (the provisions it rests on)
- Someone applying at the municipal office for a specified special permanent resident certificate (特定特別永住者証明書), which also works as an Individual Number Card (個人番号カード), may ask with that application to have it sent, if the mayor took the step under Article 18-5(6) of the My Number Act (番号利用法) and they are among those the Cabinet Order and this Order name. This Order names someone who has made a notice under Article 30-46 of the Basic Resident Registration Act (住民基本台帳法), someone whose card lapsed in the cases the My Number Act's Enforcement Order names or was burnt or badly damaged, and someone released from a prison, workhouse or juvenile training school, each only if they have not had a specified certificate or card since, and someone whose specified certificate has no space left or who is in a like position the Commissioner accepts. It is sent by restricted-delivery post (本人限定受取郵便), or, where the person states they can surely receive it, by registered post not forwarded to another address — to a hospital or other place where they are, if they cannot receive it at home.(Art. 15(1), Art. 16(1), Order for Enforcement of the Special Act on the Immigration Control of, Inter Alia, Those Who Have Lost Japanese Nationality Pursuant to the Treaty of Peace with Japan Art. 8(1), Special Act on the Immigration Control of, inter alia, those who have lost Japanese Nationality pursuant to the Treaty of Peace with Japan Art. 16-2(4), Art. 15(1)(i), Art. 15(1)(ii), Art. 15(1)(iii), Art. 15(1)(iv), Art. 15(1)(v), Art. 16(1)(i), Art. 16(1)(ii), Art. 16(1)(iii)) (the provisions it rests on)
- A specified certificate returned under the My Number Act's rules is brought to a regional immigration services bureau (地方出入国在留管理局) with Form 13, a photograph and the passport, by the holder or, in the cases Article 18(4) names, a cohabiting relative or legal representative.(Art. 18(1), Art. 18(2), Art. 18(4)) (the provisions it rests on)

Special rules and exceptions (4)
- No photograph is needed from a child under one for an application for the special permission, a change notification, or a new certificate after a loss, after damage or for an exchange, unless the Commissioner asks for one; nor when returning a specified certificate for a child under one or for someone who is no longer a special permanent resident.(Art. 1(2), Art. 2(3), Art. 7(3), Art. 9(3), Art. 10(3), Art. 18(3)) (the provisions it rests on)
- Where a holder still has a registration certificate (登録証明書) of the former Alien Registration Act (外国人登録法) that Act No. 79 of 2009 treats as their special permanent resident certificate, Forms 1, 2, 5, 7, 8, 9 and 10 take the registration certificate's number where they ask for the certificate's number.(Suppl. Prov. Art. 10(1), Suppl. Prov. Art. 11(1), Special Act on the Immigration Control of, inter alia, those who have lost Japanese Nationality pursuant to the Treaty of Peace with Japan Suppl. Prov. Art. 28(1)) (the provisions it rests on)
- A certificate issued before 14 June 2026 keeps the entries and record the earlier wording of Article 4 set for it, as Article 4 of the supplementary provisions of Ministry of Justice Order No. 20 of 2026 provides: a certificate showing a photograph was issued to expire on or after the holder's 16th birthday, and the place of residence was recorded on its IC chip only when it was issued.(Suppl. Failing to apply is punishable under Article 31 of the Act.(Art. 8(1), Suppl. Prov. Art. 10(1), Special Act on the Immigration Control of, inter alia, those who have lost Japanese Nationality pursuant to the Treaty of Peace with Japan Suppl. Prov. Art. 28(1), Special Act on the Immigration Control of, inter alia, those who have lost Japanese Nationality pursuant to the Treaty of Peace with Japan Suppl. Prov. Art. 28(2)(i), Special Act on the Immigration Control of, inter alia, those who have lost Japanese Nationality pursuant to the Treaty of Peace with Japan Suppl. Prov. Art. 22(1), Special Act on the Immigration Control of, inter alia, those who have lost Japanese Nationality pursuant to the Treaty of Peace with Japan Suppl. Prov. Art. 22(4), Special Act on the Immigration Control of, inter alia, those who have lost Japanese Nationality pursuant to the Treaty of Peace with Japan Art. 12(1) from 17 June 2022, Special Act on the Immigration Control of, inter alia, those who have lost Japanese Nationality pursuant to the Treaty of Peace with Japan Art. 31(1)(ii)) (the provisions it rests on)
How it is enforced (4)
- Besides immigration inspectors, immigration control officers, police officers and coast guard officers, whom the Act names, customs officials, public security intelligence officers, narcotics agents, municipal staff handling foreign residents' resident records (住民票) and the staff of public employment security offices () may ask a special permanent resident to show their certificate in the course of their duties. Refusing is punishable under the Act by imprisonment (拘禁刑) of up to one year or a fine of up to 200,000 yen.(Art. 19(1), Special Act on the Immigration Control of, inter alia, those who have lost Japanese Nationality pursuant to the Treaty of Peace with Japan Art. 17(2), Special Act on the Immigration Control of, inter alia, those who have lost Japanese Nationality pursuant to the Treaty of Peace with Japan Art. 31(1)(iv)) (the provisions it rests on)
- A special permanent resident who leaves Japan on the deemed re-entry permission (みなし再入国許可) states the intention to come back by giving the immigration inspector (入国審査官) Form 37-19 of the Immigration Control Act's Enforcement Regulation and showing their certificate. The deemed re-entry permission is not open to — and a full re-entry permit is needed by — a special permanent resident the immigration inspector has been told is under one of the departure-hold grounds of Article 25-2(1) of the Immigration Control Act, one issued a written detention order (収容令書), one placed under supervision measures (監理措置), or one the Commissioner finds, on reasonable grounds, needs a re-entry permit for fair immigration control, such as a risk of acts harming Japan's interests or public security. The Commissioner tells the person of that finding on Form 14, or in urgency through an immigration inspector orally, unless they cannot be reached.(Art. 22(1), Art. 23(1), Art. 23(1)(i), Art. 23(1)(ii), Art. 23(1)(iii), Art. 23(1)(iv), Art. 23(2), Art. 23(3), Special Act on the Immigration Control of, inter alia, those who have lost Japanese Nationality pursuant to the Treaty of Peace with Japan Art. 23(2)) (the provisions it rests on)
- An order by the Commissioner to apply for a new certificate, where the old one is badly damaged or soiled, is given on Form 11; the holder must then apply within 14 days. The Commissioner may publish, on the internet or otherwise, the numbers of certificates that are no longer valid.(Art. 11(1), Art. 14(1), Special Act on the Immigration Control of, inter alia, those who have lost Japanese Nationality pursuant to the Treaty of Peace with Japan Art. 14(2), Special Act on the Immigration Control of, inter alia, those who have lost Japanese Nationality pursuant to the Treaty of Peace with Japan Art. 14(3)) (the provisions it rests on)
- This Ministry of Justice Order sets no penalties of its own. Failing the Act's duties it fills in — a false notification, not renewing, not notifying a move — is punished under Articles 31 to 34 of the Act.(Special Act on the Immigration Control of, inter alia, those who have lost Japanese Nationality pursuant to the Treaty of Peace with Japan Art. 31(1), Special Act on the Immigration Control of, inter alia, those who have lost Japanese Nationality pursuant to the Treaty of Peace with Japan Art. 32(1), Special Act on the Immigration Control of, inter alia, those who have lost Japanese Nationality pursuant to the Treaty of Peace with Japan Art. 33(1), Special Act on the Immigration Control of, inter alia, those who have lost Japanese Nationality pursuant to the Treaty of Peace with Japan Art. 34(1)) (the provisions it rests on)
