Article 17-2Riding Specified Small Motorized Bicycles under the Special Exception on Sidewalks
第十七条の二(特例特定小型原動機付自転車の歩道通行)
Notwithstanding paragraph (1) of the preceding Article, among specified small motorized bicycles, one that falls under all of the following items and is not towing another vehicle (excluding one that can be made to travel by remote operation; referred to as a "specified small motorized bicycle under the special exception" in this Article and the following Article) may travel on a sidewalk where road signs or markings provide that a specified small motorized bicycle under the special exception may travel on a sidewalk; provided, however, that this does not apply where an officer, finding it necessary to ensure the safety of pedestrians, has instructed that the sidewalk must not be used.
while it is traveling on a sidewalk or side strip, it displays, by the method that Cabinet Office Order prescribes, the fact that the specified small motorized bicycle is one that may travel on a sidewalk or side strip;
歩道等を通行する間、当該特定小型原動機付自転車が歩道等を通行することができるものであることを内閣府令で定める方法により表示していること。
when the display under the preceding item is being made, it is one that, due to the structure of its body, cannot attain a speed exceeding the speed that Cabinet Office Order prescribes as a speed at which there is no risk of hindering pedestrians from proceeding on a sidewalk or side strip;
in addition to what is prescribed in the preceding two items, it satisfies the criteria that Cabinet Office Order prescribes as being of a body structure not likely to hinder pedestrians from proceeding on a sidewalk or side strip.
In the case referred to in the preceding paragraph, a specified small motorized bicycle under the special exception must drive at reduced speed on the part of the sidewalk between the center and the roadway (or, if there is a part of the sidewalk for use by standard bicycles, on that part), and must come to a stop if its progress would prevent pedestrians from proceeding; provided, however, that, as regards the part of the sidewalk for use by standard bicycles, if there are no pedestrians proceeding down or about to enter that part, the bicycle may travel down it at a safe speed and in a safe manner, in keeping with sidewalk conditions.
