What this law does
- When a municipality (市町村, which here includes Tokyo's special wards and the wards and composite wards of designated cities) hands out a special permanent resident certificate — after the special permission for permanent residence under Article 4 of the Act (for a descendant born in Japan or staying for another reason), a notification of a change of name or other details, a renewal or a re-issue — the date of issue is recorded on the certificate electronically, and the mayor tells the Commissioner of the Immigration Services Agency (出入国在留管理庁長官) that it was issued, on what date and under what number. The mayor sends that notice through the computer link the Commissioner provides, or in another way a Ministry of Justice Order (法務省令) sets. The same applies when a specified special permanent resident certificate is handed over through the municipal office after an application made with a notice under the Basic Resident Registration Act (住民基本台帳法).(Art. 1(1), Art. 2(1), Art. 2(2), Special Act on the Immigration Control of, inter alia, those who have lost Japanese Nationality pursuant to the Treaty of Peace with Japan Art. 4(1), Special Act on the Immigration Control of, inter alia, those who have lost Japanese Nationality pursuant to the Treaty of Peace with Japan Art. 7(2), Special Act on the Immigration Control of, inter alia, those who have lost Japanese Nationality pursuant to the Treaty of Peace with Japan Art. 11(2), Special Act on the Immigration Control of, inter alia, those who have lost Japanese Nationality pursuant to the Treaty of Peace with Japan Art. 11(3), Art. 8(3), Special Act on the Immigration Control of, inter alia, those who have lost Japanese Nationality pursuant to the Treaty of Peace with Japan Art. 16-2(7)) (the provisions it rests on)

- When a special permanent resident () notifies their place of residence, or a move, at the municipal office — a notice under the Basic Resident Registration Act (住民基本台帳法) made with the certificate counts as one — the mayor passes on to the Commissioner their name, date of birth, sex, nationality or region, place of residence, certificate number, the date and kind of the notice, the date they settled there or moved, and, in most cases of a move, their previous place of residence. When writing the place of residence on the certificate, the mayor also writes the date of the notice on it and records it electronically.(Art. 3(1), Art. 3(1)(i), Art. 3(1)(ii), Art. 3(1)(iii), Art. 3(1)(iv), Art. 3(1)(v), Art. 3(1)(vi), Art. 4(1), Special Act on the Immigration Control of, inter alia, those who have lost Japanese Nationality pursuant to the Treaty of Peace with Japan Art. 10(1), Special Act on the Immigration Control of, inter alia, those who have lost Japanese Nationality pursuant to the Treaty of Peace with Japan Art. 10(2), Special Act on the Immigration Control of, inter alia, those who have lost Japanese Nationality pursuant to the Treaty of Peace with Japan Art. 10(4), Special Act on the Immigration Control of, inter alia, those who have lost Japanese Nationality pursuant to the Treaty of Peace with Japan Art. 10(5)) (the provisions it rests on)
- When a special permanent resident notifies a change of name, date of birth, sex or nationality, or applies to renew their certificate, for a new one after losing it, after damage or on the Commissioner's order, or to exchange it, the mayor makes copies of the documents they showed and sends them to the Commissioner. The Ministry of Justice Order under the Act names the document copied: the passport.(Art. 5(1), Regulation for Enforcement of the Special Act on the Immigration Control of Inter Alia, Those Who Have Lost Japanese Nationality Pursuant to the Treaty of Peace with Japan Art. 13(1), Special Act on the Immigration Control of, inter alia, those who have lost Japanese Nationality pursuant to the Treaty of Peace with Japan Art. 11(1), Special Act on the Immigration Control of, inter alia, those who have lost Japanese Nationality pursuant to the Treaty of Peace with Japan Art. 12(1), Special Act on the Immigration Control of, inter alia, those who have lost Japanese Nationality pursuant to the Treaty of Peace with Japan Art. 13(1), Special Act on the Immigration Control of, inter alia, those who have lost Japanese Nationality pursuant to the Treaty of Peace with Japan Art. 14(1), Special Act on the Immigration Control of, inter alia, those who have lost Japanese Nationality pursuant to the Treaty of Peace with Japan Art. 14(3)) (the provisions it rests on)
- A special permanent resident who asks for a new certificate when theirs is not damaged, simply wishing to exchange it, pays a fee of 1,900 yen. A specified special permanent resident certificate (特定特別永住者証明書) — one the Commissioner has given the function of an Individual Number Card (個人番号カード) — costs 1,900 yen, or 2,600 yen where the Commissioner sends it to the holder rather than handing it over through the municipal office.(Art. 7(1), Art. 8(2), Art. 9(1), Special Act on the Immigration Control of, inter alia, those who have lost Japanese Nationality pursuant to the Treaty of Peace with Japan Art. 14(1), Special Act on the Immigration Control of, inter alia, those who have lost Japanese Nationality pursuant to the Treaty of Peace with Japan Art. 14(5), Special Act on the Immigration Control of, inter alia, those who have lost Japanese Nationality pursuant to the Treaty of Peace with Japan Art. 16-2(1), Special Act on the Immigration Control of, inter alia, those who have lost Japanese Nationality pursuant to the Treaty of Peace with Japan Art. 16-2(9), Special Act on the Immigration Control of, inter alia, those who have lost Japanese Nationality pursuant to the Treaty of Peace with Japan Art. 16-2(16)) (the provisions it rests on)
- Someone applying at the municipal office for a specified special permanent resident certificate, for whom the mayor took the step under Article 18-5(6) of the My Number Act (番号利用法) when they applied, may ask, with that application, to have it sent to them only if they need it quickly: a special permanent resident under one year old who has never had a specified certificate or an Individual Number Card, someone applying within the Act's time limit for a new certificate after losing theirs, or another person a Ministry of Justice Order names. The Commissioner sends it in a way a Ministry of Justice Order sets as one the person can be sure to receive.(Art. 8(1), Art. 8(1)(i), Art. 8(1)(ii), Art. 8(1)(iii), Art. 8(4), Regulation for Enforcement of the Special Act on the Immigration Control of Inter Alia, Those Who Have Lost Japanese Nationality Pursuant to the Treaty of Peace with Japan Art. 4(6), Special Act on the Immigration Control of, inter alia, those who have lost Japanese Nationality pursuant to the Treaty of Peace with Japan Art. 16-2(4)) (the provisions it rests on)

Cabinet Order Partially Amending the Order for Enforcement of the Local Autonomy Act, etc.
地方自治法施行令等の一部を改正する政令
Who it applies to
It applies to
- Mayors of municipalities (市町村の長) — including Tokyo's special wards and the wards of designated cities — which hand out special permanent resident certificates and take special permanent residents' notifications and applications.(Art. 1(1), Art. 2(1), Art. 3(1), Art. 5(1), Art. 6(1)) (the provisions it rests on)
- Special permanent residents who exchange their certificate at their own wish or are issued a specified special permanent resident certificate, and so pay the fees this Order sets.(Art. 7(1), Art. 9(1), Special Act on the Immigration Control of, inter alia, those who have lost Japanese Nationality pursuant to the Treaty of Peace with Japan Art. 16-2(16)) (the provisions it rests on)
Special rules and exceptions (4)
- No fee is charged for a new specified certificate when a holder of one gets it along with notifying a change of name or other details, renewing, or notifying a move; when theirs or its electronic record is badly damaged, or it is badly soiled or lost, through a disaster or other cause not their fault; or when it has no space left for entries. Nor is one charged when a specified certificate was refused and they apply on the day an ordinary certificate is issued, or when its Individual Number Card function lapsed while they were abroad on a re-entry permit (再入国の許可) and they apply after coming back within its validity, or in two other cases the Enforcement Order of the My Number Act (a separate Cabinet Order) names.(Art. 9(2), Art. 9(2)(i), Art. 9(2)(ii), Art. 9(2)(iii), Art. 9(2)(iv), Art. 9(2)(v), Art. 9(2)(vi)) (the provisions it rests on)
- For the time being, no fee is charged either for a specified certificate asked for on the day a special permanent resident recorded in the basic resident register (住民基本台帳) receives their first certificate after the special permission, for one asked for, by someone never issued one, along with a notice under the Basic Resident Registration Act that counts as a residence notification, or for one asked for together with applying for the special permission under Article 5 of the Act. An application of the second kind made before 1 October 2026 is charged as the rules in force before that day provide, as Article 3 of the supplementary provisions of Cabinet Order No. 268 of 2026 says.(Suppl. Prov. Art. 3(1), Suppl. Prov. Art. 3(1)(i), Suppl. Prov. Art. 3(1)(ii), Suppl. Prov. Art. 3(1)(iii), Suppl. Prov. Art. 1(1), Suppl. Prov. Art. 3(1), Special Act on the Immigration Control of, inter alia, those who have lost Japanese Nationality pursuant to the Treaty of Peace with Japan Art. 16-2(2), Special Act on the Immigration Control of, inter alia, those who have lost Japanese Nationality pursuant to the Treaty of Peace with Japan Art. 16-2(3)) (the provisions it rests on)
- A special permanent resident who notifies a move by handing in the registration certificate of the former Alien Registration Act (外国人登録法), which Act No. 79 of 2009 treats as their special permanent resident certificate, has its registration number passed on to the Commissioner in place of a certificate number. For a holder who was under 16 when that Act came into force, the registration certificate is treated so until their 16th birthday.(Suppl. Prov. Art. 2(1), Special Act on the Immigration Control of, inter alia, those who have lost Japanese Nationality pursuant to the Treaty of Peace with Japan Suppl. Prov. Art. 28(1), Special Act on the Immigration Control of, inter alia, those who have lost Japanese Nationality pursuant to the Treaty of Peace with Japan Suppl. Prov. Art. 28(2)(i)) (the provisions it rests on)
- A special permanent resident whose registration certificate of the former Alien Registration Act is still treated as their special permanent resident certificate (someone under 16 on 9 July 2012, until their 16th birthday) must apply through the municipal office to renew it between six months before that birthday and the birthday itself, as Article 12(1) of the Act read before 1 November 2023 — a wording Article 22 of the supplementary provisions of Act No. 56 of 2023 keeps for such certificates. Failing to apply is punishable under Article 31 of the Act.(Special Act on the Immigration Control of, inter alia, those who have lost Japanese Nationality pursuant to the Treaty of Peace with Japan Suppl. Prov. Art. 28(1), Special Act on the Immigration Control of, inter alia, those who have lost Japanese Nationality pursuant to the Treaty of Peace with Japan Suppl. Prov. Art. 28(2)(i), Special Act on the Immigration Control of, inter alia, those who have lost Japanese Nationality pursuant to the Treaty of Peace with Japan Suppl. Prov. Art. 22(1), Special Act on the Immigration Control of, inter alia, those who have lost Japanese Nationality pursuant to the Treaty of Peace with Japan Suppl. Prov. Art. 22(4), Special Act on the Immigration Control of, inter alia, those who have lost Japanese Nationality pursuant to the Treaty of Peace with Japan Art. 12(1) from 17 June 2022, Special Act on the Immigration Control of, inter alia, those who have lost Japanese Nationality pursuant to the Treaty of Peace with Japan Art. 31(1)(ii)) (the provisions it rests on)
How it is enforced (3)
- This Cabinet Order sets no penalties of its own: it sets the steps mayors take and the fees the Act leaves to a Cabinet Order. The penalties for a special permanent resident who fails the Act's duties — a false notification, or not notifying a move within 14 days, for instance — are in Articles 31 and 32 of the Act.(Art. 3(1), Art. 7(1), Special Act on the Immigration Control of, inter alia, those who have lost Japanese Nationality pursuant to the Treaty of Peace with Japan Art. 25(1), Special Act on the Immigration Control of, inter alia, those who have lost Japanese Nationality pursuant to the Treaty of Peace with Japan Art. 10(2), Special Act on the Immigration Control of, inter alia, those who have lost Japanese Nationality pursuant to the Treaty of Peace with Japan Art. 31(1), Special Act on the Immigration Control of, inter alia, those who have lost Japanese Nationality pursuant to the Treaty of Peace with Japan Art. 32(1)) (the provisions it rests on)
- Where a mayor learns that a special permanent resident holds a certificate that is badly damaged or soiled, or whose electronic record is damaged, the mayor must promptly tell the Commissioner in writing, with the holder's name, date of birth, sex, nationality or region, place of residence and certificate number, and send material on the certificate's condition — unless the holder is applying for a new one themselves. The Act lets the Commissioner order a holder of such a certificate to apply for a new one, which the holder must then do within 14 days.(Art. 6(1), Art. 6(1)(i), Art. 6(1)(ii), Special Act on the Immigration Control of, inter alia, those who have lost Japanese Nationality pursuant to the Treaty of Peace with Japan Art. 14(2), Special Act on the Immigration Control of, inter alia, those who have lost Japanese Nationality pursuant to the Treaty of Peace with Japan Art. 14(3)) (the provisions it rests on)
- The work this Order gives municipalities in Articles 1, 2(1) and 4 to 6 — recording the date of issue, telling the Commissioner of an issue, writing the date of a notice on the certificate, sending copies of documents and reporting damaged certificates — is a Type 1 statutory entrusted function (第一号法定受託事務) under the Local Autonomy Act (地方自治法).(Art. 10(1)) (the provisions it rests on)
