Order for the Enforcement of the Residential Basic Book Act
住民基本台帳法施行令
The Order for the Enforcement of the Residential Basic Book Act is the Cabinet Order (政令) that fills in the details the Residential Basic Book Act (住民基本台帳法) leaves to it: what else a certificate of residence (住民票) shows, how mayors make and correct it, what people must state or attach when they notify a move, and how long the records are kept.

What this law does
- Filling in items the Act lists, a certificate of residence (住民票) shows the date a person joined or left National Health Insurance, late-stage elderly medical care or long-term care insurance; for the National Pension, the date they joined or left, their category of insured person (種別) and its changes, and their basic pension number (基礎年金番号); and the month child allowance (児童手当) began or ended. It may also show other items serving residents' welfare that the mayor finds need recording to run the municipality's work for residents.(Art. 3(1), Art. 3-2(1), Art. 3-3(1), Art. 5(1), Art. 6(1), Art. 6-2(1), Residential Basic Book Act Art. 7(1)) (the provisions it rests on)

- The document a person moving in must attach to the moving-in notification (転入届) is a certificate of moving out (転出証明書) made by the mayor of their previous address, who issues it on a moving-out notification (転出届) unless the person is moving abroad or the Individual Number Card (個人番号カード) rule of Article 24-2 of the Act applies. It shows the person's name and its kana reading, date of birth, sex, householder (世帯主) details, family register (), My Number (個人番号) and resident record code (住民票コード) as the Act's Article 7 lists them, and also their address, destination and planned date of the move, whether they are insured under National Health Insurance, late-stage elderly medical care or long-term care insurance, their pension category and basic pension number, and whether they receive child allowance. A person who loses or damages it may have it reissued.(Art. 23(1), Art. 23(2), Art. 24(1), Art. 24(2), Residential Basic Book Act Art. 22(2), Residential Basic Book Act Art. 7(1)) (the provisions it rests on)
- A notification under the Act — moving in, moving within a municipality (転居), moving out, a change of household, or a foreign resident's notification — is made on paper that states the address of the person actually making it and the date, and that person signs it.(Art. 26(1), Residential Basic Book Act Art. 27(1)) (the provisions it rests on)
- A person making a notification of moving in, moving within the municipality, moving out or a change of household — or a foreign resident's notification — who is insured under National Health Insurance, late-stage elderly medical care, long-term care insurance or the National Pension adds to it the items Articles 27 to 28 list for that kind of notification, such as that they have become insured, their occupation, an insured person number, or their pension category and basic pension number; a person receiving child allowance states that on a moving-within or moving-out notification. A person who has been issued the health insurance document under Article 9(2) of the National Health Insurance Act (国民健康保険法) or Article 54(3) of the Act on Assurance of Medical Care for Elderly People (高齢者の医療の確保に関する法律), separate Acts, or a long-term care insurance card, for a scheme they add, must attach it; a person adding a basic pension number must attach a document showing it that a Ministry of Internal Affairs and Communications Order (総務省令) names, if they have been issued one.(Art. 27(1), Art. 27-2(1), Art. 27-3(1), Art. 28(1), Art. 29(1), Art. 30(1), Art. 30(2), Residential Basic Book Act Art. 28(1), Residential Basic Book Act Art. 28-2(1), Residential Basic Book Act Art. 28-3(1), Residential Basic Book Act Art. 29(1), Residential Basic Book Act Art. 29-2(1)) (the provisions it rests on)
- A person whose surname has changed may ask the mayor of the municipality where they are registered, in writing, to show on their certificate of residence one former surname (旧氏) recorded in their family register (戸籍) or a removed family register, with its kana reading; if one was shown before and later deleted, only a surname used after that deletion may be asked for. If their registered domicile (本籍) is elsewhere and the mayor cannot confirm it through the family register system, the mayor may ask them for a family register document. Once it is shown, they may ask to switch it to the surname they used just before a later change, or to delete it, and it follows them to a new municipality through the certificate of moving out or the notice between mayors.(Art. 30-13(1), Art. 30-14(1), Art. 30-14(2), Art. 30-14(3), Art. 30-14(4), Art. 30-14(6)) (the provisions it rests on)
- A foreign resident (外国人住民) may ask the mayor, on an application form with supporting material, to show on their certificate of residence an alias (通称) — a name other than their legal name that, because it is in use in their social life in Japan or for another reason, needs recording to prove where they live — and the mayor must enter it when the mayor finds that need. The mayor must delete it when the resident asks, and must also delete it when it is no longer needed, telling the resident or, where that is difficult, giving public notice. The certificate also records the municipality and date of each entry and deletion, with the deleted alias itself, and the alias and that record follow the resident to a new municipality.(Art. 30-15(1), Art. 30-16(1), Art. 30-16(2), Art. 30-16(3), Art. 30-16(4), Art. 30-16(5), Art. 30-17(1), Art. 30-17(2)) (the provisions it rests on)

Cabinet Order Partially Amending the Order for the Enforcement of the Residential Basic Book Act
住民基本台帳法施行令の一部を改正する政令
Who it applies to
It applies to
- The people the Act covers, and so this Order: the Act does not apply to foreign nationals other than the foreign residents its Article 30-45 lists, nor to people outside the Family Register Act (戸籍法), a separate Act — except princesses (内親王 and 女王) who married a man other than the Emperor or a member of the Imperial Family, including one later divorced or widowed — nor to others a Cabinet Order names.(Enacting Stmt. 1, Residential Basic Book Act Art. 39(1) from 24 October 2026) (the provisions it rests on)
- Residents who notify a move or a change of household under the Act, and householders (世帯主), who may notify for members of their household and must when a member cannot: the Order sets the form of the notification, the certificate of moving out to attach, and the items an insured person or child-allowance recipient adds.(Art. 26(1), Art. 23(1), Art. 27(1), Art. 29(1), Residential Basic Book Act Art. 26(1), Residential Basic Book Act Art. 26(2)) (the provisions it rests on)
3 more
- Foreign residents (外国人住民), who may have an alias (通称) shown on their certificate of residence; one who is not the householder and whose householder is also a foreign resident attaches a document proving their relationship to the householder when notifying a move or a change of household, except in the cases this Order lists.(Art. 30-16(1), Art. 30-19(1), Residential Basic Book Act Art. 30-49(1)) (the provisions it rests on)
- People whose surname has changed and who want a former surname (旧氏) shown on their certificate of residence.(Art. 30-14(1)) (the provisions it rests on)
- Lawyers (弁護士), judicial scriveners (司法書士), land and house investigators (土地家屋調査士), certified public tax accountants (税理士), labour and social security attorneys (社会保険労務士) and patent attorneys (弁理士), with their firms: when, for representation in the dispute and appeal procedures this Order lists for each, they ask on a client's behalf for a copy of someone's certificate of residence, removed certificate, family register supplement or removed supplement, the request need state only their qualification and the type of work, not the client's name.(Art. 15-2(1), Art. 17-2(1), Art. 21(1), Residential Basic Book Act Art. 12-3(4)(v)) (the provisions it rests on)
Special rules and exceptions (6)
- A person moving in from abroad, a person who is not recorded in any municipality's register, and a person who cannot attach a certificate of moving out for another unavoidable reason attach none, and add their date of birth, sex and family register () to the moving-in notification instead; a foreign resident adds their nationality or region and the items for their group in place of the family register.(Art. 22(1), Art. 30-21(1), Residential Basic Book Act Art. 22(1)(vii), Residential Basic Book Act Art. 22(2)) (the provisions it rests on)
- An Individual Number Card holder who gave notice of moving out need not attach a certificate of moving out to their first moving-in notification, but must after all if they were recorded in any municipality's register in between, if they notify on or after the earlier of 30 days after the planned moving-out date and 14 days after moving in, or if they do not present the card when notifying. The same three cases apply where a card-holding householder notifies for household members without a card who moved out together.(Art. 24-2(1), Art. 24-2(2), Residential Basic Book Act Art. 24-2(1), Residential Basic Book Act Art. 24-2(2)) (the provisions it rests on)
- No household-change notification is needed from a person who has become the only member of the household other than the householder.(Art. 25(1), Residential Basic Book Act Art. 25(1)) (the provisions it rests on)
- A foreign resident who is not the householder need not notify a change of relationship to a foreign-resident householder if their kinship has not changed or the family register papers on it have been accepted by the mayor. They need not attach a document proving the relationship if they are not related, if they moved out together with the householder and move in together with them, or move within the municipality together with them, where that person remains householder, or — where the mayor finds the kinship can be confirmed — if they move in or within together with another foreign resident who becomes householder, or in a case a Ministry of Internal Affairs and Communications Order sets.(Art. 30-18(1), Art. 30-19(1)) (the provisions it rests on)
- Princesses (内親王 and 女王) who married a man other than the Emperor or a member of the Imperial Family, including one later divorced or widowed, whom the Act keeps within its scope and lets a Cabinet Order make special rules for, are called 婚姻内親王等 (married princesses) here. Their certificate of residence shows their given name and its reading in place of a full name and, in place of a family register, that they are such a princess living in the municipality; accepting a notification under the Act on the Handling of Family Registers of Persons Who Have Left the Status of Imperial Family Members, etc. (皇族の身分を離れた者等の戸籍の取扱い等に関する法律), a separate Act, takes the place of family register papers as what leads the mayor to record. If one leaves the Imperial Family under Article 11 of the Imperial House Act (皇室典範), the mayor makes her an ordinary certificate of residence, and the Grand Steward of the Imperial Household Agency (宮内庁長官), on learning in the Agency's work of anything about her that needs recording and that no notification brings, must tell the mayor without delay.(Art. 33(1), Art. 33(2), Art. 33(3), Residential Basic Book Act Art. 39(1) from 24 October 2026, Residential Basic Book Act Art. 39(2) from 24 October 2026) (the provisions it rests on)
- In a designated city (指定都市) under the Local Autonomy Act (地方自治法), a separate Act, the wards (区) and combined wards (総合区) and their heads stand in for the city and its mayor for the provisions of the Act that Article 31(1) lists and the provisions of this Order that Article 32 lists, so the register is kept, notifications are received and copies are issued by the ward.(Art. 31(1), Art. 31(2), Art. 32(1), Art. 32(2), Residential Basic Book Act Art. 38(1)) (the provisions it rests on)
How it is enforced (8)
- When a notification under the Act is made, the mayor asks the person making it to show a document or explain, to confirm who they are, and — where they act for someone outside their own household — to show that they act at that person's request or under the law; the same checks apply to requests to show or delete a former surname or an alias. The mayor then examines whether what the notification says is true before entering, removing or correcting a certificate of residence on it.(Art. 11(1), Art. 30-14(7), Art. 30-16(6), Residential Basic Book Act Art. 27(2), Residential Basic Book Act Art. 27(3)) (the provisions it rests on)
- Where a person should have notified but has not, the mayor checks the facts and makes the entry on the mayor's own authority (職権), then tells the person — or, where their address and whereabouts are unknown or telling them is otherwise difficult, gives public notice instead.(Art. 12(1), Art. 12(4)) (the provisions it rests on)
- Where an entry is called for, the mayor also updates certificates of residence on the mayor's own authority on receiving family register papers or a notice from another mayor, on assigning a My Number, on facts about health insurance, long-term care, pension or child allowance, on one of the appeal decisions or final court judgments Article 12(2)(vi) lists that differs from the register, and on a change in how addresses are displayed. The mayor does the same on learning that the register leaves someone out or records them wrongly, or that a certificate of residence has an error or omission other than in the resident record code.(Art. 12(2), Art. 12(3)) (the provisions it rests on)
- For a foreign resident, the mayor corrects the certificate of residence on the mayor's own authority on receiving the notice the Commissioner of the Immigration Services Agency (出入国在留管理庁長官) must send under Article 30-50 of the Act when the person's details change or are wrong; the notice is sent from the Commissioner's computer to a computer the mayor is given to use, or in another way a joint Ministry of Internal Affairs and Communications and Ministry of Justice Order (総務省令・法務省令) sets.(Art. 30-20(1), Art. 30-21(1), Art. 12(2)(i), Residential Basic Book Act Art. 30-50(1)) (the provisions it rests on)
- Where a person being entered has been on a register before but the resident record code (住民票コード) they last had cannot be found, the mayor gives them a new one from the codes the Japan Agency for Local Authority Information Systems (地方公共団体情報システム機構) designated, and promptly tells them in writing; the mayor also promptly tells them in writing after correcting an error in their code. A person asking to change their code must show their Individual Number Card (個人番号カード) or a document a Ministry of Internal Affairs and Communications Order names.(Art. 30-2(1), Art. 30-2(2), Art. 30-3(1), Art. 30-4(1), Art. 30-4(2), Residential Basic Book Act Art. 30-3(2)) (the provisions it rests on)
- This Order sets no penalty of its own. Under the Act, a false notification of moving in, moving within the municipality, moving out or a change of household, or a false foreign resident's notification — including a false item added to it, such as the insurance and pension items this Order lists — brings a civil fine (過料) of up to 50,000 yen unless another law punishes it with a criminal penalty, and so does failing without good reason to make one of those notifications; the summary court () decides these fines. Obtaining a copy of a certificate of residence, removed certificate (除票), family register supplement (戸籍の附票) or removed supplement by deception or other wrongful means is a crime punished with a fine (罰金) of up to 300,000 yen.(Residential Basic Book Act Art. 52(1), Residential Basic Book Act Art. 52(2), Residential Basic Book Act Art. 53(1), Residential Basic Book Act Art. 46(1)(ii)) (the provisions it rests on)
- The mayor keeps removed certificates of residence (除票) and removed family register supplements (戸籍の附票の除票) for 150 years from removal or re-preparation, and notification forms and other papers for one year from acceptance. The identity confirmation information (本人確認情報) — a person's name and its kana reading, date of birth, sex, address, My Number and resident record code, with details of the entry — that the mayor sends to the prefectural governor is kept by the mayor, the governor and the Japan Agency for Local Authority Information Systems for 150 years, counted, for an entry or correction, from the next notice about that person, and for a removal, from the notice itself.(Art. 34(1), Art. 34(2), Art. 34(4), Art. 30-6(1), Art. 30-7(1), Residential Basic Book Act Art. 30-6(1)) (the provisions it rests on)
- Where the Act lets the Japan Agency for Local Authority Information Systems pass identity confirmation information other than the resident record code to the national bodies and corporations listed in the Act's first appended table (別表第一) or to prefectural and municipal bodies, or lets a prefectural governor pass it to the prefecture's other bodies, it is passed either over a telecommunications line or on a magnetic disk, as a Ministry of Internal Affairs and Communications Order sets.(Art. 30-8(1), Art. 30-9(1), Art. 30-10(1), Art. 30-11(1), Art. 30-12(1)) (the provisions it rests on)
